This permit, issued on Z`Z,� 7 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The structures will be constructed in accordance with the attached work
plats.
(2) The residential area and community lot must not exceed the effective impervious
cover and setback requirements as specified in NCAC 2H.0208(e) to control
stormwater runoff.
(3) The activities associated with this project will require the submittal of
an erosion -sedimentation control plan. The plan must be filed with N. C.
Dept. of Natural Resources and Community Development, Division of Land Resources,
Land quality Section, P. 0. Box 1507, Washington, NC 27889.
(4) All graded slopes and fills must be provided with a ground cover within
30 working days of placement.
(5) The activity will be conducted in such a manner as to prevent a significant
increase in turbidity outside the area of construction or construction -related
discharge. Increases such that the turbidity in the waterbody is 50 NTUs
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1990
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

or less are not considered significant.
(6) Prior to occupancy of any slips authorized under this permit, the permittee
will permanently equip the marina with a pumpout facility to service boats
with holding tanks.
(7) The marina shall prominently post and enforce a no sewage discharge policy.
(8) All floating structures, other than boats, used for habitation or commerce
(as defined in 15 NCAC.0602) shall be in conformance with local regulations
for onshore sewage treatment.

(9) No person shall be allowed to live aboard vessels in the marina.
(10) The marina shall only be used for docking of vessels associated with North
Creek Landing residential development. No transient dockage, fueling or
commercial services shall be offered as part of this marina.
(11) The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee
is not relieved of this requirement if he abandons the permitted activity
without having it transferred to a third party.
NOTE: Some of the lots adjacent to North Creek have extensive areas of wetland
vegetation. The permittee should instruct. individual lot owners to contact
a representative bf the Division of Coastal Management or Corps of Engineers
prior to commencement of any development activities.
NOTE: It is unlikely that future excavation within the marina area would receive
favorable review due to its location within a primary nursery area.
NOTE: Permanent reflectors should be attached to the structure in order to
make it more visible during hours of inclement weather or darkness.
NOTE: Section 401 Water Quality Certification No. 2048 was issued on March
23, 1987 for this project by the Division of Environmental Management.
NOTE: Within the development is a •family cemetery that is currently being regis-
tered with the Archives and Records Section of the Department of Cultural
Resources. This cemetery must be properly designated and protected accor-
ding to N.C.G.S. 65-3 concerning the care of rural cemetaries. For more

NOTE: The permittee should contact the local health- department regarding their
requirements for septic tank installations (as required under 10 NCAC
10A.1900 et. seq.). For information concerning septic tank and other

8. Project summary The applicant is proposing to subdivide a 137 acre tract of land on
North Creek into 20 residential lots construct a boat ramp and construct an 80' long
marina pier with 11 finger piers
Environmental setting
The applicant owns a 137 acre tract of land in Beaufort County which borders North
Creek, and Ashon Gut. A portion of the property was timbered in the early 1980's
and since that time has been used periodically for agriculture. The portion that
was not timbered has remained vegetated with mixed hardwoods and pines. The
majority of the property which borders North Creek, Ashon Gut and another unnamed
gut to North Creek is vegetated by a wide fringe of marsh. The marsh is dominated
by S�arti�na cXnosuroides, Juncus roemerianus, Spartina alterniflora, Typha spy., and
others. Within the past year since the applicants purchaseTthe property, a
considerable amount of road improvement and landscaping has occurred.
North Creek and the guts are classified as a primary nursery area by the Division of
Marine Fisheries and are classified as "SA" Waters by the Division of Environmental
Management. The creek is classified as polluted and has been closed to shellfishing
by the Division of Health Services.
Project proposal
The applicant,is proposing the following:
(1) The.subdivision of a portion of the property into residential lots each being
130' by 300' or + 39,000 sq.ft. Twenty such lots will be created. Each lot will
be served by an individual septic tank and well.
(2) The creation of a community lot on North Creek which will serve all of those
who purchase a lot. Located on this lot will be the following: (a) A 25' long
by 10' wide boat ramp with an adjacent 32' long by 3' wide walkway pier. The ramp
will be constructed of precast concrete sections which will be placed on salt -
treated girders; (b) An 80' long 6' wide marina pier with two T-sections. Eleven,
12' long finger piers will be constructed with tie -off pilings which will create
22 mooring slips. These slips are for,residents only, thus there are no plans to
lease the slips at this time. The water depths in the vicinity of the proposed
pier average just less than 4' at NWL, thus the size -and types of vessels which
can utilize the slips are limited. No excavation is being proposed. The width
of North Creek at the proposed pier site is + 380'. The total length of the
pier including tie -off pilings is 1161, just less than one-third of the total width
of the creek.
Environmental impact
If the project is conducted as proposed + 20 sq.ft. of Spartina alterniflora will
be covered by the proposed boat ramp. 7Fis will be the only wet an s isturbed.
The marina pier will cover + 8,700 sq.ft. of surface area of North Creek, a
primary nursery area. The impacts to North Creek will be those associated with
runoff of developed residential lots and those associated with the boating activity
at the marina.

