(at Pamlico Beach) as requested in your application dated 7/28/75 & attached plats, (2), no date subject to the conditions set forth below. (1) That the river banks immediately adjacent to both ends of the existing bulkhead be stabilized to prevent erosion of fill material. P (2) Landscape the proposed reclaimed land and stabilize with vegetation to control erosion. (3) That the activity be conducted in such a manner as to prevent significant increases in turbidity outside of the area of construction or construction -related discharge (increases of 25 JTU's or less are not considered significant). THIS PERMIT WILL BE VOIDED AND WORK STOPPED IF THE ABOVE CONDITIONS AND THE PLANS AND SPECIFICATIONS SUBMITTED AS PART OF THE APPLICATION (WHERE NOT IN CONFLICT WITH THE CONDITIONS) ARE NOT FOLLOWED PRECISELY. PERSONS FOUND GUILTY OF A VIOLATION UNDER G. S. 113-229 ARE SUBJECT TO A FINE OR IMPRISONMENT, OR BOTH. This permit, (as approved with conditions), may be objected to by the applicant or by interested State agencies within twenty days of the date of issuance by giving written notice to the issuing office. If the applicant does not submit an objection, this will be interpreted as an agreement of compliance with all permit conditions. This permit must be displayed along with a copy of the application and the project map in the cab (or pilot -house) of the vehicle working on the project, or be easily accessible on site to Department personnel when the project i.: inspected. Notify: Permir Section, Division of Marine Fisheries, Box 27687, Raleigh, North Carolina, 27611 when the project is completed. Any maintenance work or additional work on the project subsequent to the termination of this permit requires permit renewal and/or modification. Denton 7-28-75 Location - Beaufort County - near Pamlico Beach. The project site is located along the north side of Pamlico River adjacent to the western extension of SR 1730. Project site is approximately 1/2 mile west of Sawyers Grocery Store. The driveway to the site is marked by white posts on either side of the path, with a removable aluminum cable stretched between.the posts. Investigative process - App. rec. Raleigh 7-29-75; Morehead 7-31-75. Site investigated with applicant's son 8-21-75. Environmental setting - The project site is a 70' wide waterfront lot along the north side of Pamlico River. A creosote bulkhead has been placed along the shoreline of the site some 5' offshore of the MWL. The bulkhead has not been backfilled, however. A 5-10' wide bor- der of rock and concrete rip -rap has been placed adjacent to and in front of the bulkhead and along the wings on the east and west property line of the site. The 5-6' high bank inshore of the existing bulkhead was experiencing severe erosion prior to bulkhead con-„- struction. Several small pines have recently been undermined and fallen into the water behind the existing bulkhead. No marsh or submergent vegetation was observed in the sandy river substrate. The interior portion of the site contains the applicant's small vacation cottage. The lawn surrounding the cottage is well grassed except for the heavy wooded area adjacent to SR 1730. According to my telephone conversation with the applicant, and my discussion with his son on site, Fisheries Inspector Ward McGahey observed the bulkheaded shoreline in late May or early June. According to the applicant, Inspector McGahey told him not to backfill the bulkhead until he had received the necessary drege and fill permits. Mr. McGahey gave the applicant the forms and the applicant subsequently applied for the necessary permits. Project description - The applicant proposes to backfill the existing bulkhead with ma- terials obtained from a highland borrow area. The purpose of the project is to protect the applicant's eroding bank and to reclaim a small portion of the land lost to erosion. Environmental impact - If the project is completed as proposed, approximately 350 sq.ft-. of water area will be filled. However, the applicant is only attempting to stabilize shore- line in the project area, and to reclaim a small portion of his lot which has been lost to erosion.
