This permit, issued on May 12, 1983 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
No special conditions.
NOTE: This permit modification authorizes the following only: 1) finger piers,
as described, attached to existing piers, 2) dock parallel to existing
bulkhead, 3) 12'X30' service pier and, 4) attendant building as described.
NOTE: The permittee is reminded that this permit authorizes work on properties
(Re. high ground) owned by him or properties under lease or other agree—
ment.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on

agrees that your project is consistent with the North
Carolina Coastal Management Program.

As you are aware I have been notified by Mr. Hugh Heine, Corps of Engineers, that
Mr. J. Cliff Vaughan has con e e rps and has stated that he owns a 9 1/2 foot
wide strip of land on whit Mr. Cottrell 's proposing a portion of his project.
As a result of this information I suggest that you contact Mr. Cottrell and place
the proposed modification on hold until such time Mr. Cottrell and Mr. Vaughan can
resolve this problem.
When this problem is resolved I will submit to you conditions that I would like
placed on the permit.

This office has received a request to consider a modification to Permit No.
52-80 for Mr. Scott Cottrell of Ocracoke. The newest request from Mr. Cottrell
involves the addition of finger piers, a service pier, board walk and an
attendant house. The attendant house will not be served by restroom facilities.
Other facilities shown on the attached plats, with the exception of the piers,
bulkhead and ramp, have been put in place without benefit of a permit. Copy
of the existing permit attached.
Any comment you wish to submit on this request should be forwarded by December
8, in order that action can be taken.

�7 Enclosed is an application package consisting of application form, plats, certified
mail receipts, and a $25.00 check which I received from Scott Cottrell on 9 November
rat "' 1982.
As you are aware Mr. Cottrell's property is located on Silver Lake on Ocracoke and
is divided by NC 12. Located on the property at this time is (1) a concrete bulkhead,
(2) boat ramp, (3) two 180' long piers, (4) four gas pumps, two on highground, two
on piers; the lines to the tanks on the pier are 1 1/2" galvanized pipes with auto-
matic cutoffs on handles, (5) three 3000 gallon buried asphalt coated gas tanks,
(6) and a motel in operation with sewage system.
Mr. Cottrell's current proposal includes the following: (1) a 12' x 30' barge pier
which will be attached to the existing bulkhead, (2) an 8' wide board walk adjacent to
the existing bulkhead, (3) eight 2' x 6' finger piers on each of the 180' long piers;
the finger piers will be 20' apart, (4) an octagonal shaped attendant house. The build-
ing will be 400 sq.ft. with each side being 20'. No restrooms will be located in this
bu ild ing .
I have not yet notified Mr. Cottrell by mail that I am accepting this application for
modification. (I have verbally indicated to Mr. Cottrell that the package is satisfac-
tory.) I would appreciate you reviewing the submitted materials and if you need addi-
tional information contacting Mr. Cottrell. As you can see the plats which have been
submitted are much better than we have received from him in the past. I will wait to
advertise the project until I hear from you.

After extensive coordination between North Carolina and Federal agencies, a
general permit No. SAWCO80-N-000-000291 (inclosure 1) was issued on
27 January 1981, by Colonel Robert K. Hughes, District Engineer, Wilmington
District, U.S. Army Corps of Engineers, which provides Federal authorization
for "...those construction activities that require and receive authorization
from the State of North Carolina in the form of a Coastal Area Management Act
(CAMA) permit for major development and/or a permit to excavate and/or fill
and/or a Water Quality Certification."
A review of your application received 16 July 1982 for a Department of the
Army permit to construct piers, install pilings, and deepen a basin area on
Silver Lake off Pamlico Sound at Ocracoke in Hyde County, North Carolina,
indicates that your proposal is a candidate for Federal authorization under
this general permit. Accordingly, the processing of your application will be
accomplished by the N.C. Office of Coastal Management. In this process, the
N.C. Division of Environmental Management will review your proposal and a
determination will be made as to the need for a State Water Quality
Certification. Comments from Federal review agencies will be furnished to
the State. If there are no unresolved differences of State -Federal positions
or policy, the final action taken on your application by the State will
satisfy the terms of our general permit. The terms of the general permit
will not be satisfied if any of the following situations exist:
1. There is an unresolved objection from any Federal agency.
2. A State Water Quality Certification has not been issued (if
required). Section 401 of the Clean Water Act requires that prior to the
issuance of any Federal permit that may result in a discharge into waters or
wetlands, the State agency responsible for water pollution control (N.C.
Division of Environmental Management) must certify that the discharge will
not violate applicable Water Quality Standards.

