Dear Mayor Williamson:
This letter of refinement is in reference to Major CAMA Development Permit
No. 229-89 issued to the Tow- of Chocowinity on 11 December 1989. Permit no.
229-89 was issued for installation of a force sewer main under the Pamlico River
near the U.S. Highway 17 bridge crossing the Tar Pamlico.
The first condition on the aforementioned permit states "In order to protect
juvenile fin fish, placement of the force main within the Pamlico River will
not occur between the dates of 1 April and 30 September of any year without
prior approval of the Division of Coastal Management, through the Division of
Marine Fisheries." The effective date of this moratorium is hereby changed
to be between 1 March and 31 May. This not only allows more available time
to complete construction but more accurately protects the peak period of
biotic activity originally requested by the N.C. Division of Marine Fisheries.
You should note this change on your permit to help insure accurate contractual
agreements and retain this correspondence for documentation. All other permit
conditions including the 31 December 1992 expiration date still apply and
remain unchanged.
