Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) There will be no excavation of wetlands on the west side of the canal. (2) All excavated materials will be confined and retained on high ground landward of the normal water elevation and any wetlands. (3) No excavated material will be placed at any time in any wetlands or waters of the State. (4) Excavation will not exceed 4 feet below the elevation of normal water. (5) No wetlands may be filled on the project site. (6) Spoil piles must not block drainage and cause mosquito breeding sites. (7) The activity must be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction -related discharge. NOTE: An Erosion and Sedimentation control plan will be required for this project. This plan must be filed at least thirty (30) days prior to beginning any land disturbing activity. Submit this plan to the Dept. of Natural This permit action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1987 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. This application is now being circulated to the agencies for conments. Mr. Daniels' original proposal involved the excavation of 1,800 sq.ft. of marsh which is dominated by Juncus roemerianus. In a letter from me to Mr. John Prevette, Mr. Daniels' agent, I discussed the need to minimize the amounts of wetlands to be excavated. As a result of this letter, I have received on 13 July 1984 a request from Mr. Prevette to modify the original proposal to lessen the amounts of wetlands excavated. Attached is a copy of the materials furnished to me. I suggest that you circulate this to the review agencies as an addendum to the original application. Mr. Daniels has concurred with the following modifications: 1. Wetlands extend to west bank of existing canal. No excavation will occur on west bank of canal. Wetland areas will not be bulkheaded. 2. 5' fringe of wetlands on east bank will be excavated (875 sq. ft.) to allow a total width of 20'-25'. 3. The area south of the wetlands will be excavated to a width of 501. A benefit of the proposed project will be to open a new area for small fish and shrimp. Project summary The applicant is proposing to widen an existing ditch into a boating access channel, and terminate it with a boat basin which will contain a boat ramp. Adjacent to the channel will be a camper trailer area. Environmental settin The applicant owns a 6.75 acre tract of land at Pamlico Beach on the Pamlico River in Beaufort County. Located on the property is a single family dwelling and a convenient store, both of which are being served by septic tank sewage disposal systems. Also located on the property is a + 20' wide by + 420' long ditch which has been historically connected to the Pamlico River. At the present time sand has accumulated at the mouth of the ditch restricting drainage. The ditch has an average depth of 3.5' at NWL. Much of the 6.75 acres of property is highground, however, two areas of wetlands occur. One area is east of the existing ditch and east of the proposed road to the campground (see attached plat). This area is vegetated with Tyha fM., Distichlis spicata, Spartina patens and Juncus roemerianus. The second area is on the west side of the existing ditch (see attached plat). This area is vegetated with Juncus roemerianus and Distichlis s icata. Project proposal At the present time the applicant is proposing the following: (1) The conversion of the present drainage ditch into a 330' long by 50' wide by -4' deep NWL boating access channel. This will be accomplished by constructing an earthen plug across the mouth of the ditch, pumping any water into the river, and excavating the canal with a dragline; (2) The excavation of an area 50' wide by 50' long by -4' deep NWL within the Pamlico River at the mouth of the canal; (3) The construction of tcro 100' long wooden groins at the mouth of the canal; (4) The excavation of a 75' by 90' by -4' deep NWL basin at the landward end of the canal; (5) The bulkheading of the entire length of the basin and canal; (6) The construction of a 20' by 20' boat ramp within the basin; (7) The construction of a + 18' wide road from SR 1730 parallel to the access canal to a campground which will be placed on the east side of the proposed canal. Three camp sites will be provided for campers with self-contained toilets. A dump -out station will be provided. Environmental impact The wetland area on the east side of the present ditch will not be disturbed. No excavation will occur within the area and no spoils will be placed within the area. Excavation will occur within the wetland area on the west side of the existing ditch. As proposed, + 1,800 sq.ft. of wetland vegetation dominated by Juncus roemerianus will be excavated. No wetland vegetation will be filled on the west side of the ditch. Some turbidity will occur when the existing ditch is pumped out, and when the excavation within the river occurs. David Gossett - Washington Office - 25 June 1984 Mr. William M. Daniels of Pamlico Beach proposes to excavate an existing canal on his property to allow'the operation of a commercial boat ramp and basin for area boat owners. The proposal includes an area for future development such as a travel trailer park for self-contained units. The park would accomodate a maximum of 4 units and would be designed in accordance with Beaufort County Ordanances. The project site is a,6.75 acre track with a 420' X 20' X 3.5' canal which empties into the Pamlico River. Mr. Daniels proposes to construct an earthen plug at the river end of his canal and pump the water into the river. This would enable the canal and basin to be excavated by dragline. The project will consist of excavating the present canal to a width and depth not to exceed 50' X -4' MWL. A basin will be excavated at the head of the present canal to 75' X 90' X -4' MWL. The entire length of the new canal and basin will be bulkheaded. A 20' X 20' boat ramp will be constructed at the head of the basin. The spoil material will be placed in piles in designated areas. The piles will be about 3.5' high and will not enfringe on wet land areas and run-off will be contained. The piles will be moved off site to an upland area to be sold as fill material. The remaining piles will be spread over upland areas on site and seeded. No erosion is expected to take place during nor after construction. The mouth of the proposed canal w ill be excavated approximately 50' off shore by dragline to a depth of -4" MWL. To ensure the stability of the mouth of the proposed This will be a commercial venture with charges for putting a boat overboard. The Pamlico Beach and Wades Point have no commercial ramps and area residents must drive some distance to have boat access to the Pamlico River. APPLICATION FOR -. Recently, I have been contacted by Mr. J.T. Moss of Nashville, North Carolina who has stated to m that there is some question concerning the property boundary lines between you and Mr. Moss. Because of this, I feel that before I can process your application I must have a letter of agreement between you and Mr. Moss stating that the permit as applied for is agreeable to both of you and that if the permit is issued neither party will dispute the work if it is conducted as described on the application form and accompanying plats. A review of your application received May 23, 1984, for a Department of the Army permit to excavate an access channel/canal and basin and construct jetties, bulkheads and a boat ramp off the Pamlico River at Pamlico Beach in Beaufort County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit.
