Any violation of these terns may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) In order to protect juvenile fish resources, no excavation may take place under this renewal from February 1 to June 30 of any year without prior approval of the Division of Coastal Management in consultation with the Division of Marine Fisheries. 2) This renewal must be attached to the original of permit No. 132-87 and be readily available on site when Division personnel inspect the project for compliance. All conditions and stipulations of the original permit apply to the project under this renewal. MAINTENANCE CLAUSE The Division of Coastal Management will be notified in writing at least two (2) weeks in advance of any maintenance work (after Dec. 31, 1992) authorzed by this permit and that notification include: (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. D. the date of plan revision and the permittee's signature shown anew on the original plan. r A DEC 0 8 1992 M E M O R A N D U M TO: John Parker FROM: Terry Moore DATE: 4 December 1992 SUBJECT: Renewal of Major CARA Permit No. 132-87 for Project Maintenance Since answering regulatory responsibilities on Ocracoke Island in the Spring of 1992, I have reviewed this project area from onsite inspection and aerial overflight. Although this office was not involved with processing the application nor onsite for the original excavation and monitoring we have noted, primarily from overflight, that the permitted channel has already filled in at the waterward end thus severely restricting the use of the permitted project. Therefore, I recommend the permit be renewed for project maintenance with the standard modification requirements, etc. cc: Ted Tyndall AWve+Q.nviete William W. Box 2188 Washington, NC 27889-2188 Re: Request for Maintenance Under CAMA Major Permit No. 132-87 Dear Mr. Moore: I am requesting a maintenance excavation clause in my permit to allow excavation of sand to keep the channel open. The project has been completed and there has been some closure of the channel near the opening. Hence, I request that maintenance be allowed to keep this channel open in accordance with the originally permitted excavation. I will not be making any dimensional changes to the original excavation.
