This permit, issued on february 23, 1994 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) Prior to any construction and/or excavation at the site, a preconstruction meeting will be held
at the site between the applicant, contractor and representative of the Division of Coastal
Management.
Excavation and Filling
2) In order to protect populations of juvenile finfish and crustaceans, no excavation will be
permitted between the dates of April 1 and September 30 of any year without prior approval of
the Division of Coastal Management, in consultation with the Division of Marine Fisheries.
3) Excavation will not exceed seven (7) feet below the elevation of normal water.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1997
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
4) The temporary placement or double -handling of excavated or fill materials within waters or
vegetated wetlands is not authorized:
5) No excavated or fill material will be placed at any time in any marsh or surrounding waters
outside of the alignment of the fill area indicated on the workplan drawings.
6) All excavated materials will be confined above mean high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover
of solids into any marsh or surrounding waters.
7) A permanent ground cover sufficient to restrain erosion will be provided on all exposed areas
within the shorter of 30 working or 120 calendar days after project completion.
Bulkhead Construction
8) The alignment of the proposed bulkhead will be staked by a representative of the Division of
Coastal Management prior to its construction.
9) The bulkhead must be constructed prior to any backfilling activities.
10) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through
the structure.
11) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles
or other suitable materials approved by department personnel. No excavation is permitted,
except for that which may be required for the construction of the bulkhead wall, riprap, deadmen
cables, etc. This permit does not authorize any excavation waterward of the approved
alignment.
12) The fill material will be clean and free of any pollutants, except in trace quantities. Metal
products, organic materials, or unsightly debris will not be used.
13) All backfill materials will be obtained from a highground source and confined landward of the
permitted bulkhead.

Operation and Maintenance
14) This permit authorizes only docks, piers and other structures and used located in or over the
water that are expressly and specifically set forth in the permit application. No other structures,
whether floating or stationary, may become a permanent part of this docking facility without
permit modification. No non -water dependent uses of the structures, except as shown in the
permit application may be conducted on, in, or over public trust areas without permit
modification.
15) The permittee will maintain the authorized work in good condition and in conformance with the
terms and conditions of this permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without having the permit transferred to. a third parry.
16) The authorized structure and associated activity will not cause an unacceptable interference with
navigation.

I would like the following Conditions be placed on the subject permit when it is issued:
(1) Excavation will not exceed 7 feet below the normal water level.
(2) The bulkhead must be constructed prior to any backfilling activities.
(3) The bulkhead must be structurally tight so as to prevent seepage of backfill materials
through the structure.
(4) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet
piles or other suitable materials approved by department personnel. No excavation is
permitted except for that which may be required for the construction of the bulkhead
wall, riprap, deadmen cables, etc. This permit does not authorize any excavation
waterward of the approved alignment.

(11) The alignment of the proposed bulkhead will be staked by a representative of the
Division of Coastal Management prior to its construction.

SUBJECT: Marion Dilday Proposal, East and Latham Street, Town of Belhaven, Beaufort
County, North Carolina
This proposal includes enlarging an existing boat house, the addition of a mooring dock and
bulkhead and maintenance excavation in a manmade canal. Coastal wetland AEC's, estuarine
waters, marsh fill is proposed.
The proposal comes under the auspices of the March 1993 CRC Certified Belhaven Land Use
Plan Update. The Plan offers the following guidance on proposals of this type:
Town policy on AEC's (Page 26-27) notes their importance and "The policy shall be to
support current Federal, State and local regulations with regard to development in areas
of environmental concern."
Town policy on Damages to Existing Marshes by Bulkhead Installation (Page 31) is
"conservation". "Implementation shall occur through local support of State and Federal
standards for bulkheading. No additional local initiative will be taken regarding
bulkheads."
Town policy on Types of Urban Growth Patterns Desired (Page 36) notes the Town will
be "to rely on the local zoning ordinance for guiding urban growth into areas classified
as developed or urban transition on (]and classification) the map."
The site for this proposal is shown on the Town's Land Classification map (Page 53a) in both
the Developed and Conservation Land classes.
The Developed class (Page 54) calls for the whole range of urban land uses at various densities
with services necessary to support that development.
The Conservation class (Page 55) includes all AEC's and notes the importance of protecting
these resources through careful management. The discussion continues by allowing specific
uses:

"1. Water oriented uses such as docks, piers, mooring pilings, bridges ...
if shown not to cause a detriment to the AEC or conservation lands."
"I Bulkheading, when construction of the bulkhead can be conducted without
significantly altering the ecological system, and in compliance with
existing Federal, State and local regulations."
My opinion is the proposal if completed in accordance with Federal, State and local regulations
would not be inconsistent with the 1993 Belhaven Land Use Plan Update.

