This permit, issued on / is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terns may subject
pemtittee to a fine, imprisonment or civil action; or may cause the Permit to be null and void
(1) The bulkhead will be constructed on an alignment in strict accordance with
the permit plans. To prevent an unintentional violation of the permit
authority, representatives of the N. C. Office of Coastal Management and
the Corps of Engineers are available to stake the bulkhead alignment prior
to construction.
(2) All backfill material will be obtained from a highground source and confined
behind the permitted bulkhead.
(3) No excavated or fill material will be placed at any time in any marsh or
surrounding waters outside of the alignment of the fill area indicated
on the plat.
NOTE: Further development on the permittee's property may require a modification.
to this permit.
NOTE: In keeping with the provisions of GS 146-6(c) the State Property Office
of the Department of Administration has granted authorization to fill
State-owned submerged lands as described in this permit.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
AN work must cease when the permit expires on
December 31, 1987
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.
Signed by the authority of the Secretary of DNRCD and
the Chairman of the Coastal Resources Commission.

Dear Mr. Parker:
Reference the application of Mr, orge D. Cord n for a
Department of the Army permit to constru ackfill a bulkhead
on the Pamlico River new Burbage Crossroads in Beaufort County,
North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The bulkhead will be constructed on an alignment in
strict accordance with the permit plans. To prevent an
unintentional violation of the permit authority, representatives
of the North Carolina Office of Coastal Management and the Corps
of Engineers are available to stake the bulkhead alignment prior
to construction.
b. All fill material will be obtained from a highground

As you are aware the Office of coastal Management is presently processing permits
for Mr. Cordon to construct a 245' long bulkhead, a portion of which will average
+ 14' beyond the normal water level. This section of bulkhead is within a man-
made canal. Although Mr. cordon has not lost this amount of land to erosion
within the last twelve months, I feel that this proposal is permittable since the
activity will occur within the canal. There have been other instances where
this has occurred, and there have been instances where entire canals have been
filled.

X (A) This agency interposes no objection to the proposed work.
(B) Dredge and/or Fill. This agency objects to the project
as proposed. The objection is based upon findings which
lead to the conclusion that there will be one or more
adverse effects as covered in G. S. 113-229 (e) 1-5.

S. Project summary The applicant is proposinct to construct 245' of bulkhead and backfill
as i-ha mnfinacl araa_
Environmental settin
The applicant owns a parcel of land which is + 24' in width, + 250' in length,
which borders the Pamlico River on the southern end. On the east side of the land
is a + 38' wide manmade canal which extends the length of the property. The canal
is shown on the applicant's deed as being under his ownership.
No wetland vegetation is present at the project site. The property is vegetated
with upland shrubs and pines.
Project proposal
The applicant is proposing to construct a bulkhead along the southern side of his
property to retard ongoing erosion and to construct a bulkhead within the manmade
canal so that his property will.have a more uniform shape. That portion of the
bulkhead which borders the Pamlico River will be 40' in length, will connect to an
existing bulkhead and will average + 3' beyond the NWL. That portion of the
bulkhead which will be placed within the canal will be 205' in length and will
average + 14' beyond the NWL. Once the bulkhead is completed, the confined area
will be backfilled and seeded.
Environmental impact
If the project is conducted as proposed + 2,990 sq.ft. of open water area will be
filled; of this amount + 2,870 sq.ft. will be within the manmade canal. No wetland
vegetation will be excavated or filled.

On January 27, 1981, we issued general permit No. SAWC080-N-
000-0291 (enclosed) which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received September 5, 1984, for
a Department of the Army permit to construct and backfill a
bulkhead on the Pamlico River near Burbage Crossroads in Beaufort
County, North Carolina, indicates it to be a candidate for
Federal authorization under this general permit. Accordingly,
the administrative processing oaf your application will be
accomplished by the North Caro inice of Coastal Management.
Comments from Federal review agencies will be furnished to the
State.
If your application must be withdrawn from this general
permit process for any reason, you will be written and informed
of its further management. If there are no unresolved
differences of State -Federal positions or policy, the final
action taken on your application by the State will result in your
receiving written notice from us that your application has been
successfully processed under our general permit. Only after
receiving such confirmation should you begin work.
. Your application, pursuant to Section 10 of the River and
Harbor Act and Section 404 of the Clean Water Act, has been
assigned No. SAWCO84-N-007-0368 and will be coordinated by
Mr. Steve Brown, telephone (919) 343-4632. He is available to
