See attached sheet for conditions. THIS PERMIT IS VOID IF THE ABOVE CONDITIONS ARE NOT PRECISELY FOLLOWED Notification of project completion must be given this office. This permit must be displayed with a copy of the application and the,project map in the cab or pilot -house of the vehicle working on the project, whichever is applicable, or be easily accessible on site to Department of Conservation and Development personnel. This permit is terminated on December 31, 1974 Any additional work or maintenance work on' the project subsequent to the termination of this permit requires a new permit. The permit, (as approved with conditions), may be objected to by the applicant or by interested State agencies within twenty days of the date of issuance by giving written notice to the Depariment of Conservation and Development. The applicant is advised of the requirement under G. S. 146-6.1 that power -operated earth - moving equipment operating or to be operated in or on publicly owned tidelands, publicly owned beaches, publicly owned marshlands, or navigable waters within the State must be registered by the owner of the equipment with the Department of Water and Air Resources. i-X c ,. That deeping (other than the channel) be accomplished only in the immediate area adjacent to the docks and adequate to facilitate boat maneuvering. That run-off waters from the diked spillway be contained within a pipeline trough or similar device to the MLW line in order that gully erosion between the disposal area and adjacent estuarine waters be prevented. That all dredge spoil be placed upon highgound and that there be no further destruction of the remaining hardwood bottom land by spoil deposition. That no septic tanks be placed in filled areas. That all spoil be adequately contianed to prevent its entry to adjacent waters. That either a "Locked Head Policy be enforced at the dock or that a waste collection system be incorporated to serve the dock area. Processing is now complete and we find that the coordinated state view- point does include and objection. It is my form you that receipt of this objection necessitates pe t denial this time. The objection to your project and the agency submitting same follows: State Board of Health - objected to permit issuance due to the possibility of increased water pollution in the area. The Board also recommended (for future plans) that the marina provide adequate facilities for sanitary collection and disposal of sewage from water craft having retention tanks. The above comments are in accordance with G.S. 113-229(e)(3), that there will be significant adverse effect on public health safety and welfare". When an application for a permit is denied, the applicant is entitled to a hearing as provided for in G.S. 113-229. He is also entitled to representation by counsel. As I told you on the phone, we king with us in supplying the necessary revisions in You state that there has been no reference to Project No. 1 - the project in Rod- man's Creek. The reason there has been no reference to this project in our corres- pondence is that this project does require a State and Federal permit. It is now in the process of being circulated to State agencies for comment. I called our Raleigh office just a short time ago, and they tell me that one more state agency has to comment before a final decision can be made. This comment should be in the Raleigh office very shortly. I appreciate your concern that Mr. Crisp is prepared to work on the Rodman's Creek Marina - Application No. 1 - but he must wait until he obtains the necessary State and Federal permits before he commences. As concerns Application No. 2 - work in Chocowinity Bay - as I have previously stated, no State permit is required. However, a Corps of Engineers permit is re- quired and any work prior to your obtaining this permit would be in violation of the Federal law. T&2 for permission to dredge and fill on Rodmans Creek (T) & (2) on Chocowinity Bay. On April, 4 I recieved a letter from you asking for addittional information on both projects. This was complied with and mailed to you on April IT, with more information on what Mr. Crisp was planning to do with the sandpits that were mined with and under permits issued by the State. In each of the above letters to you I stated that Mr. Crisp was anxious to get started on the projects especially the Rodmans creek Marina as the Sailboat Slips ware much in demand and that he wanted to get started on this project first. On May 3 1973-I recieved a letter from Mr. C. Douglas RingEr Biologist Estuarine Studies Section, stating that Mr. Crisp did not need a permit to dredge in Chocowinity Bay as it had been declaired 11 Inland Waters n and if Mr. Crisp would declair that no marsh would be destroyed he could begin his work, and that the application would be declared null and void. this was complied with on May 6. There has been no reference to project No. T nor no reply as to any needed information on this project. from you or Mr. Ringler. ' Investigative process - 3-23-73 application received in Morehead; 4-4-73 new plats requested; 4-9-73 plats received; 4-10-73 revised plats requested again; 4-12-73 revised plats received; 4-18 on -site investigation with applicant; 4-19 telephone conversation with applicant's surveyor re need for plat revisions reflecting on -site discussions; 4-24 complete plats received. Environmental setting - The Pamlico River at the project site provides habitat for freshwater fish species including largemouth bass, yellow perch, pckerel and pump- kinseed. The river edges and its tributaries are utilized as spawning habitat by anadromous herring species during the spring of the year. Depths in the river average 5-9' with an average of some 3-4' in Rodmans Creek. The creek bottom is loose mud with a lower layer of sandy mud. No marsh vegetation exists along the shoreline of the im- mediate project area; however, directly across the creek is a large homogenous stand of giant cordgrass (Spartina cynosuroides). 