This proposal is for the subdivision of 137 acres of property on North Creek into
20 residential lots (average size 6.8 acres) and an 80' long communal pier for use
by prospective property owners.
The predominant land classification for the site is the rural class (with a note on
the land class map that by definition all coastal wetland AEC's are in the conservation
class). The 1982 Beaufort County Land Use Plan defines the rural class as (pg 3-9)
!! rimarily as a resource production area including farming, mining and forestry."
The discussion of the community class (pg 3-7) builds on the community classification
used in the 1976 plan which acknowledged the intent of the community class (pg 3-2, 3-3)
"...is to provide for clustered land development to meet housing, shopping, employment
and public service needs within the rural areas of the county. Lands classified
community are those areas within the rural areas... characterized by a small grouping
of mixed uses (residence, general store, church, school, etc.) and which are suitable
and appropriate for small clusters of rural development not requiring municipal
sewer service."
It appears this proposal would be more "community" than "rural" insofar as the land
classification discussion. The project would thus be inconsistent with the county's
stated intent for the rural class.
Similarly language in the 1982 plan (pg 2-24) concerning vacation homes acknowledges
potential problems associated with shoreline development. The plan includes a
hecommendation that steps be taken on the county's part to adopt subdivision
regulations to help mitigate these potential impacts.

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received January 13, 1987, for a
Department of the Army permit to construct a pier providing 22
moorings and boat ramp facilities on North Creek off the Pamlico
River, west of Belhaven, in Beaufort County, North Carolina,
indicates it to be a candidate for Federal authorization under
this general permit. Accordingly, the administrative processing
of your application will be accomplished by the North Carolina
Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State -Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act and Section 404 of the Clean Water Act, has been
assigned No. SAWC087-N-007-0182 and will be coordinated by Mr. Ken

As we discussed during our recent telephone conversation, this office has received
an application for state permits from Mr. Earl DeHoog and Mr. Arie DeHoog to
develop a subdivision and marina on North Creek in Beaufort County. Enclosed is
a copy of their permit application for your reference.
As you are aware, in all permit application reviews, a review of the appropriate
land use plan which includes the area in which the project is located is conducted.
Attached for your reference is a memorandum to me from John Crew in which he
discusses how the subject project relates to the Beaufort County Land Use Plan.
As you can see, John feels that the project is inconsistent with the rural classi-
fication. I would appreciate your review of this matter and would appreciate you
forwarding to me your opinion so that I can inform the applicant of what course
he needs to follow.

Dear Mr. Parker:
Reference the application of Mr. Earl DeHoog and Mr. Arie
DeHogg for a Department of the Army permit to construct a pier

The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. Use of the permitted structures and associated activities
must not interfere with the public's right to free navigation on
all navigable waters of the United States.
b. If the display of lights and signals on the authorized
structure is not otherwise provided for by law, such lights and
signals as may be prescribed by the U.S. Coast Guard will be
installed and maintained by and at the expense of the permittee.
c. The permittee will maintain the authorized work in good
condition and in conformance with the terms and conditions of this
permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without having it transferred to a
third party.

d. The activity will be conducted in such a manner as to
prevent a significant increase in turbidity outside the area of
construction or construction -related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less are not
considered significant.
