This permit, issued on January 26, 2022 1 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation tf these terms may be subject to tines, imprisonment or civil action; or may cause the permit to ne min ana voia. Upland Development within Urban Waterfront 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the 8 condominium buildings, driveway, sidewalk and boardwalk along the bulkhead, and other associated infrastructure, all as expressly and specifically set forth in the attached permit application and workplan drawings. Shoreline Stabilization - Bulkhead 2) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2025 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit No. 4-22 Page 2 of 3 ADDITIONAL CONDITIONS 3) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 4) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. 5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 6) The bulkhead shall be constructed prior to any backfilling activities. 7)- The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 8) This permit does not authorize any excavation waterward of the approved alignment. 9) The fill material shall be clean and free of any pollutants except in trace quantities. 10) . Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 11) No backfill material is to be placed within 30 feet of the normal high-water level, except that which will be used to backfill the area behind the permitted bulkhead. 12) All fill material to be placed below normal high-water level shall be confined behind the permitted bulkhead. 13) This permit does not authorize any formalized boat slips. Stormwater Management 14) The Division of Energy, Mineral and Land Resources is currently reviewing a stormwater management plan permit application to determine if the proposed project is in compliance with North Carolina's stormwater management rules. If required, the permittee shall receive a Stormwater Management Permit, and provide a copy of this permit to DCM, prior to the initiation of any development activities authorized by this permit. Any violation of the permit approved by the DEMLR shall be considered a violation of this CAMA permit. Sedimentation and Erosion Control 15) An Erosion and Sedimentation Control Plan modification will be required for this project. If required, this plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Division of Energy, Mineral and Land Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. 11 Showboat Investments LLC. Permit No. 4-22 Page 3 of 3 ADDITIONAL CONDITIONS 16) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 17) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 18) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 19) This -permit -shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 20) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 21) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800080 (Action ID SAW-2022-00065). NOTE: The N.C. Division of Water Resources authorized the proposed project by way Water Quality Certification No. WQC004602 and assigned the project DWR Project No. 1995-1130 v2. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An express application processing fee of $2000 was received by DCM for this project. Subject: Showboat Cottages Recommendations SHORELINE STABILIZATION • The bulkhead alignment will approximate the existing bulkhead at the time of construction. • The bulkhead/riprap shall not extend more than 2 feet average waterward from the existing bulkhead wall and not more than 5 feet at any point along its alignment at the time of construction. • Any changes in the the alignment of the authorized bulkhead/riprap must be reviewed for approval by a representative of the Division of Coastal Management prior to the start of construction. • The bulkhead must be constructed prior to any backfilling activities. • The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. • The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall. This permit does not authorize any excavation waterward of the approved alignment. • The fill material will be clean and free of any pollutants. Metal products, asphalt, petroleum based, organic materials, or hazardous material or debris shall not be used. • All backfill material will be obtained from a high ground source and confined behind the permitted bulkhead. • All fill material to be placed below mean high/normal water level will be confined behind the permitted bulkhead. • Operative sedimentation and erosion measures shall be installed prior to site improvements to prevent sediment and runoff from entering the adjacent waterbody until the disturbed areas are effectively vegetated and stabilized. 