(1) That no excavated or fill material be placed nC any time In any marsh or
waters of the state.
(2) That all excavated materials be confined on high ground behind adequate
dikes or other retaining structures to prevent spill -over of solids into
any marsh or surrounding waters.
(3) That in order to protect water quality, a central sewage treatment facility
must be installed to service any additional development established after
the issuance date of this permit. NOTE( Plans for this system must be ap-
proved prior to installation by the linvironmental Operations Sectton of the
Division of Environmental Management.
(4) That the boat railway not be used in conjunction with sandblasting, spray
painting or other uses that wl.11 adversely effect water quality.

RE: MODIFICATION OF STATE PERMITS - ROLAND DALE
In December, 1978,State permits were issued to Mr. Dale to excavate a boat
basin and widen a 1400' section of canal at his property in Hyde County off
of SR 1108.. Mr. Dale's overall development plans showed construction of a
bait and tackle shop, boat launching facilities and a trailer park. The
1978 permit gave permission to excavate but also required installation of
a central sewage treatment and disposal system for the associated high ground
development. Due to the cost of the treatment facility, Mr. Dale abandoned
the trailer park plan and apparently has stopped with the construction of the
J bait and tackle shop, placement of three trailers and sewage hook-up for a
small number of camper trailers.
Mr. Dale now seeks permission to widen a 2600' section of canal from 50' to
70', construct a boat launch railway and place a 350' wooden jetty at the
mouth of the canal to control shoaling.
A copy of the previously issued CAMA permit, updated field report and modified
permit application are attached for your review. Please submit comments con-
cerning this proposed modification by July 9th.

On 7 May 1980 this office received an application for a State
permit for proposed maintenance and new work at White Plains
Marina. This memo is a result of our conversation to treat
the proposed work as a modification of Mr. Dale's previous
permit instead of processing a new permit.
t At the present time, existing at White Plains Marina is a
+ 3,300' long by + 50' wide by + 4-6' deep canal with several
boat basins, and boat ramp. Structures present consist of three
mobile homes and a bait and tackle shop.
The applicant is proposing to widen a 2,600' long portion of
the canal by a width of 20'. That portion of the canal to be
widened starts at the northern end nearest SR 1108 and proceeds
2,600' toward the mouth of the canal. The depth of the canal
is adequate in this area so the entire width does not need
maintaining. All excavated materials will be placed on adjacent
highground on the eastern side of the existing canal. No wetland
vegetation will be excavated or filled.
The remainder of the canal (+7001) will not be widened but
only maintained to a depth of -6' MLW. All excavated materials
will be placed on an existing 30' wide spoil area located on the
east side of the existing canal. Again, no wetland vegetation
will be excavated or filled.
Also proposed is a + 350' long wooden jetty which is to be
constructed on the, eastern side of the mouth of the existing
canal. The purpose of this is to try to halt the shoaling

effect which is presently occurring at the mouth of the canal.
The last portion of the proposed project is the construction
of a 20' by 40' railway which will be constructed on the western
side of the canal + 1,000' from the northern end. The railway
will be used for minor activities such as replacing shafts, bent
props, etc. No sandblasting or spray painting will occur at the
site.

development in accordance with the submitted application and
Department findings, Plans for this system must be approved
by the Water Quality Section of the Department prior to the
development of any additional lots and evidence of such approval
must be available on site for review by Department enforcement
personnel,
During an onsite investigation of the proposed project on 13 May
1980 i observed along with other personnel of this department
the following facilities present at the site: (1) bait and
tackle shop (possible restaurant), (2) two mobile homes,
(3) connections for mobile campers,
I would at this time appreciate if you would review Mr. Dale's
existing facilities along with his future plans to determine
if he is presently violating the above stated condition of
permit no. 25,
This review is necessary so that I may be provided the needed
information so that I may determine whether Mr. Dale is in
violation of his permit so that I may pursue enforcement
alternatives, if necessary,
