This permit, issued on \ -_ 0;4-q — q 0% , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) The riprap will not extend waterward more than 10 feet from the normal water level at any point
along its alignment at the time of construction and will average 5' beyond the normal water level.
2) No vegetated wetlands will be excavated or filled.
3) The riprap material must be free from loose dirt or any other pollutant, except in trace quantities.
It must be of a size sufficient to prevent its movement from the site by wave or current action. The
riprap material must consist of clean rock or masonry materials such as, but not limited to, granite
or broken concrete.
4) No fill material will be placed at any time in any marsh or surrounding waters outside of the
alignment of the fill area indicated on the workplans.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or piioject modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31.2002
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
5) All backfill materials will be obtained from a highground source and confined landward of the
permitted riprap alignment.
6) The temporary placement or double -handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
7) No excavated or fill material will be placed in any location or in any manner so as to impair surface
water flow into or out of any wetland area.
8) The permittee will maintain the authorized work in good condition and in conformance with the
terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons
the permitted activity without having the permit transferred to a third party.
9) No attempt -will be made by the permittee to prevent the full and free I use by the public of all
navigable waters at or adjacent,to the authorized work. Use of the permitted activity, must not
interfere with the public's right to free navigation on all navigable waters of the United States.
NOTE: The Division of Water Quality approved this project on November 10, 1998
under General Water Quality Certification No. 3112.

8. PROJECT SUMMARY: The applicant proposes to subdivide a ±31.2 acre tract of land into 30
residential lots identified as section 14 of Cypress Landing. Development proposed on the waterfront
lots includes; riprap, and a concrete sidewalk.

Project Setting
The project site is located off SR 1123 at the Cypress Landing Development on
Chocowinity Bay near Chocowinity, in Beaufort County, North Carolina. Weyerhaeuser Real
Estate proposes to develop a ±31.2 acre tract of land identified as section 14 on the Cypress
Landing master plan. Upstream (west) of the project area is the developed portion of Cypress
Landing and has single family dwellings, a marina and a golf course. Downstream (east) of the
project area is a developed subdivision known as Moore's Beach. The project site is a wooded
tract, vegetated with mixed hardwoods, pines, shrubs and vines. At each end of the project site
are large areas of coastal wetlands predominately vegetated with Spartina ,ynncnroidec. The t 15'
elevation above mean sea level -created an erosion bluff at the bay interface which created
aggressive undercutting of the bank in several locations in the project area as a result of
Hurricanes Bertha and Fran in 1996.
Chocowinity Bay is classified as SB by the Environmental Management Commission.
Chocowinity Bay at the project site is a Public Trust Area and is not open to shell fishing.
Project description
The applicant proposes to subdivide the t31.2 acre tract into 30 home sites of f 1 acre
each. Five of the lots will extend to Chocowinity Bay and are the project site. The applicant
proposes to place ±775' of riprap along the shoreline. The riprap will average 5' waterward of
the normal water level (NWL) with a maximum distance offshore of 10'. The riprap will extend
approximately 10' landward of the NWL to a height of 6' above the NWL. The existing shoreline
will be graded down to the newly installed riprap over a width of 25'.
An asphalt road is under construction onto the property and will terminate at the east end
of the project area and has no wetland impact.
Anticipated impacts
The project as proposed will result in the filling of t3,875 ft2 of bay bottom associated
with the placement of the riprap. Grading of the existing bluff and the construction of the
sidewalk as well as the road construction and upland fill activities will result in the disturbance
of ±96,964.6 ft2 of high ground. The project as proposed will result in localized turbidity as a
result of the construction activities.

PURPOSE -THE PURPOSE OF THE PROPOSED PROJECT IS TO STABILIZE

THE INCREASED RATE BEGAN WHEN HURRICANES BERTHA AND FRAN HIT
THE AREA AND IT CONTINUES TODAY. _
PROJECT DESCRIPTION-RIPRAP WILL BE PLACED ALONG
APPROXIMATELY 775 FEET OF THE SHORE AND A CONCRETE WALKWAY
WILL BE BUILT AT THE TOP OF THE RIPRAP. DEBRIS ALONG THE
SHORELINE WILL BE REMOVED AND DISPOSED OF AT AN OFFSITE
LOCATION.
TIMING -IT IS OUR INTENTION TO BUILD THE PROJECT IN THE FALL OF
1998, PRIOR TO SALE OF THE AFFECTED HOMESITES; THEREFORE,
- CUSTOMERS WILL NOT BE REQUIRED TO INDIVIDUALLY APPLY FOR
PERMITS AND SUPERVISE THE CONSTRUCTION.

other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under

from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the
