This permit must be on the project site and accessible to the permit officer when the project is inspected for
compliance. The applicant certifies by signing this permit that: 1) prior to undertaking any activities authorized by this
permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the
local land use plan and all local ordinances, and 2) a written statement from the adjacent riparian property owner(s)
has been obtained, or proof of delivery of certified mail notification of the adjacent riparian property owner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

This letter is in response to your objection, which was received by the N.C. Division of
Coastal Management on September 12, 2022, indicating your objections about the
proposed development by Mr. David Smith, for the construction of a private docking
facility, located at 126 Genoes Point Road SW in Supply, Brunswick County. Based on
consistency with the Rule requirements outlined in 15A NCAC 07H .1200, GENERAL
PERMIT FOR CONSTRUCTION OF PIERS AND DOCKING FACILITIES, a permit has
been issued to authorize the development. I have enclosed a copy of the permit, as well
as the relevant statutes.
If you wish to contest our decision to issue this permit, you may file a request for a Third
Party Appeal. The Chairman of the Coastal Resources Commission will consider each
case and determine whether to grant your request to file for a Contested Case Hearing.
The hearing request must be filed with the Director, Division of Coastal Management, in
writing and must be received within twenty (20) days of the permit decision. I have
enclosed the applicable forms and instructions that must be filed prior to that deadline.

After speaking with our Attorney, pulling the deeded riparian waiver and corresponding plat, and pulling the previous
permit issued at 126 Genoes Pt, I can confirm that the owner of lot 312 has the right to use "Corridor A", without the
need for a setback waiver from Lot 311, as referenced on the Dale Smith Jr. Survey from 7/26/01 and based on the
language in the deeded riparian waiver. The owners of Lot 311 still need to be notified of the proposed work and are still
able to file a 3`d party appeal if they so choose.

Yes- that's my reading of the waiver document. The prior owner gave the right to waive away to the next door owner,
so the current owner doesn't have that anymore (and was on record notice of the waiver since it was recorded in the
chain of title). The new owner still gets notice as an ARO and certainly they can object and file a 3rd party appeal if they
want. This is only waived for as much as the plans referenced in that document show (ie the new proposed pier can't
get more of a waiver than was given before.).

Sorry for the delay -
Once Smith waived the setback area of 311 for the benefit of the current/future owners of 312, that "stick" goes out of
Smith's/311's "bundle of property rights" and in to the owners of 312 bundle. 312 holds it unless they want to transfer
it. So no need for a new owner of 311 to transfer anything since 311 doesn't have that "stick" anymore.....it's still with
312 (this assumes there is no deed back from 312 to 311- 1 didn't see one).

I do have a question that was brought up by the current owner of Lot 311 (The Aylings). The way the riparian waiver
reads, it says Dale Smith Jr, owner of lot 311 waives the rights to the current/future owners of lot 312... Dale smith has
since sold the property so would the new owners of lot 311 be required to waive it too? The riparian waiver only
mentions current/future owners of lot 312 but fails to mention if the owner of lot 311 sells and now has a new owner.

Hi Brendan -
I think we can skip the meeting next Monday .... I just needed time to look at the purported deeded 15' riparian setback
waiver.
Yes- these are a thing and we accept them in lieu of a 15' riparian setback waiver if they are recorded in the ROD like this
appears to be. What this DOES NOT WAIVE is the notice required from an applicant to an adjacent riparian owner. We
still want the neighbor to have notice of a project and to raise any objections they may have to use before we make a
permit decision, but the neighbor (or usually that neighbor's predecessor in interest) can perpetually waive a riparian
setback and bind future owners. While the neighbor's closing attorney should have noted this in the title opinion done
at closing to make the buyer aware of this, that may not always happen.
The only tricky part comes in when the site conditions may change where the common riparian line is located. If the
point at NHWL at the common property line and the channel (here, specific dredged channel delineation is easy!) are
about the same, the riparian line (and corresponding 15' setback) would be the same and waived. If those features
change a lot and change the "waived area" then we would probably say that the deeded waiver doesn't cover a different
area. That's not likely to regularly come up, but would be something to check and see if its changed since this 2004
waiver was signed.

Good morning Christy,
I have an applicant that has provided me with a deeded riparian waiver from the adjacent lot that states the 15' riparian
waiver will be waived by all current/future owners. The new neighbor must not be aware of this document because he
refused to sign the riparian waiver. What's the process moving forward? Do I need to notify the neighbor that he is
required to waive the setback and have him redo the paperwork for the application? Or do I just include the deeded
waiver in the application and move forward with permitting a docking facility in the setback?

Thanks for getting back to me. Attached is the form given to me by Sea Dog Marine. I had called your main number
910-796-7215 and they transferred me to you. At that point I had no idea where to send it. After not being able to
reach you, I called the 888 number on the form and was told I should return the form to Sea Dog. So last week I emailed
it to them and sent the original copy in the mail. The form says I need to notify DCM if we have objections.
Therefore I am sending you the form with our objection. We do not want them to build the proposed dock. If it is not
you who handles it could you please forward it to the correct person?
Also please note this form was hand delivered to us by Sea Dog on Wednesday 8/31/22 so we are within the 10 day
notification time.
Can you please just confirm that you received this and will handle it.
