Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. Pier Construction 1) Prior to any construction at the site, a pre -construction meeting must be held between the applicant, contractor and representative of the Division of Coastal Management. 2) The pier structures shall have a minimum setback of 15 feet between any parts of the structure and the adjacent property lines as extended perpendicular to the channel into the water at the points where they intersect the shoreline. Operation and Maintenance 3) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1997 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. The proposal is located in public trust waters, by definition an AEC. The County Plan offers the following on development within AEC's: Pg. VIII-4; "C. Support development in AEC's only if such development meets the management objectives in 15 NCAC 7H.0203 and the use standards in 15 NCAC 7H.0208 and .0209." By definition AEC's are included in the Conservation Land Classification. That class (Pg. IX-9) calls for the effective long-term management .5f special resources to protect their natural, cultural, recreational, scenic or productive values. The classification map also shows the Camp Leach Estates (upland portion) in the Limited Transition Class. That class (Pg. IX-5) calls for limited development with some services such as group water systems and generally acknowledges these areas are geographically remote from existing towns. These modest density areas are noted as being suitable for closed water systems rather than individual wells. PROJECT SUMMARY: The applicant is proposing to construct two (2) piers to improve their existing boating access site. Camp Leach Estates Homeowners Association Beaufort County Environmental setting Camp Leach Estates is a 46 lot subdivision which is located off of SR 1335 adjacent to the Pamlico River and Mallard Creek in Beaufort County. Of the total 46 lots, 25 are presently built upon with single family dwellings. Each lot has an individual septic tank and the entire community has a central water system. When the development was begun in the mid-1980's, the developers established a 0.51 acre access area for the entire development on Mallard Creek. Located at the site was a gravel access road, a 15' wide by f 30' long concrete boat ramp and a 30' long pier with a L-shaped platform at the waterward end. The access lot is mostly gravel with some areas of upland vegetation. A fringe of coastal wetlands (marsh) which is dominated by Spartina anosuroides is located adjacent to Mallard Creek on both sides of the existing boat ramp. Project proposal The applicant is proposing the following: (1) The construction of a 80' long by 5.0' wide pier north of the existing boat ramp. (2) The attachment of a 50' long by 5' wide pier to the L-shaped platform of the existing pier. Both piers will be used for temporary mooring of boats as they are launched at the existing ramp. Environmental impacts The project as proposed should have a minimal environmental impact. Some short term turbidity may exist during time of pier construction. David L. If the applicant is not claiming to be the owner of said property, then forward a copy of the dead or other instrument under which the owner claims title, plus written permission from the owner to carry out the project. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue -line prints or other larger plats are acceptable only if 18 high quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the site.
