Division of Coastal Management on August 26, 2022, regarding your concerns about the proposed development by Mr. Mark. McGarity, at property located at 126 Fayetteville Street, in Holden Beach, NC. The project consists of 'constructing a new boat lift, at an existing docking facility in the canal adjacent to the subject property. Based on consistency with the Rule requirements outlined in 15A NCAC 07H .1200, GENERAL PERMIT FOR CONSTRUCTION OF PIERS AND DOCKING FACILITIES: IN ESTUARINE AND PUBLIC TRUST WATERS AND OCEAN HAZARD AREAS, a permit has been issued to authorize the development. I have enclosed a copy of the permit, as well as the relevant statutes. Please note: This office (DCM Wilmington) is returning the $500 dollars in cash that you enclosed in your correspondence and objection letter received by DCM on August 26th 2022. Your funds are being returned in the form of a $500 cashier's check (Check No. 6731301735) included in this correspondence. Please note that there is no fee for submission of your objections or comments with regard to CAMA proposals. If you wish to contest our decision to issue this permit, you may file a request for a Third Party Appeal. The Chairman of the Coastal Resources Commission will consider each case and determine whether to grant your request to file for a Contested Case Hearing. The hearing request must be filed with the Director, Division of Coastal Management, in writing and must be received within twenty (20) days of the permit decision.
