This permit, issued on q1 �y , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The bulkhead alignment will approximate the normal water level.
(2) All back fill material will be obtained from a highground source and confined
behind the permitted bulkhead.
(3) All excavated materials will be confined above mean high water and landward of
regularly or irregularly flooded marsh behind adequate dikes or other retaining
structures to prevent spill —over of solids into any marsh or surrounding waters.
(4) An earthen plug will be left between the area to be excavated and the existing
creek and a 24—hour period after completion of the excavation will elapse prior
to removal to prevent unnecessary siltation into the adjacent water body.
(5) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction -related
discharge.
(6) The spoil area must be provided a ground cover sufficient to restrain accelerated
erosion within 30 working days of final placement.

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This penint must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1987
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

as proposed. The objection is based upon findings which
lead to the conclusion that there will be one or more
adverse effects as covered in G. S. 113-229 (e) 1-5.

CONDITIONS
(1) In order to protect juvenile shrimp, no excavation or filling will be
permitted between April 1 and September 30 of any year without the prior
approval of the Office of Coastal Management.
(2) The bulkhead alignment will approximate the normal water level.

8. Project summary The applicant is proposing to excavate a 60' x 60' boat basin with a
15' x 12' access channel off of Hatter Creek. Also proposed is a 30' x 12' boat
ramp and 270' of bulkhead within the basin.
Environmental settin
The applicant owns a 0.85 acre tract of land adjacent to Hatter Creek in Goose
Creek Shores Subdivision in Beaufort County. Hatter Creek is a tributary to
the AIWW. No structures are located on the property. Vegetation on the property
varies from small pines', upland grasses, to a narrow sparse fringe of wetland
vegetation mainly Juncus roemerianus at the edge of Hatter Creek. Historical
excavation appears to have been conducted in the creek which is indicated by
the presence of very old eroded spoil piles.
Project proposal
The applicant is proposing to create a private boating facility. The proposal is
to excavate a 60' by,60' boat basin to a depth of -4' NWL which will be connected
to Hatter Creek by a proposed 15' long by 12' wide access channel. The access
channel will also be excavated to a depth of -4' NWL. When the basin is
completed a 30' long by 12' wide boat ramp will be placed in the basin. Also
the basin and access channel will be bulkheaded to prevent erosion.
During excavation of the basin a dirt berm is to be placed around its perimeter
to prevent excavated materials from returning to the basin. All excavated
materials are to be placed on highground landward of the berm. When the materials
are dried they will be spread and seeded.
Environmental impact
The project as proposed should have a minimal environmental impact. + 30 sq.ft.
of wetland vegetation will be excavated•" none will be filled. Some turbidity will
exist during project activity.
