Docking Facility
1) This permit authorizes a maximum of 4 boat slips.
2) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance
with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with
boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the
entire existence of the permitted structure.
3) Should the adjacent property to the north be sold prior to the initiation of construction of the docking
facility, the permittee shall be required to obtained a signed riparian corridor waiver from the new
property owner.

This permiLaction may be appealed by the penmittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the pernit expires on
December 31, 2003
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using
the docking facility. Any sewage discharge at the docking facility shall be considered a violation
of this permit for which the permittee is responsible. This prohibition shall be applied and
enforced throughout the entire existence of the permitted structure.
5) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, may become a permanent part of this docking facility without
permit modification. No non -water dependent uses of structures may be conducted on, in or over
public trust waters without permit modification.
6) No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
7) The authorized structure and associated activity must not cause an unacceptable interference with
navigation.
8) The permittee must install and maintain at his expense any signal lights or signals prescribed by
the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a
minimum, permanent reflectors should be attached to the structure in order to make it more
visible during hours of darkness or inclement weather.
9) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in
the opinion of the Secretary of the Army or his authorized representative, said structure or work
shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will
be required, upon due notice from the Corps of Engineers, to remove relocate or alter the
structural work or obstructions caused thereby, without expense to the United States or the state
of North Carolina. No claim shall be made against the United States or the state of North
Carolina on account of any such removal or alteration.
10) The permittee will maintain the authorized work in good condition and in conformance with the
terms and conditions of this permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without having it transferred to a third party.
Utility Line Installation
11) In accordance with the 401 Water Quality Certification for the proposed project, double -lined
pipes or anti -seep collars shall be used for any segments of the sanitary sewer line going through
any area of open water, marsh or other wetland.

ADDITIONAL CONDITIONS
12) Preconstuction wetland and open water substrate contours will be restored and all excess
materials will be removed to a high ground disposal area immediately following completion of
the wetland portion of the utility crossing.
NOTE: The extension of the wastewater collection system was authorized by the Division of
Water Quality on 2/23/00 (Permit No. WQ0017830).
Sedimentation and Erosion Control
13) In orderto protect water quality, runoff from construction must not visibly increase the amount
of suspended sediments in adjacent waters.
14) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain
erosion within thirty days of project completion.
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan
must be filed at least thirty (30) days prior to the beginning of any land disturbing
activity. Submit this plan to the New Hanover County Engineering Department.
General
15) In accordance with the 401 Water Quality Certification for the proposed project, future
construction on Lots 14, 15, 16 and 17 must be implemented without the involvement of any
wetland fill.
16) No excavated or fill material will be placed at any time in any vegetated wetlands or surrounding
waters outside of the alignment of the fill area indicated on the workplan drawing(s).
NOTE: The permittee is encouraged to contact the New Hanover Mosquito Control Office at
(910) 252-2505 to discuss mosquito control measures.
NOTE: The N.C. Division of Water quality has authorized the proposed project under General
Water Quality Certification No 3112 (DWQ Project No. 000585), which was issued on
6/5/00.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id.
No. 200001085.

to Coastal Resources Commission Rule 710203
for a detailed description.)
Please note that original drawings are preferred
and only high quality copies will be accepted.
Blue -line prints or other larger plats are acceptable
only if an adequate number of quality copies are
provided by applicant. (Contact the U.S. Army
Corps of Engineers regarding that agency's use of
larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently
detailed to guide agency personnel unfamiliar with