350' inland of the creek exists a trian- gular shaped boat basin 500' long and 150' wide at its base. A 40' wide channel con- nects the basin with Rodmans Creek on the basin's east end while a 50' wide channel extends 220' from its western end toward the creek. The eastern channel stops 60' from the creek boundary. Further east of the project site is a 600' x 300' wooded swamp that narrows and extends up Rodmans Creek. The existing basin is tied into an extensive drainage canal system in the many acres of adjoining farm land. This site is located near Whichards Beach, a highly developed recreation -resort area bordering Pamlico River and Chocowinity Bay. Project description - Mr. Crisp proposes to dredge the mouth of Rodmans Creek to pro- vide navigable access, construct docks and finger piers from the highland into the creek, erect a 350' long bulkhead along Rodmans Creek and enlarge two existing canals from an existing basin to the creek. A 600' x 500' area of Rodmans Creek is to be deepened from 3-4' to 6' below MLW. Spoil material from this dredge operation is to be pumped behind earth dikes constructed in the wooded swamp area west of the exist- ing basin. The existing 40' wide easterrr-channel is to be widened to 80' and the western channel is to be widened also to 80' and extended 50' to the creek. Spoil ma- terial from these dragline operations will be placed between the canals on existing highland. The applicant's Rodmans Creek shoreline has experienced some erosion and a bulkhead is proposed to regain some of this land and to prevent future loss. The -2- 350' shoreline is now shaped like a broad "W". Bulkhead construction is to be ap- proximately "point to point" with the structure extending no more than 10' from the shoreline anywhere along the shore. Environmental impact - If completed as presented, the project would alter some 6.5 acres of Rodmans Creek by deepening it from 3-4' to 6' below MLW. The acres of wooded swamp would be altered by receiving spoil from the dredge operation, The amount of dredging seems to be excessive to provide navigable access to the project area. I have no objection to the issuance of a permit for this work if the permit contains the following conditions: That dredging in Rodmans Creek be limited to: 1. a single access channel to Pamlico River; 2. deepening only the immediate docking area adjacent to the highland; 3. that runoff.waters from the dike spillway be contained within a pipeline trough or similar device to the MLW line in order that golly erosion between the disposal area and adjacent estuarine waters be prevented. Earthern dikes with pipes for spillways will be used on the Rodman Creek and Chocowinity Bay projects to prevent washback instead of log dikes as first proposed. It was my understanding with Mr. Crisp in our first plan that he would dredge an 80 ft. channel in Rodmans Creek and mark it with bouys. this would be less expensive, however it will be much safer to both small and larger boats to dredge the creek. I made the corrections on the returned plats and added another sheet, see "Sheet 5 0£ 5 V The Corps of Engineers have the original tracings and have not yet returned them. You will note that on the areas marked spoil they are double cross hatched, but I am sure you will understand what is meant to be shown as spoil and what is to be excavated, and the MHW. and MLW. lines have been added. The sandpits have already been mined and there will be no excavating on or rather in them. The pit on the south side of the Whichards Beach road will be, and is in the process of being squared off with the wide end of the pit. This sand is being sold for fill or masonry sand and will be bulkheaded after he is through. As I have stated before in my first letter with the applications, these pits were dug by permit from the State in the most non productive part of his field. The soil is a very light sandy type, the type that blows away in light winds. It also requires a great amount of irrigation to sustain any kind of crop. what he is planning to do,with your Departments help will be the best way to utilize the property. Crisp to do some dredging at the mouth of Rodman Creek, Pamlico River. It is my understanding that you are acting as agent for Mr. Crisp in seeking renewal of this same permit. The procedure should be to submit the request in writing to our Raleigh office. You should include a copy of the approved work plat and note any changes which may be proposed. I would suggest that a new plat be drawn showing in more de- tail exactly what is proposed for that area. The only changes I might suggest are that the proposed bulkhead should not exceed 5' from the mean high water mark, and that the proposed channel width be reduced from 80' to 60'. Your request for renewal should be addressed to Mr. John Parker, Division of Marine Fisheries, PO Box 27687, Raleigh, N. C. 27611. Your request will be cir- culated for review among the various state agencies involved with our program. However, the process does not require as much time as a new application. The swamp area in question is only about one half acre in size and there is ample room south of the swamp area and the cult ivated field to hold the spoil. Some spoil will be placed on the existing spoil between the two canals. As stated in the letter to the Corps the septic tanks will be moved across the basin to the edge of the cultivated field. On these maps I have indicated those areas which you may get your surveyor to draw onto the project maps to be sup- plied to the Corps of Engineers. The addition of these revisions will, I feel, result in a clearer understanding by the Corps. As concerns the proposed spoil area in the wooded area northwest of the small boat har- bor, I find that the permit contains a condition suggested by the Wildlife Resources Commission that no spoil be placed in the subject wooded area. Therefore, I have in -- di cated on the map a high land area to be used for spoil disposal, When I spdce to you on the site I did not remember that this condition was an integral part of the permit to dredge and fill. In order to comply with the conditions of Permit No. 135-73, your spoil disposal site will have to be on high land and out of the wooded area.