1 WATER QUALITY & STORMWATER • In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. • The DEMLR Stormwater Section is currently reviewing the permit application to determine if the project is in compliance with North Carolina's Water Quality Certification program. The permittee must receive a Water Quality Certification from DEMLR prior to the initiation of any construction activities. EROSION & SEDIMENTATION CONTROL NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the NCDEMLR, DEQ Wilmington Regional Office , • Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). • A ground cover sufficient to restrain erosion shall be provided within the shorter of 15 working or 30 calendar days of completion of any phase of grading on cut or filled slopes. Navigation • No attempt will be made by the permittee to prevent the free and full use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. The proposed work is located at 702 Atlantic Beach Causeway, within Atlantic Beach in Carteret County, North Carolina. The applicant is proposing to construct a vinyl sheetpile bulkhead 5' above the normal high water (NHW) line to raise the elevation of the finished grade to a proposed 7' NHW elevation. The proposed bulkhead would be constructed 2' waterward of the existing bulkhead. The gap between the existing and proposed bulkheads would be back -filled with clean earthen material. The proposed bulkhead would then be topped with a shore -parallel 6' wide by 425' long slatted boardwalk. DMF does not oppose to the project as proposed. However, DMF would recommend that the proposed boardwalk include design elements that prevent the area from being used as docking. This could be accomplished by incorporating railings and installing signs indicating that docking is prohibited. Thank you for consideration of our comments and concerns. Overview: The project is located at 702 Atlantic Beach Causeway, Atlantic Beach, Carteret County, at the former Showboat Hotel property, adjacent to the man-made canal to the east and is also contiguous with Bogue Sound. The 1.334—acre project property was formerly developed with a hotel (the Showboat Hotel), paved parking lot, pool, boat ramp, bulkhead, and 10 slip docking facility.The existing building, pool; septic system, and parking lot have been razed and removed. There is an existing dilapidated bulkhead, boat ramp, and remnant dock structures and mooring pilings remaining on the property and within the property's riparian area. AECs onsite include .Coastal/Estuarine Shoreline. This area is designated as Urban Waterfront and is located within the Division of Water Resources White Oak River Basin area. The waters of Bogue Sound in this area are classified as SA; HQW, are not classified as a primary nursery area and are closed to shellfishing. No submerged aquatic vegetation is present at this location. There are no coastal, non - coastal wetlands or cultural resource within the project property. There is a federally designated channel that is parallel to the property shoreline and is within approximately 47' of the federal channel setback on the south end of the property and within approximately 25' of the channel setback near the northern end of the property. The project tract prior to the demolition contained 60,810 square feet of impervious surface area which included the offsite service road (45,870 square feet onsite with an additional 14,821 square feet from the off -site area from property line to edge of travel lane). The applicant proposes to re -develop the upland area with eight (8) residential multi -family duplex buildings (16living-units) with a private concrete drive for each unit, concrete sidewalk, and shared septic system per building. Upland disturbance is approximately 2.02 acres, which includes the proposed grading on the off -site property. The 30' CAMA buffer would not apply to this development pursuant to the Urban Waterfront designation in accordance with NCAC 15A 07H .0209(g)(4). The existing boat ramp on the property would be filled in or removed. The top of the existing bulkhead averages an elevation of 2.5' NHW. The applicant proposes to construct a vinyl sheetpile bulkhead 5' above NHW to raise the elevation of the finished grade to a proposed 7' NHW elevation bringing the site up to the base flood elevation (AE 7). The proposed bulkhead would be constructed two feet waterward of the existing bulkhead. The gap between the bulkheads would be back - filled with clean earthen material. The bulkhead structural tie -back work corridor would be approximately 10-12' landward measured from the proposed bulkhead. The bulkhead would be topped with a shore - parallel, 6' wide x 425' long slatted boardwalk at grade level. Anticipated Impacts: This project is proposed to connect to the waterfront boardwalk, the project would locate residential structures in the estuarine shoreline to within 15' of the NHW line (Bulkhead). There are no wetlands onsite and there are no anticipated impacts to habitat or shellfish resources. The proposed re- development would reduce the previous impervious surface by 25% and includes the use of vegetative swales for stormwater runoff treatment. According to the project design engineers, the proposed systems would improve stormwater treatment than the previous conditions that existed onsite. Impacts include temporary high ground shoreline disturbance because of the associated grading and landscaping. There would be risk of sedimentation and erosion runoff into the adjacent canal and waters of Bogue Sound without the use of effective sedimentation control barriers and practices. There would be temporary water column turbidity during the installation of the bulkhead. Long term impacts would include the usurpation of 630+/- square feet of public trust waters by the construction of a bulkhead waterward of the existing bulkhead. The proposed bulkhead would shorten the existing channel width by an