The applicants own a 1.3 acre tract of land adjacent to Tom's Creek at the intersection
of East and Latham within the Town of Belhaven in Beaufort County. Four applicants are
involved in the subject application, three of which are part owners of a ±0.65 acre lot on which
is a boathouse an associated amenities. The other applicant also owns a 0.65 acre lot on which
is a single family dwelling.
The boathouse lot is vegetated mostly with loblolly pines and various lawn grasses. The
50, by 50' enclosed boathouse has been in existence for many years and is constructed atop a
manmade basin which is connected to Tom's Creek. The boathouse is utilized to moor 3
vessels. Water, depths within the boathouse an immediately offshore average ±4' 6" at normal
water. Water depths of 6.0' to 7.0' are located several hundred feet beyond the basin and
boathouse.
The dwelling lot (Hackney) is also vegetated mostly with loblolly pines and various lawn
grasses. However, along most of the shoreline is a fringe of Coastal Wetlands, marsh which
is dominated by SSpartina cvnosuroides, Svartina patens, and Distichlis s_picata. The majority of
the marsh is growing atop old fill or within various types of rubble that has been historically
placed along the shoreline in an effort to retard ongoing erosion. Also located on the east end
of the property within Tom's Creek is a ± 10' long private pier with a T-shaped waterward end.
Project proposal
The applicants are proposing the following:
(1) The enlargement of the existing boathouse from 50' by 50' to 50' by 56' by
relocating the north wall 6' in a northern direction. Also the existing roof line
will be raised by 8.0' which will make the finished roof line ±18' above the
NWL. A ±20' long by ±12' wide storage shed is to be constructed at the
northwest comer of the new boathouse. ±4.0' of this storage shed will be
constructed beyond a proposed bulkhead over the open water area of the basin.
The reason for the boathouse modification is to accommodate a new boat which
has been purchased by Mr. Marion Dilday, the owner of the northern portion of
the boathouse.

(2) The construction of ±278' of bulkhead. The bulkhead will begin at the northwest
comer of the boathouse and will extend in a east, northeast direction along the
property of Mrs. Hackney. The bulkhead will average 3' 6" beyond the NWL
and will be 9.0' at the furthest point. The bulkhead will be aligned on the
waterward side of the marsh on the Hackney property. The marsh will be filled
along with the confined open water area when the bulkhead is backfilled.
(3) The construction of 115' by 4.0' wide dock. The dock will begin at the
northwest corner on the inside and along the relocated wall of the boathouse. It
will extend the length of the boathouse and then 50.0' additional feet east of the
boathouse just waterward of the proposed bulkhead. The dock will be utilized by
Mr. Dilday for mooring.
(4) The maintenance excavation of 50' long by 25' wide area beneath the existing
boathouse within the manmade basin. Approximately 2' of material will be
excavated resulting in a final project depth of -7' at normal water. Also an area
150' long by 52' wide within the access channel leading to the boathouse will also
be excavated. Within this area 2' of material will also be removed resulting in
a final project depth of -7' at normal water. All spoils from the excavation will
be placed on the Hackney lot and will be utilized for landscaping purposes and
for bulkhead backfill.
Environmental impact
The following environmental impacts will occur as a result of project activity:
(1) ±951 sq. ft. of coastal wetlands will be filled landward of the proposed bulkhead.
(2) ±1,000 sq. ft. of open water area will be filled landward of the proposed
bulkhead.
(3) ±9,050 sq. ft. of open water area within the manmade basin will be excavated.
(4) Some short term turbidity will occur during project excavation and construction.
