Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) This permit modification authorizes excavation of the sewer line main trench by clam shell bucket as described in the application letter and revised drawing. 2) Spoil from the clami shell operation must be placed on a barge and moved to the high ground disposal site identified as the Moss Planing Mill property. The excavated material must be managed at the site so as not to return to the River during or after project activity. 3) No excavation by any method may take place between March 1 and May 1 of any year without the prior approval of the DCM in consultation with the Division of Marine Fisheries. 4) Spoil material taken from the River may not be used as backfill for the pipe. (See attached sheet for Additional Conditions) This permit action may be appealed by the pemtittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee MEMORANDUM TO: John Parker FROM: David Gossett THROUGH: Terry Moore DATE: 30 April 1992 SUBJECT: Request for Minor Modification of Permit Town of Chocowinity Permit No. 229-89 Beaufort County MAY 0 5 IM I On 11 December 1989 the NCDCM issued to the Town of Chocowinity the subject permit for the subaqueous placement of a sanitary sewer force main across the Pamlico River just downstream from the US 17 bridge. On 24 May 1990 a Minor Modification was issued to the Town which involved the type of pipe which was allowed to be used. During a pre -construction meeting concerning the permit on 24 January 1992 it was brought to the Division's attention that from station 7+25 to station 8+20 on the project plats that the contractor my need to excavate the pipe trench with a clam shell bucket instead of by hydraulic jetting as was authorized by the subject permit. The Town was told at that time that such a change in excavation method would require a modification of the permit. Enclosed are the materials that I have now received from the Town and Rivers and Associates requesting a minor modification of the permit. As you can see from the attachments, that if a clam shell is used between stations 7+25 and 8+20 that a trench 15.5' deep will be excavated on a 2:1 slope which means the trench will have a 66' top width. It should be noted that if the project is done by hydraulic jet the same top width, depth, side slopes etc. should be expected. Also, as can be seen from the attachments, the spoils will be placed at property owned by Moss Planning Mill Company on the north side of the Pamlico River, just downstream from the project site. Terry and I have discussed the project an agree that the proposal should be handled as a minor modification of the permit. We do however feel that the DEM, DMF, DLR, and NCDOT should have the opportunity to comment on the proposal. Through a copy of this memorandum I have forwarded a copy of the proposal to these agencies and have asked that they comment back to your office no later than two weeks or by 17 May 1992. This will hopefully allow the Town enough time to continue on their present time schedule to begin the project on or shortly after 1 June 1992. Box 1507 Washington NC 27889 Subject: Chocowinity, North Carolina Proposed Sewer Crossing the Pamlico River CAMA Permit No. 229-89 Rivers No. 90378 Dear David: Per our telephone conversation of last week, please find enclosed a typical cross section of the pipeline trench from Station 7+25 to Station 8+20 as might be necessary if clam shell excavation is required. As stated in Mayor Williamson's letter of April 16, 1992, a minor modification is requested to the CAMA Permit to allow clam shell excavation. This request is made due to the depth of cut required between the two channels passing under the Highway 17 bridge. The river bottom between these two channels is somewhat higher in elevation than other areas of the river outside of the channels. It is not known whether this higher elevation is caused from channel excavation spoil material or from sediment due to a quiescent zone formed behind the bridge fender cluster piles. It is proposed to attempt installation of the pipeline by hydraulic jetting as originally permitted. However, should that prove unsuccessful within this particular area due to the depth of cut required, it is desired to have a permit modification in hand to allow excavation through this area so that the installation can be completed without project delay. ALBRrrrON In accordance with the outcome of discussions held during our January 24, 1992 meeting at the Tbwn Hall, The Town of Chocowinity requests a minor modification to the subject permit which would allow for excavation and removal of up to 2500 CY of material as an alternate method of pipeline installation between approximate station 7+25 and 8+20 as shown on Exhibit B of the original permit application (copy enclosed). We have negotiated with the Owners of Moss Planing Mill for placement and spreading of the material upon their property. Enclosed is a copy of a letter from Mr. Tbmp Litchfield, Secretary/Treasurer, concerning placement of the material. Also enclosed is a aerial photographic indicating the location of the site. Our contractor intends to make every attempt to install the pipeline by hydraulic jetting as currently permitted. However, we desire to have this alternate method permitted in advance and available to our contractor if necessary.