Summary
Southern Lifestyles proposes to develop an existing18 lot subdivision at the end of Windy Hills
Drive adjacent the Intracoastal Waterway (AIWW) on Myrtle Grove Sound. The proposed
development will include a sanitary sewer line extension to become part of the County's system
and a pier with four boat lifts. According to the Division's Field Investigation Report, several lots
have been sold and some lot owners have secured permits for lot improvements and private
bulkheads and piers. The subdivision has been approved by the New Hanover County Planning
and Zoning Department.
Impact on AECs
According to the Division's Field Investigation Report the following AECs will be effected:
Estuarine Waters (EW), Estuarine Shoreline (ES), Coastal Wetlands (CW), and Public Trust Area
(PTA). Waters at the site are classified SA-ORW and are open to shellfishing. The site is a
Primary Nursery Area (PNA).
LUP review
The development proposal has been reviewed for consistency with the 1997-2010 New Hanover
County Land Use Plan Update and Comprehensive Plan (LUP).
Land Classification
The land classification for the area of the proposed boat dock expansion is Conservation (C) and
Resource Protection (RP). The purpose of the C classification is to provide for effective long-
term management and protection of significant, limited or irreplaceable natural resources while
also protecting the rights of the property owner. The LUP limits development of these areas to
water dependent uses, shared industrial access corridors, and exceptional developments
preserving natural features.
The purpose of the RP class is to provide for the preservation and protection of important natural,

Policy Discussion
Chapter seven in the LUP contains policies pertaining to natural resources. Policy 4.9 concerns
the development of docking facilities. The policy states that docks are to be limited to the

n1inimum necessary to provide access for waterfront property owners. Policy 3.4 concerns
development within wetlands and is applicable to the construction of the sewer line. According to
the development proposal, all wetlands harmed during the construction of the sewer line extension

Recommendation
This project appears to be consistent with the 1997-2010 LUP provided all local, state, and

Summary
Southern Lifestyles proposes to develop an existingl S lot subdivision at the end of Windy Hills
Drive adjacent the Intracoastal Waterway (AIVM on Myrtle Grove Sound. The proposed
development will include a sanitary sewer line extension to become part of the County's system
and a pier with four boat lifts. According to the Division's Field Investigation Report, several lots
have been sold and some lot owners have secured permits for lot improvements and private
bullcheads and piers. The subdivision has been approved by the New Hanover County Planning
and Zoning Department.
Impact on AVCs
According to the Division's Field Investigation Report the following AP Cs will be effected;
Estuarine Waters (EW), Estuarine Shoreline (ES), Coastal Wetlands (CW), and Public Trust Area
(PTA), Waters at the site are classified SA-0RW and are open to shellfishing. The site is a
Primary Nursery Area (PNA).
LUP review
The development proposal has been reviewed for consistency with the 1997-2010 New Hanover
County Land Use Plan Update and Comprehensive Plan (LUP).
Land Classification
The land classification for the area of the proposed boat dock expansion is Conservation (C) and
Resource Protection (RP), The purpose of the C classification is to provide for effective long-
term management and protection of significant, limited or irreplaceable natural resources while
also protecting the rights of the property owner. The LUP limits development of these areas to
water dependent uses, shared industrial access corridors, and exceptional developments
preserving natural features.
The purpose of the RP class is to provide for the preservation and protection of important natural,
scenic, wildlife and recreational resources. Residential densities in these areas are limited to 2.5

The applicant is proposing a community marina in Myrtle Ground Sound, a Primary
Nursery Area. Water depths in the slips would be from 2-2.5 ` MLW. Because of its location
adjacent to the Intracoastal Waterway and close proximity to Carolina Beach Inlet, once the
structure is built a significant amount of sand will be deposited around the pilings similar to what
has happened at Dolphin Bay. It needs to be strongly stated in the permit that dredging will
never be permitted for this project, no matter how much sand piles up in the slips. Let the buyer
beware!

