That all spoil be placed above high water and so placed as to prevent its re- entry into surrounding waters. That all work be carried out as per your. application. THIS PERMIT IS VOID IF THE ABOVE CONDITIONS ARE NOT PRECISELY FOLLOWED. Notification of project completion must be given this office. This permit must be displayed with a copy of the application and the project map in the cab or pilot -house of the vehicle working on the project, whichever is applicable, or be easily accessible on site to Department of Conservation and Development personnel. This permit is terminated on Dec. 31, 1973 Any additional work or maintenance work on the project subsequent to the termination of this permit requires a new permit. The permit, (as approved with conditions), may be objected to by the applicant or by interested State agencies within twenty days of the date of issuance by giving written notice to the Department of Conservation and Development. The applicant is advised of the requirement under G. S. 146-6.1 that power -operated earth - moving equipment operating or to be operated in or on publicly owned tidelands, publicly owned beaches, publicly owned marshlands, or navigable waters within the State must be registered by the owner of the equipment with the Department of Water and Air Resources. Jim Brown From Bob Pittman Subject App. for Permit - Alfred Dodge - 3-7.72 Location - Swan Quarter, N. C. on State Road 1138 InvestiSatedd April 6, 1972 Environmental settinr, - The project is located on a man made canal. The canal, approximately 25' wide, joins Rose Bay Creek which, in turn, drains into Rose Bay. Mr. Dodge has a w-arine railway at the site in addition to several dock- ing areas located along the canal. The property is relatively high with bushes and shrubs scattered over the location. Adjacent to the railway slip a 150' long by 80' wide area has been excavated from the highland but does not con- nect to the canal. An area approximately 80' long by 12' wide separates this "hole" from the canal. I 4plicant'a proposal - Mr. Dodge proposes to excavate the area separating the "hole" from the canal. Approximately 600 cubic yards of material is to be removed by dragline and deposited adjacent to the basin on an existing spoil area. Environmental effects - N66ther the excavation nor the spoil area contains any marshgrass. Apparently the "hole" wad dug without Any connection to the exist- ing canal in order to bypass the need for a dredge and fill permit. Now that the project is almost completed, Mr. Dodge has requested to connect the basin with the navigable water of the canal. I can foresee no major detriment to marine fishery resources if the project is completed as proposed. The map of the proposed project which you furnish, however, is in- adequate for our needs in investigating the work you want to do. At- tached is an "example copy" of a map which you may use for reference in submitting a new map to us. I am returning the map you sent us with the request that you pre- pare a new one, being sure that you draw the map to some scale show- ing reliable dimensions. Also indicate by red crossmarks the area to be draglined, and indicate in red where the spoil disposal will be placed. It will also be necessary to indicate the high and low water marks and to furnish a "location" map. This location map may be taken from a C&CS Chart or a road map - anything to enable us to locate easily the site when we make our on -site inspection. Please return your corrected map to my attention at the above More- head City address. Upon receipt of it we will continue with the in- vestigation and processing of your application.
