This permit authorizes you to excavate and/or fill in Beaufort County, N. C.
at Pamlico River (N. side at Swan Point development) as requested in your application
dated 10/10/75 & attached plat, no date , subject to the conditions set forth below.
(1)
That the bulkhead must not exceed 5' from the high water mark at any point
along its alignment.
(2)
That all backfill material be obtained from a highland source and confine
behind the permitted bulkhead.
(3)
That no excavated or fill materials be placed at any time in any marshes
waters of the state except as stated in condition #1 of this permit.
(4)
That all fill be stabilized with vegetation to prevent its erosion intoadjacent
rZ
waters.(5)
That the activity be conducted in such a manner as to prevent significantincreases
in turbidity outside of the area of construction or constructionrelated
discharge ( increases of 25 JTU's or less are not considered
significant ).
THIS PERMIT WILL BE VOIDED AND WORK STOPPED IF THE ABOVE CONDITIONS AND THE
PLANS AND SPECIFICATIONS SUBMITTED AS PART OF THE APPLICATION (WHERE NOT IN
CONFLICT WITH THE CONDITIONS) ARE NOT FOLLOWED PRECISELY. PERSONS FOUND
GUILTY OF A VIOLATION UNDER G. S. 113-229 ARE SUBJECT TO A FINE OR IMPRISONMENT,
OR BOTH.
This permit, (as approved with conditions), may be objected to by the applicant or by
interested State agencies within twenty days of the date of issuance by giving written notice to the
issuing office. If the applicant does not submit an objection, this will be interpreted as an agreement of
compliance with all permit conditions.
This permit must be displayed along with a copy of the application and the project map in the
cab (or pilot -house) of the vehicle working on the project, or be easily accessible on site to Department
personnel when the project is inspected.
Notify: Permit Section, Division of Marine Fisheries, Box 27687, Raleigh, North Carolina,
27611 when the project is completed.
Any maintenance work or additional work on the project subsequent to the termination of
this permit requires permit renewal and/or modification.
This permit shall terminate on December 31, 1977

Investigative process - Met with applicant on site September 26, 1975; received
application in Washington Field Office October 10, 1975
Environmental Setting - The project site is located on the north side of Pamlico
River in Swan Point development which is approximately five (5) miles east of Washington.
The applicant's lot is bordered on one side by Pamlico River and on one side by a boat canal
serving the housing development. The river shore has a narrow sandy beach which has been
stabilized with a series (5) of jetties. The canal bank is covered with weeds and is
subjected to moderate erosion. No marsh grasses or submerged vegetation occur on either
shoreline.
The applicant's lot, 250' x 150', has an average elevation of four feet. The area below
the house and boat canal was the site of spoil disposal when the canal was originally dug.
Project description - The applicant proposes to construct a bulkhead 200' long to
stabilize the canal bank and a 50' portion of the river shore. The bulkhead will begin
at applicant's property line in the canal and end adjoining the first jetty nearest the
mouth of the canal. The irregular shoreline requires building the bulkhead slightly
below the normal high water mark in some places. The bulkhead will be back filled with
old spoil material which was deposited on the applicant's lot when the canal was originally
dug.
Environmental impact - The project will destroy no marshgrass or submerged vegetation.
By building the bulkhead below normal high water a small portion of sand bottom will be
filled. Some short term turbidity could occur from the backfilling operation.