The North Carolina Wildlife Resources Commission has reviewed the project for impacts
to wildlife and fishery resources. A site visit was made on June 5, 2000. Our comments are
provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401,
as amended; 16 U.S.C. 661 et seq.) and the Coastal Area Management Act (G.S. 113A-100
through 113A-128).
The applicant proposes to develop a subdivision adjacent to the AIWW on Myrtle Grove
Sound. Intentions are to trench sewer pipeline across wetlands and an associated tidal creek to
connect to the planned Loder Landing Subdivision north of the project. A 9-slip community dock
is also proposed. The proposed development borders a high quality tidal creek system comprised
of jurisdictional 404 wetlands having mature vegetation, coastal wetlands, and waters classified
SA-ORW, Primary Nursery Area, and open to shellfishing. Excellent habitat occurs for raccoon,
opossum, muskrat, wading birds, waterfowl, various songbirds, diamondback terrapin and other
reptiles (a black racer was seen in 404 wetlands), various juvenile fishes, fiddler crabs,
and periwinkles. Also, the water quality protection function of site wetlands is extremely
important.
Estuarine habitats associated with the project are extremely. sensitive to perturbation.
Jurisdictional 404 wetlands have been delineated and are a significant proportion of the platted
lots, especially lots 14 through 17. It is our understanding that wetland fill•as currently proposed
is limited to a small isolated pocket. We are concerned, however, that future individual requests
to fill wetlands will come from lot owners and frankly cannot see how lots 14 through 17 can be

developed otherwise. These wetlands form the outer edges of the tidal creek system and we
consider them critical buffers to stormwater runoff. The proposed trenching for the sewer
pipeline would disturb high quality coastal wetlands and elevate turbidity in sensitive coastal
waters„ perhaps causing mortality of estuarine organisms. Development of a community dock at
such a shallow, sensitive site may prompt future requests to dredge for enhanced access, resulting
in elevated turbidity and loss of shallow water habitat. Finally, cumulative adverse impacts from
this and similar projects are expected to result in the loss of important existing uses of Myrtle
Grove Sound. Based on these concerns, we recommend that any permit issued be minimally
conditioned as follows.
1. Due to the large area of 404 wetlands bordering the tidal creek in lots 14 through 17,
delete these lots from development plans.
2. Restrictive covenants will be placed on individual lot owners preventing the fill of both
404 and coastal wetlands.
3. The sewer pipeline shall be directionally drilled underneath the tidal creek and
wetlands rather than trenched through them.
4. Present or future dredging for the community dock shall be prohibited.
5. Due to the site's high sensitivity to disturbance, the project shall comply with the most
stringent Use Standards for ORW Estuarine Shorelines.

APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. Dickey:
You have our approval, in accordance with the attached conditions and the conditions listed below, to place fill 0.054 acre
of wetlands, along with disturbance and shading of 0.13 acre of wetlands in order to construct the Windy Hills Subdivision and
sanitary sewer line in New Hanover County as described in your application dated, 2 May 2000. After reviewing your
application, we have determined that this fill is covered by General Water Quality Certification Number 3112. This Certification
allows to use your CAMA Permit when the NC Division of Coastal Management issues it. In addition, you should get any other
federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non -Discharge and Water Supply Watershed regulations. Also this approval will expire when the
accompanying CAMA Permit expires unless otherwise specified in the General Certification. This Certification replaces one
issued to you on May 11, 2000.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application for a new certification. If the property is sold. the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions.
If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached
certification and the following conditions:
1. Double -lined pipes or anti -seep collars should be used for any segments of sanitary sewer line going through marsh or
other wetlands;
2. Deed restrictions shall be placed on all remaining lots;
3. Any construction on Lots 14, 15, 16 and 17 must be implemented without involvement of additional wetland fill.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory, hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