average of two feet along the shoreline in this area from an existing 161' to 159' from bulkhead to bulkhead. Basis for Determination: The project site is located in the Town of Atlantic Beach and is subject to the town's CAMA Land Use Plan Update, certified by the CRC on September 24, 2021. The Future Land Use Map (FLUM) designates the site as "Causeway", and the subject AECs as "Conservation'. The "Causeway" classification provides requirements that defer to two zoning districts, Commercial Corridor and Commercial Circle (see Figure 1). As DCM does not administer zoning this permit review can only determine the consistency of the Permitted Uses requirement that apply to the entire Causeway Classification. The other requirements should be administered by the town through their zoning ordinance. Narrative Description: The project property was formerly developed with a hotel (the Showboat Hotel), paved parking lot, pool, boat ramp, bulkhead, and 10 slip docking facility. The property is located adjacent to the man-made canal to the east and is also contiguous with Bogue Sound, in Atlantic Beach, Carteret County. The property is bordered on the north by vacant commercial property (formerly the Channel Marker Restaurant) and on the South by a vacant commercial parcel and on the west by the Atlantic Beach Causeway. This property was previously developed for commercial use as a hotel. The existing drainage ground surface flow was into Bogue Sound. The existing building, pool, septic system, and parking lot have been razed and removed. There is an existing dilapidated bulkhead, boat ramp, and remnant dock structures and mooring pilings remaining on the property and within the property's riparian area. There was a previous CAMA Major Permit No. 62-95 (expired) issued for the docks and piers. The elevation of the high ground of the parcel is approximately 2.5' to 4.0' above the normal high water (NHW). There is no vegetation on the tract. The 1.334-acre tract has approximately 470 linear feet of continuous shoreline, approximately 150' of that shoreline borders along the man-made canal waterway within the project site. The narrowest canal width adjacent to the southern end of the property is approximately 161' feet across and then open to Bogue Sound at the northern end of the property. There are no coastal or non -coastal wetlands within the project area. This area is designated as Urban Waterfront and is located within the Division of Water Resources White Oak River Basin area. The waters of Bogue Sound in this area are classified as SA; HQW. There is not a cultural resource within the project property. These waters are not classified as a primary nursery area and submerged aquatic vegetation is not present at this location. This area is closed to shellfish harvest. There is a federally designated channel that is parallel to the property shoreline and is within approximately 47' of the federal channel setback on the south end of the property and within approximately 25' of the channel setback near the northern end of the property. There is an easement agreement for a submerged land claim appurtenant to and that runs with the adjacent riparian or littoral land for this property for the existing docks and piers lying over the state-owned submerged lands in Bogue Sound that is valid until April 23, 2050. Roy Brownlow December 13, 2021 Morehead City Field Investigation Report: Showboat Cottages, Atlantic Beach, Carteret County Paae 3 Proposed Development: The project tract prior to the demolition contained 60,810 square feet of impervious surface area which included the offsite service road (45,870 square feet onsite with an additional 14,821 square feet from the off -site area from property line to edge of travel lane). The applicant proposes to re -develop the upland area with eight (8) residential multi -family duplex buildings (16 living -units) with a private concrete drive for each unit, concrete sidewalk, and shared septic system per building. Upland disturbance is approximately 2.02 acres, which includes the proposed grading on the off -site property. The proposed residential structures at the closest points on the south and north ends would be approximately 15' from the NHW. The 30' CAMA buffer would not apply to this development pursuant to the Urban Waterfront designation in accordance with NCAC 15A 07H .0209(g)(4). The existing boat ramp on the property would be filled in or removed. The top of the existing bulkhead averages an elevation of 2.5' NHW. The applicant proposes to construct a vinyl sheetpile bulkhead 5' above NHW to raise the elevation of the finished grade to a proposed 7' NHW elevation bringing the site up to the base flood elevation (AE 7). The proposed bulkhead would be constructed two feet waterward of the existing bulkhead. The gap between the bulkheads would be back -filled with clean earthen material. The bulkhead structural tie -back work corridor would be approximately 10-12' landward measured from the proposed bulkhead. The bulkhead would be topped with a shore -parallel, 6' wide x 425' long slatted boardwalk at grade level. As per the project engineer, the previous existing site provided stormwater sheet flow with no treatment of the runoff before discharging into Bogue Sound. The previous built upon site had no