This permit, issued on FEBRUARY 28, 1994 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) The area of emergent wetland vegetation which is to be excavated on the island will be restored
to its pre -project contours, preferably with the materials that are excavated. The applicant must
submit to the N. C. Division of Coastal Management a plan for approval on how the restoration
is to be accomplished.
2) All excavated materials will be confined above normal water level and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover
of solids into any marsh or surrounding waters.
3) Trench excavation will not exceed the dimensions as shown on application and plats.
4) Prior to any construction, an onsite meeting must be held at the site between the petmittee,
contractor, and representative of the Division of Coastal Management.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1997
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

5) Prior to beginning work on the project, a N. C. Department of Transportation encroachment
agreement must be obtained and a copy supplied to the N. C. Division of Coastal Management.
NOTE: Prior to pipeline installation, the permittee must obtain an Easement from the Council
of State through the Department of Administration's State Property Office.
NOTE: The Division of Environmental Management approved the project under General Water
Quality Certification No. 2664.

SUBJECT: Water/Wastewater Line Construction to the Cypress Landing Development
Proposal, Chocowinity Bay, Beaufort County, North Carolina
This proposal involves water and sewer lines crossings of Chocowinity Creek to supply those
services to the proposed Cypress Landing Development. The location of the crossings is within
the extraterritorial planning authority of the Town of Chocowinity and thus comes under the
auspices of the September 1993 CRC Certified Chocowinity Land Use Plan Update. While
Chocowinity has its own water treatment and distribution system, the project is further
complicated in that Chocowinity is connected to the City of Washington's wastewater system,
so sewer service Chocowinity provides to Cypress Landing will be treated by Washington, and
both Cypress Landing and Chocowinity are subject to the City of Washington's treatment
capacity.
The City of Washington's March 1991 CRC Certified Land Use Plan Update notes that average
daily usage is about 75 % of capacity (Page 17) and notes that when Chocowinity connects to
Washington's system, in 1991 usage will be raised to about 92% of capacity. No mention is
made as to what the City intends to do in future years, yet "The present capacity appears to be
adequate." (Page 21).
The Chocowinity Land Use Plan offers the following guidance on proposals of this type:
Page 8 - "The Town appears to have an adequate supply of water to serve demand.
Even assuming a large usage increase to accommodate the proposed Cypress Landing
Development on Chocowinity Bay, current water supply would be adequate, although
storage capacity would be short of a full days supply."
The Plan's discussion of sewage services is found on Page 9 as follows:
"Sewer Service. The Town has entered into a partnership situation with the City
of Washington to supply public wastewater treatment needs. During the course of this
update, the Town should begin operation of this system. Each existing septic tank will
be provided with a pump to move wastewater from the tank to the trunk line, which will
then be pumped to Washington for treatment. New development will still be required
to install a septic tank, but it will not be subject to the usual Health Department
permitting requirements, so minimum lot sizes may be reduced for future development
served by the sewer line. A major limiting factor for new development will be the
contract agreement between the Town and the City. A capacity of 120,000 gpd has been
committed to Chocowinity, with an option to purchase an additional 25,000 gpd at an