3. The proposed work would have a significant effect on the quality of
the human environment. The District Engineer will make this determination
prior to the conclusion of the State process.
4. There is a significant and substantive unresolved objection from
any individual, group, or agency.
If your application is withdrawn from this general permit process, you will
-be so notified and informed of its further management in writing. When your
application is successfully processed to conclusion under this general
permit, you will receive written notice from the District Engineer. Only
after receiving such confirmation should you begin work.

Dear Mr. Cottrell:
Recently this office received a request by you to modify permit numberQ2-80� to
allow the construction of a 12' x 30' pier, tie off pilings, a 275 sq.ft. attendant
building, and to excavate a 160' long by 115' wide by -6' deep NWL area in Silver
Lake which will serve as a boat basin.
A review of the submitted package indicated several deficiencies which must be
corrected before the request for modification can be accepted. These deficiencies are
as follows:
(1) It is the policy of the Office of Coastal Management to review the total develop-
ment of a project not just a portion as you have shown on the submitted plat. The
development which is being undertaken on the west side of Highway 12 has not been in-
dicated on the plat. This office will need a thorough discussion with plat depicting
that development. A discussion with Mr. Willie Shooter, Hyde County Sanitarian, indi-
cated a special sewage system is being designed for this development. This office will
need plans of this system and the plat should indicate exactly where the system will be
placed. The plat for the west side of Highway 12 must be drat.n according to the attached
regulations. (2) The plat which was submitted for the east s:de of Highway 12 is not
drawn in enough detail. Again this plat should be redrawn to meet the criteria within
the attached regulations. This plat must indicate where exis-ing structures are located
and proposed structures are to be located. Distances from property lines and bulkhead
must be shown. (3) The area to be excavated must be cross -hatched and the plat must
show where the spoil is to be placed. The application indica_es the work is to be con-
ducted with a dragline and dredge. More detail must be given as to which method will
be used. (4) Detail design information must be given on the attendant building along
with a discussion of sewage disposal methods. If a septic tank is to be used the loca-
tion of the tank must be shown on the plat. If alternative methods are to be used a
discussion must be presented to'describe these. (5) Information must be submitted de-
scribing fuel handling facilities, which must indicate how spillage will be controlled.
Your plat shows gas pumps at the waterward end of a pier. Alternative locations must
be discussed. Also a discussion must be submitted giving information on the recently

installed fuel tanks. This information must consist of (a) total capacity of tanks,
(b) number of tanks, (c) exact location of tanks, e.g. distance from bulkhead, (d) type
of material of which the tanks are constructed, (e) life expectancy of tanks in a saline
environment, (f) emergency spill procedures. (6) The cross-section drawings which were
submitted are not shown in enough detail. These must be redrawn. (7) Upon completion of
the application and plats, they must be forwarded to the adjacent property owners by
certified mail, and I must be given the certified mail receipts when the package is sub-
mitted to this office.
In summary it appears to satisfy this office's requirements, several plats will have to
be resubmitted, all in much greater detail than originally submitted. Enclosed is the
entire package of information that you submitted. When a new package is submitted as
stated above, processing will begin immediately. In the mean time you should not con-
duct any development activities within 75' of the NWL of Silver Lake (Estuarine Shore-
line Area of Environmental Concern) nor within Silver Lake (Estuarine Waters Area of
Environmental Concern), and cease and desist from any development activities ongoing
within these same areas.