Dear Mr. Blanchard: New Hanover County
In accordance with your application received December 16, 1999, attached is Permit No.
W00017830, dated February 23, 2000, to New Hanover County for the construction and operation of
the subject wastewater collection extension. Please note that a variance has been granted for the
construction of the subject wastewater collection system because the slope of the 10-inch gravity lines
from SSMH #1 to SSMH # 8, and the 8-inch gravity lines from SSMH #8 to SSMH #13 do not meet
Gravity Sewer Minimum Design Criteria requirements for minimum slope.
This permit shall be effective from the date of issuance until rescinded and you shall be subject
to the conditions and limitations as specified in the North Carolina Gravity Sewer Design Criteria
adopted February 12, 1996 and the attached permit.
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations, permission is hereby granted
for the construction and operation of approximately 1,108 linear feet of 8-inch gravity sewer and 1.316
linear feet of 10-inch gravity sewer to serve seventeen (17) single family residences as part of the Windy
Hills Subdivision project, and the discharge of 6,120 GPD of collected domestic wastewater into the
City of Wilmington's existing sewerage system, pursuant to the application received December 16,
1999, and in conformity with the North Carolina Gravity Sewer Design Criteria.
The sewage and wastewater collected by this system shall be treated in the City of Wilmington
Wastewater Treatment Facility (NPDES Permit No- NC0023973) prior to being discharged into the
receiving stream.
This permit shall become voidable unless the agreement between New Hanover County and the
City of Wilmington for the collection and final treatment of wastewater is in full force and effect.

A stormwater management plan must be submitted to and approved by the Wilmington Regional
Office in accordance with 15A NCAC 2H .1000.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatoryhearing upon written request within thirty (30) days follovng receipt of
this permit. This request must be in the form of a written petition, conforming to Chapter 1 SOB of North
Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service
Center, Raleigh, NC 27699-6714. Unless such demands are made this permit shall be final and binding.
The issuance of this permit does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local,
state, and federal) which have jurisdiction.

Carolina. The purpose of the work is to develop a single family residential subdivision with
waterfront lots and community water access.
The proposed project consists of using mechanized equipment to install a subaqueous sewer line in
a 20-foot-wide by 230-foot-long crossing of a tidal creek and marsh to connect with the municipal
sewer line. This work will result in temporary impacts to a small area of intertidal wetlands
vegetated with saltmarsh cordgrass (Spartina alternii fora). Also proposed is the permanent filling
of a small area of isolated wetlands. A 200-foot-long by 6-foot-wide community pier with a 146-
foot-long by 8-foot-wide floating dock with five 30-foot-long by 4.5-foot-wide finger piers is
proposed for Lot 30. The purpose of this structure is to provide water access to the subdivision's
interior lot owners. Water depth at the location of the floating dock is 2.0 to 2.5 feet at mean low
water. The subdivision also includes nine waterfront lots where future requests for authorization of
docks for boating access are likely. In addition, all but one of the 18 lots in the subdivision have
substantial wetland components ranging from 20 to 70 percent of their area.
The project is located adjacent to Masonboro Sound which is designated by the North Carolina
Division of Water Quality as outstanding resource waters (ORW). ORW are high quality waters
deserving of high level of protection from the degradation of water quality. The shoreline includes
a fringe of saltmarsh cordgrass (Spartina alterniflora) marsh which varies in width up to a maximum
of 200 feet. Masonboro Sound and its adjacent intertidal wetlands provide habitat for estuarine
dependent fishery resources for which we are responsible. Commercially and recreationally

important species found in the project area include spot (Leiosiomus xanthurus), spotted seatrout
(Cynoscion nebulosus), Atlantic croaker(Micropogonias undulatus), bluefish (Pomatomus saltairix),
summer flounder (Paralichthys dentatus), Atlantic menhaden (Brevoorlia tyrannus), striped mullet
(Mugil cephalus), hard clams (Mercenaria mercenaria), shrimp (Penaeus spp.), American oyster
(Crassostrea virginica), and blue crab (Callinectes sapidus). The continued production of these
fishery resources is dependent upon the wetlands that help maintain water quality in Masonboro
Sound.
We are concerned that sevoral aspects of the proposed development could result in wetland losses
and/or the degradation of water quality. Seventeen of the eighteen lots in the subdivision include
either Section 404 or intertidal wetland components. If the lot size is inadequate for typical
residential construction, the new property owner may propose to fill wetlands. The resulting
cumulative wetland losses can be avoided by ensuring that lot size is adequate and by incorporating
wetland protection in the restrictive covenants for the subdivision.
We are also concerned with the potential cumulative impact to waters and wetlands of the
construction of multiple docks in this development. As presently proposed, no dredging is
requested. Based on the presence of high quality benthic habitat that supports fishery resources, we
would oppose any future dredging proposals in this area.'
The adverse impacts to wetlands of the proposed sewer line crossing will be minimal only if the
marsh substrate elevation is maintained and revegetation occurs in a timely fashion. Intertidal
wetlands provide a source of detritus that is an important component in the aquatic food chain. They
also provide a refuge from predators and help maintain water quality necessary for continued fishery
production.'
In view of the above, we recommend against federal authorization for the utility crossing of the tidal
creek and associated emergent wetlands and the proposed community pier until a development plan
for the entire subdivision is submitted for review. This plan should demonstrate and ensure that
future requests for the filling of wetlands on individual lots will not occur and that there will no
future requests for dredging in adjacent waters. These restrictions should protect valuable fishery
habitat in the project area.