grassed areas between the parking area on the west and the bulkhead on the east side of the property. The project engineer states the redevelopment plan proposes approximately 25% less impervious and provides sheet flow through vegetated areas to provide stormwater treatment by natural features that would decrease runoff velocity and promote ground infiltration. The narrowest point between existing bulkheads within the manmade canal located along the southern portion of the project property measures approximately 160' in width. The proposed bulkhead would decrease this distance by two feet at this same location. The proposed bulkhead would vary from the western edge of the federal channel setback anywhere from 23'- 67'. Potable water would be provided by the Town of Atlantic Beach via a two-inch extension. The project engineer reports the on -site septic systems have received construction authorizations from Carteret County Environmental Health. No dredging or docking facilities are proposed as part of this submittal. Roy Brownlow December 13, 2021 Morehead City Field Investigation Report: Showboat Cottages, Atlantic Beach, Carteret County Paqe 4 Anticipated Impacts: This project is proposed to connect to the waterfront boardwalk, the project would locate residential structures in the estuarine shoreline to within 15' of the NHW line (Bulkhead). There are no wetlands onsite and there are no anticipated impacts to habitat or shellfish resources. The proposed re -development would reduce the previous impervious surface by 25% and includes the use of vegetative swales for stormwater runoff treatment. According to the project design engineers, the proposed systems would improve stormwater treatment than the previous conditions that existed onsite. Impacts include temporary high ground shoreline disturbance because of the associated grading and landscaping. There would be risk of sedimentation and erosion runoff into the adjacent canal and waters of Bogue Sound without the use of effective sedimentation control barriers and practices. There would be temporary water column turbidity during the installation of the bulkhead. Long term impacts would include the usurpation of 630+/- square feet of public trust waters by the construction of a bulkhead waterward of the existing bulkhead. The proposed bulkhead would shorten the existing channel width by an average of two feet along the shoreline in this area from an existing 161' to 159' from bulkhead to bulkhead. No wetlands exist on the site. The existing Showboat Hotel and parking area was built in 1973 per the Carteret Count Tax Office (Exhibit A) predating any NCDEQ stormwater regulations. The existing impervious area survey was provided by Kevin Barefoot, PLS of KR Barefoot Surveying located in Newport, NC, entitled ALTA/NSPS Land Title Survey, Showboat Investments, LLC dated May 6, 2019. The existing building and parking area have been demolished. The existing impervious calculated on the tract is approximately 45,870 square feet with an additional 14,821 square feet off site (area from property line to edge of travel lane) but within the overall stormwater project area. Other existing features of the site include a damaged septic system to be removed, boat ramp to be removed and filled, sheet pile bulkhead and dilapidated docking facility. In 2008, the Town of Atlantic Beach designated properties lining the Causeway as Urban Waterfront (see Exhibits B and Q. This Urban Waterfront designation provides exemption from the Vegetative Buffer Requirements per Session Law 2008-211 Section 2(e) which is incorporated into the proposed design. The site drains from west to east into Bogue Sound, Class SA;HQW and is within 575' and must meet erosion and sedimentation design standards for sensitive watersheds. Even though the existing development provided sheet flow there was zero treatment of the runoff before discharging into Bogue Sound. No grassed areas were provided between the parking area and bulkhead. This redevelopment plan proposes approximately 25% less impervious and provides sheet flow through vegetated areas to provide better stormwater treatment by naturally removing pollutants, decreasing runoff velocity and promoting infiltration. At this time future allocation of the remaining impervious is included in the design for documentation in the permit. Coastal Stormwater Regulations The North Carolina Division of Environmental Management implemented coastal stormwater regulations in coastal counties on January 1, 1988, and most recent codified effective January 1, 2017. This project is submitted for approval consideration under Redevelopment per 15A NCAC 02H.1001(1)(f), G.S. 143-214.7(al) and Session Law 2008-211 Section 2(e). Coastal Management Upland development proposes eight (8) duplex buildings (16-units) with a private drive for each unit. A taller bulkhead is proposed waterward of the existing and then the site will be filled bringing the site up to the effective flood zone AE 7. Potable water is provided by the Town of Atlantic Beach via a two-inch extension. On -site septic systems have received improvements permits with Carteret County Environmental Health. Upland disturbance is approximately 2.01 acres. No dredging or water dependent structures proposed as part of this submittal.
