This permit, issued on ) � )E ' '' Z , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) No attempt will be made by the permittee to prevent the full and free use
by the public of all navigable waters ar or adjacent to the authorized work.
(2) It is possible that the authorized structure may be damaged by wavewash
from passing vessels. The issuance of this permit does not relieve the
permittee from taking all proper steps to ensure the integrity of the permitted
structure and the safety of moored boats from damage by wavewash.
(3) The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The pe::::;;tee
is not relieved of this requirement if he abandons the permitted activity
without transferring it to a third party.
(4) If the permittee discovers any previously unknown historic or archaeological
remains while accomplishing the authorized work, he will immediately notify
the Wilmington District Engineer and the Div. of Coastal Management in order
to initiate the required State/Federal investigation.
(5) The activity will be conducted in such a manner as to prevent significant

or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1989
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

Dear Mr. Dunn:
This letter of refinement is in reference to your 29 September 1989 request to
modify Major CAMA permit #96-86 issued to you on 6 May 1986 for a 20' long jetty,
a new deck, gazebo, pier extension, tie -off pilings and finger piers onsite of
your property near the waterward end of SR 1340 on Bath Creek in Bath Township,
Beaufort County. This permit is valid through 31 December 1989.
Your request to modify the aforementioned permit to allow the relocation of one
existing mooring piling to a position 45' east of its present location and in
line with the "new pier addition" is hereby authorized. All permit conditions
including the 31 December 1989 expiration date still apply and remain unchanged.
Your modified plat (attached) illustrating the authorized change will became
a part of your permit and file and construction should be accomplished
accordingly.

This letter of refinement is in reference to your request to modify your Major CAMA
Permit #96-86. Your request was hand delivered to this office by Jeff Woolard on
10 March 1988. Permit #96-86 was issued for a jetty, decks, finger piers, mooring
pilings, a gazebo and pier extension onsite of your property adjacent the west side of
Bath Creek near the end of SR 1340 in Beaufort County, North Carolina.
Your request to modify the aforementioned permit to allow the installation of three
additional mooring pilings, two on the west and one on the east side of an existing
pier (per the attached plat) is hereby authorized. All permit conditions including
the 31 December 1989 expiration date still apply and remain unchanged. Your
modified plat illustrating the authorized changes will became a part of your permit
file and construction should be accomplished accordingly.

Dear Mr. Parker:
Reference the application of Mr. L n A. Dunn, r., for a
Department of the Army permit to recons extend a pier on
Bath Creek, Bath Township, Beaufort County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. No attempt will be made by the permittee to prevent the
full and free use by the public of all navigable waters at or
adjacent to the authorized work.
b. It is possible that the authorized structure may be
damaged by wavewash from passing vessels. The issuance of this
permit does not relieve the permittee from taking all proper steps
to ensure the integrity of the permitted structure and the safety
of moored boats from damage by wavewash. The permittee will not
hold the United States or the State of North Carolina liable for
any such damage.
c. The permittee will maintain the authorized work in good
condition and in conformance with the terms and conditions of this
permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without transferring it to a third
party.

d. If the permittee discovers any previously unknown historic
or archeological remains while accomplishing the authorized work,
he will immediately notify the Wilmington District Engineer who
will initiate the required State/Federal coordination.
e. If possible under applicable law, the permittee will
incorporate this permit as part of the documents reflecting title
to or interest in the real property affected. .'

Also proposed are two decks, jetty, gazebo and finger pier with pilings.
Environmental setting
The applicant owns a lot located on Bath Creek with the following dimensions: 195'
(waterside) x 212' (south side) x 150' x 122' (north side). Located on the lot is
an existing single family dwelling which is served by a septic tank sewage disposal
system. The lot is presently bulkheaded, and existing also is a boathouse and + 92'
long pier.
No wetland vegetation is located on the lot.
Project proposal
The applicant is proposing the following:
(1) A 20' long jetty which will be used to create a pontoon boat slip-
(2) A new walkway on highground which will connect to a new 8' x 16' deck. This
deck will be connected to the existing pier. '
(3) A 16' x 16' deck which will be connected to the existing 16' x 16' deck.
(4) A 16' x 16' gazebo which will be constructed atop the existing 16' x 16' deck.
(5) A 58' long by 8' wide pier extension, which will be connected to the existing 16'
x 16' deck.
(6) A 34' long by 4' wide finger pier which will be connected to the new section of
pier. Flour tie -off pilings will be constructed alongside the finger pier.
Environmental impact
The project as proposed should have a minimal environmental impact. No wetland
vegetation will be excavated or filled. No excavation will occur in Bath Creek.