On February 11, 1991, we renewed general permit No. 198000291 (copy enclosed), which
provides Federal authorization for construction activities that receive authorization from the State
of North Carolina.
A review of your application received May 2, 2000, for Department of the Army
authorization to construct a community pier and to install a sanitary sewer line extension with fill
material to be placed in wetlands adjacent to Intracoastal Waterway near Wilmington, New
Hanover County, North Carolina, indicates it to be a candidate for Federal authorization under this
general permit. Accordingly, the North Carolina Division of Coastal Management will accomplish
the administrative processing of your application. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general permit process for any reason, you
will be informed regarding its further management. If there are no unresolved differences in State -
Federal positions or policies, the final action taken on your application by the State will result in
your receiving written notice from us that your application is consistent with the general permit and
you may commence your activity. Only after receiving such confirmation should you begin work.
On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed
a memorandum of agreement (MOA) establishing procedures to determine the type and level of
mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA
provides for first, avoiding impacts to waters and wetlands through the selection of the least
damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts
on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the
extent appropriate and practical. To enable us to process your application in full compliance with
this MOA, we request that you provide the following additional information:
a. Permits for work within wetlands or other special aquatic sites are available only if the
proposed work is the least environmentally damaging, practicable alternative. Please furnish
information regarding any other alternatives, including upland alternatives, to the work for which
you have applied and provide justification that your selected plan is the least damaging to water or
wetland areas.
b. It is necessary for you to have taken all appropriate and practical steps to minimize
wetland losses. Please indicate all that you have done, especially regarding development and
modification of plans and proposed construction techniques, to minimize adverse impacts.
c. The MCA requires that appropriate and practical mitigation will be required for all
unavoidable adverse impacts remaining after all appropriate and practical minimization has been
employed. Please indicate your plan to mitigate for the projected, unavoidable loss of waters or
wetlands or provide information as to the absence of any such appropriate and practical measures.
This information is essential to our expeditious processing of your application and it should
be forwarded to us by June 5, 2000. Also, a copy of this information must be sent to the North
Carolina Division of Water Quality to enable them to adequately evaluate your application for a
Water Quality Certification pursuant to Section 401 of the Clean Water Act.
Your application, pursuant to Section 10 of the River and Harbors Act and Section 404 of