additional charge, but until the Town actually goes on line, no one is;sure what the
current .demand will be. Engineering estimates range from 100,000 gpd to the full
120,000 gpd. A major improvement project at the Singer Furniture factory could
significantly impact capacity reserves, if in fact such reserves exist. Washington has also
agreed to amend the capacity clause if necessary, should the Town allow the proposed
Weyerhauser development on Chocowinity Bay to tap into the Town's lines."
On Page 7 in the Plan there is note of 404 wetlands and AEC's within the Town's planning area
and acknowledgement that the Corps and Division of Coastal Management regulates these areas.
Town policy (Page 18) on freshwater swamps and marshes is; "The policy shall be to help
protect swamp and marsh areas from inappropriate development. Implementation shall occur
through periodic review of the local zoning scheme, strict enforcement of the zoning ordinance,
and support for State and Federal restrictions on destruction of swamps and marshes."
Town policy on 404 wetlands (Page 18) is; "The policy shall be tb support all development
which complies with federal controls."
Other policies in the preface to the Resource Protection Policy Section (Page 17) underline the
Town's strong support for natural resources and notes the Town's support of development only
if conducted in an appropriate fashion.
By definition (Page 36) AEC's and forested wetlands are considered in the Conservation Land
Classification. That class does not imply "non use" but rather careful and cautious management
of the uses allowed therein.
The Plan (Page 36) goes on to state that the Town supports the State's restriction of uses in the
Conservation class to uses such as: "2. Necessary utility service lines, such as water, sewer,
electrical, natural gas, etc., when demonstrated that the lines will not terminate on the land
designated as Conservation and the environmental integrity of the Conservation area will not be
violated."
If this proposal can be accomplished in accordance with applicable State and Federal
environmental protection requirements, my opinion is it will not be inconsistent with the 1993
Chocowinity Land Use Plan Update. However, if and when Cypress Landing comes on line,
arrangements as to future sewage treatment capacity may need to be addressed.

8. PROJECT SUMMARY: The applicant is proposing to construct wastewater and potable water lines
to serve Cypress Landing residential development.

Environmental setting
The project site is where Chocowinity Creek, a tributary of Chocowinity Bay and the
Pamlico River, crosses NC 33 approximately 1 mile east of the Town of Chocowinity in
Beaufort County. At the site, the creek has a width of approximately 170' and a average depth
of -3' at normal water level. In the center of the creek is an island which is approximately 40'
in width and is vegetated by various types of wetland vegetation such as Juncus effusus, Hibiscus
W.p,,, Solidago Wp., etc. On both the east and west sides of the creek, the adjacent lands have
been previously disturbed by road construction. These areas are vegetated by a mixture of
upland grasses.
Project proposal
The purpose of the proposed project is to provide wastewater collection and to provide
potable water to the proposed Cypress Landing Development which is being constructed by
Weyerhaeuser Real Estate on Chocowinity Bay. The development along with its amenities were
previously permitted by the North Carolina Division of Coastal Management in 1989 when
CAMA Major Development Permit No. 181-89 was issued. At that time, the development was
proposing its own land application sewage disposal system and well system for potable water.
Since that time, arrangements have been made with the Town of Chocowinity and the City of
Washington to provide the services. In order to construct the necessary lines, Chocowinity
Creek must be crossed resulting in the application that is being considered. The applicant is now
proposing the following:
(1) The construction of 14,000 linear feet of 6" sanitary sewer force main and a 10"
water main along SR 1123 and NC 33 for connection into existing Town of
Chocowinity lines. At Chocowinity Creek, the lines will be placed within
existing NC Department of Transportation right -a -ways or the north side of NC
33. The lines will be placed approximately 10' apart within a subaqueous trench.
The trench will be f 170' in length ±20' wide and the pipes will be placed a
minimum of -3' below the existing creek bottom. Once the pipes are in place,
the trench will be allowed to backfill naturally. The sides of the creek will be
stabilized with 4" Geogrid along the disturbed area.

Environmental impact
The following environmental impacts will occur:
(1) ±800 sq. ft. of wetland vegetation as described under Environmental setting will
be excavated.
(2) ±2,600 sq. ft._ of open water area will be excavated.
(3) Some short term turbidity will occur during the trench excavation and pipe
placement.

PROJECT NARRATIVE
This project consists of the extension of public water and wastewater utilities to service the
proposed Cypress Landing Company Development. Specifically, the extension includes
approximately 14,000 linear feet of a 6-inch sanitary sewer force main and a 10-inch water main.
The proposed route is from the development, northerly along NCSR 1123, NC 33, and Bragaw
Lane in the Town of Chocowinity.
The portion of this project to which this permit application applies is the subaqueous crossing
of these utility pipes under Chocowinity Creek. This crossing will be made in NCDOT ROW,
along the east side of the bridge carrying NC 33 over the creek.
The application information is that associated directly with this utility project, except that
information in Section 5 Upland Development pertains to the Cypress Landing project itself
which has been permitted previously and separately.
