This permit, issued on JUNE 12, 1995 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Excavation
1) In order to protect juvenile fmfish and shellfish resources, no excavation may take place between
April 1 and September 30 of any year without the prior approval of the Division of Coastal
Management and the Division of Marine Fisheries.
2) Prior to any excavation, a pre -construction meeting will be held at the site between the applicant,
contractor, and a representative of the Division of Coastal Management.
3) Excavation will not exceed 8 feet below the normal water level.
4) The temporary placement or double -handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1998
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

5) Prior to any excavated material being trucked from the site, the disposal area must be approved
by a representative of the Division of Coastal Management.
6) All excavated materials will be confined above mean high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover
of solids into any marsh or surrounding waters.
7) No excavated or fill material will be placed at any time in any marsh or surrounding waters
outside of the alignment of the fill area indicated on the workplans.
8) A permanent ground cover sufficient to restrain erosion shall be provided on all exposed areas
of the spoil disposal site within the shorter of 30 working days or 120 calendar days after project
completion.
9) Appropriate erosion and sedimentation control devices, measures or structures shall be used at
the spoil disposal site to prevent sediment from entering adjacent wetlands, waters or properties.
10) After dewatering, the spoil disposal site shall be graded smooth.
Sewage Waste Disposal
11) Prior to the occupancy of any vessels within the area to be excavated which is authorized under
this permit, a marine pumpout sewage disposal facility will be installed and operable (and
maintained for the life of the marina).
12) No sewage, whether treated or untreated, shall be discharged at any time from boats using the
marina. Any sewage discharge at the marina shall be considered a violation of this permit for
which the permittee is responsible.
General
13) No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
NOTE: It is strongly recommended that the permittee exercise all available precautions in the
day-to-day operation of the facility to prevent sand blasting residue and/or other facility
waste from entering the adjacent waters. Such discharge, either directly or indirectly,
to adjacent waters could contravene state water quality standards, thereby violating state
law.

SUBJECT: Cox Railways, Inc., Town of Belhaven, Beaufort County
This proposal, for excavation of an area 108' by 48' by -8' in Pantego Creek to facilitate
additional moorings at the existing Cox Railways, comes under the auspices of the March 1993
CRC certified Belhaven Land Use Plan update. Public Trust Areas of Environmental Concern
are involved.
The March 1993 certified land use plan offers the following limited guidance on proposals of
this type:
Page 26-27 Town policy on AEC's is to recognize the important natural role they
play and to support federal, state and local restrictions with regard to
development in AECs.
Page 30-31 Town policy on upland excavation for marina development notes the
town supports CAMA actions taken in regards to this issue.
The area for this proposal is shown in the Conservation land classification by definition (page
55-56). This class calls for water oriented uses to be permitted if they are in accordance with
applicable use standards.
In November 1994 the CRC certified an amendment to the town's LUP update that prohibits
permanent moorings within the town planning jurisdiction. The town narrowly defines moorings
as a structure, float or devise left permanently in the water to which a vessel is attached. The
definition does not include any pier, dock or other structure which is permitted under the towns
zoning ordinance.
My opinion is if this activity can be accomplished in accordance with applicable AEC use and
performance standards, it is not inconsistent with town policy for AECs nor the Conservation
land classification. Permanent moorings as described in the town plan and its zoning ordinance
are prohibited.

Environmental setting
The applicant is the manager of Cox Railways, Inc. which is located on East Front
Street, adjacent to Pantego Creek in the Town of Belhaven, Beaufort County. On 29 October
1993 the Division of Coastal Management issued Major Development Permit No. 112-93 to Mr.
Jimmy Cox, the applicant's father and property owner, for the upgrading of the existing marine
railway facility. The permit allowed for the construction of new docks, piers, bulkheads, and
for the maintenance excavation of an existing access channel to the two existing railways. The
±1 acre site is located on the north side of Pantego Creek on a peninsula between two access
channels, both of which have a depth of 6 to 8 feet at NWL. The eastern access channel enters
the applicants property an provides access to existing railways. The western access channel
enters adjacent property an also provides access to railways. The site is developed with
buildings and a gravel driveway with parking facilities. Much of the southern portion of the
peninsula is grassed with upland vegetation. No wetland vegetation is present at the site. The
area just south of the bulkhead, beyond the NWL of Pantego Creek, has a hard sandy bottom
with no submerged aquatic vegetation.
Project proposal
The applicant is proposing to excavate an area 108' long by 48' wide to a depth of -8'
at NWL. The area which is located within Pantego Creek between the two access channels is
adjacent to and south of the previously permitted bulkhead an has an average depth of -5' at
NWL at this time. All excavated materials will be trucked from the site to a highground lot on
East Street within the Town of Belhaven. When completed, the area will have approximately
the same depth as the adjacent channels.and Pantego Creek, immediately beyond the excavated
area. The area will be utilized for additional mooring for the existing railway facility.
Environmental impact
If the project is conducted as proposed, the following environmental impacts will occur:
(1) ±5,184 sq. ft. of sandy bottom area will be excavated to a depth of -8' at NWL.
(2) Some short term turbidity will exist during project excavation.
(3) No submerged aquatic vegetation will be excavated and/or filled.
(4) No coastal wetlands (marsh) will be excavated and/or filled.

Attached is a copy of the subject application for a state permit. I have reviewed Mr.
Cox's proposal in regards to NCAC 7H, specifically .0208 - the use standards that apply to
excavation, and feel that Mr. Cox's proposal is consistent with these standards. Therefore, I

Dear Mr. Gossett,
Enclosed please find an application requesting a permit to dredge the shoaling
mouth of our boat basin and in front of my property. This project site is
located at 308 East Front Street, Belhaven, North Carolina; along the shore of
Pantego Creek. This property has already been permitted for a dock.
This project is needed in order to continue servicing our clientel. At present,
the entrance to basin and a portion in front of the property, does not provide
sufficient depth to accommodate the vessels that would patronize my business.
We need to dredge a depth of eight feet, with a distance of 42' feet outward
into the Pantego Creek from the permitted dock. Most of this bottom is sand,
and will be hauled to an upland site.
It is important to the future progress of my business to have this area dredged.

8 ADDITIONAL INFORMATION
In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8 '
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management and should be advised by the applicant of
that opportunity.

9 CERTIFICATION AND PERMISSION
