THIS PERMIT WILL BE VOIDED AND WORK STOPPED IF THE ABOVE CONDITIONS AND THE PLANS AND SPECIFICATIONS SUBMITTED AS PART OF THE APPLICATION (WHERE NOT IN CONFLICT WITH THE CONDITIONS) ARE NOT FOLLOWED PRECISELY. PERSONS FOUND GUILTY OF A VIOLATION UNDER G. S. 113-229 ARE SUBJECT TO A FINE OR IMPRISONMENT, OR BOTH. Notify: Permit Section, Division of Commercial and Sports Fisheries, Box 27687, Raleigh, North Carolina, 27611 when the project is completed. This permit must be displayed along with a copy of the application and the project map in the cab (or pilot -house) of the vehicle working on the project, or be easily accessible on site to Department personnel when the project is inspected. This permit shall terminate on December 31, 1975 Any maintenance work or additional work on the project subsequent to the termination of this permit requires permit renewal and/or a new permit. This permit, (as approved with conditions), may be objected to by the applicant or by interested State agencies within twenty days of the date of issuance by giving written notice to the issuing office. If the applicant does not submit an objection, this will be interpreted as an agreement of compliance with all permit conditions. Potter (reed 7-17-74) Location - Beaufort County - Satterwait Creek near Pamlico Beach Investigative process - App. rec. Raleigh, 7-16-74; Morehead 7-17. Site investigated with Mr. Potter 7-25-74 Environmental setting - The project is located on the south side of Satterwait Creek off SR 1726 approximately .50 mile upstream from its junction with the Pungo River. The site is a 100' wide,..220' long mixed marsh area encompassed by wooded highlands dominated by pine on three sides. The remanents of a drainage ditch can be seen run- ning from the creek approximately 25' inland. A 25 sq. ft. area of black needlerush (Juncus roemerianus) is located near the middle of the site. The remaining vegeta- tion consists of a mixture of switch grass (Panicum virgatum), black grass (Juncus erardi), spike grass (Distichilis sp), common three -square (Scirpus americans) and highland shrub species. A 3' square patch of salt marsh and grass (Spartina alterni- flora) is present at the water's edge. Project description - The applicants propose to excavate by dragline a 100' x 40'.x 6' boat basin and deposit the spoil over the low area around the basin. Approximately 25 sq. ft. of black needlerush will be excavated and the remaining mixed marsh and shrub species will be covered with spoil from the excavation. Approximately 890 cu. yds. of spoil will be deposited over the area adjacent to the proposed basin in order to raise the surrounding ground elevation. Environmental impact - If the project is completed as proposed, there should be little impact on marine fisheries. The excavation and filling of an isolated area of mixed marsh and shrub species totaling about 1/2 acre does not seem excessive. This is particularly true since it is obvious that the area in question is seldom flooded and supplies little or no nutrients to the surrounding water. For this reason, I have no objection to the issuance of a permit for the proposed work with the following condi- tions: 1. That all excavated materials be confined on high ground behind adequate dikes or other retaining structures to prevent spill -over of solids into any marsh or surrounding waters. 2. That the dike be seeded, grassed or otherwise stabilized within four weeks of construction to prevent undue erosion of the dike with resultant solid materials entering adjacent marsh or water.