As requested in your letter of 5/3/2000, I am providing MCA information for the above
mentioned project. The project proposes to install a gravity sewer line from the Windy Hills
property to a lift station north of the property. Following installation, the sewer lines would
become part of the New Hanover County sewer system. Therefore, location of the sewer
easement is dictated by the County's master plan for sewer expansion and involves subaqueous
installation in a tidal creek on the northern edge of the Windy Hills property. While sewer lines
could be installed in uplands along the existing roads, this would require pumping sewage from
the site to Myrtle Grove Loop Road and is not preferred by the County. Rather, a gravity system
is preferred due to the ease of maintenance and the lack of failure during power outages.
Since a gravity sewer system is favored, due largely to the protection of water quality, efforts
have been made to minimize environmental impacts associated with its installation. Pipe will be
installed under the tidal creek at the narrowest width A dirt road exists on the northern side of
the creek and appears to have filled a small portion of marsh. This prior wetland fill provides a
shortened crossing distance from upland bank to upland bank. In addition, the creekbanks are
relatively steep at this location, further limiting the amount of wetland area to be crossed.
Although the sewer easement is thirty feet wide, work will be limited to a twenty foot width
within the tidal creek. Actual excavated area will be only five feet wide. Equipment matting be
used and will serve to prevent rutting damage. It is noted that the use of directional boring was
investigated, but does not offer the level of precision necessary for the slope of a gravity line.
Efforts to mitigate any damage will include restoring the area to its natural grade following
installation. If necessary, plugs of Spartina alternii fora will be re -positioned in the disturbed

Dear Ms. Dickey:
Reference your application for a Department of the Army (DA) permit to construct a nine
(9) slip community pier with five (5) finger piers and to construct a sanitary sewer line extension
with fill place in wetlands adjacent to the Intracoastal Waterway, in the Windy Hills Subdivision,
south of Wilmington, New Hanover County, North Carolina.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of general permit No. 198000291. Therefore, you may commence construction activity
in strict accordance with applicable State authorization and the enclosed plan. Failure to comply
with the State authorization or conditions of the general permit could result in civil and/or
administrative penalties.
Please be advised that the following are conditions of this DA permit:
1. No portion of the community pier will be located nearer than 80 feet from the near
bottom edge of the Federally maintained Atlantic Intracoastal Waterway. To ensure compliance
with this condition, an as -built survey of the pier will be submitted to the Corps of Engineers
within 30 days of the completion of pier construction.
2. The permittee shall properly record restrictive covenants, approved by the District
Engineer, with the Register of Deeds for New Hanover County, so that they appear in the chain
of title for the described property, prior to the sale or development of any lots within the Windy
Hills subdivision, and within thirty days of the date of this authorization. The permittee shall
provide the Corps of Engineers with a copy of the recorded restrictive covenants as soon as
possible.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified.

COASTAL MANAGEMENT
Reference the application of Southern Lifestyles, LLC for a Department of the Army
permit to construct a nine (9) slip community pier with five (5) finger piers and to construct a
sanitary sewer line extension in wetlands adjacent to the Intracoastal Waterway near Wilmington,
New Hanover County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. The plans depict the revision of the pier's floating
T-head from a width of 8 feet to 6 feet.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or
alter the structural work or obstructions caused thereby, without expense to the United States.
No claim shall be made against the United States on account of any such removal or alteration.
3. If the display of lights and signals on the authorized structure is not otherwise provided
for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed
and maintained by and at the expense of the permittee. The permittee must install and maintain, at
his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations
or otherwise, on authorized facilities.

4. No attempt will be made by the permittee to prevent the full and free use by the public
of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must
not interfere with the public's right to free navigation on all navigable waters of the United States.
5. The permittee will maintain the authorized work in good condition and in conformance
with the terms and conditions of this permit. The permittee is not relieved of this requirement if
he abandons the permitted activity without having it transferred to a third party.
6. No excavated or fill materials will be placed at any time, including temporarily, in any
vegetated wetlands or waters outside the footprint of fill as shown in the permit plans.
7. Preconstruction substrate and wetland bottom contours will be restored and all excess
material will be removed to a high ground retention area immediately following completion of the
wetland portion of the utility crossing.
8. This permit does not authorize any dredging.
9. The permittee shall properly record restrictive covenants, approved by the District
Engineer, with the Register of Deeds for New Hanover County, so that it appears in the chain of
title for the described property, prior to the sale or development of any lots within the Windy Hills
subdivision, and within thirty days of the date of this authorization. The permittee shall provide
the Corps of Engineers with a copy of the recorded restrictive covenants as soon as possible.
