This permit, issued on ��b / is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The proposed dock will not be constructed within 15' of the Ralph Jarvis property line without prior written approval from Mr. Jarvis. (2) The proposed roof atop the dock will be opensided and in no way be enclosed. (3) The riprap material will not be aligned farther waterward than an average of 3 feet from the normal water elevation contour. (4) Vegetated wetlands will not be excavated or filled. (5) The riprap material will be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (6) Prior to any of the pond being filled, a bulkhead must be constructed along the western side of the pond to prevent spillover into the adjacent marsh. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Lyle Cahoon ADDITIONAL CONDITIONS Permit #131-87 Page 2 of 2 (7) No excavated or fill material will be placed at any time in any marsh or surrounding waters outside of the alignment of the fill area indicated on the work,plat (sheet 1 of 2, modified). (8) All backfill material will be obtained from a highground source and confined behind the permitted bulkhead. (9) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction -related discharge. (10) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. (11) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. NOTE: The proposed project is certified under General Water Qual.ity Certification No.=1664 issued on September 8,ti1983, for Rip -Rap Placement: NOTE: This 11/87 modification authorizes the placement of fill in a borrow pit adjacent to the parking area.
