G.S. 113-229) Issued to: Mr. Doward H. Brugh, Bay Dredging & Contracting Corp. P. 0. Box 37, Ocracoke, North Carolina 27960 Permit Class 4th Renewal/Completion This permit authorizes excavation and/or filling in Hyde County, N.C. at Pamlico Sound (at Ocracoke near Cap Point) as requested in the permittee's application dated 10/29/73 & attached plats, 21 dated 10/29/73 subject to the conditions set forth below. (1) That no spoil be placed below MHW or on any marsh. (2) That the diked disposal areas have an adequate spillway. In addition, the disposal area effluent must be contained by pipe, trough, or similar device to a point at or below the MLW line of Pamlico Sound. co (3) That all spoil be adequately contained by dikes or bulkheads. (4) That disturbed land areas resulting from project activities and fill material placed landward of bulkheads be stabalized to restrict its erosion and movement into surrounding waters. Vegetative covers utilized to control erosion should be established within thirty days 1 after parts of the project are progressively completed. NOTE: Bulkheading of the channelized areas is recommended to reduce future maintenance. [see attached sheet for Additional Conditions]. IF THE ABOVE CONDITIONS AND THE PLANS AND SPECIFICATIONS SUBMITTED AS PART OF THE APPLICATION (WHERE NOT IN CONFLICT WITH THE CONDITIONS) ARE NOT FOLLOWED PRE- CISELY, THE PERMITTEE IS SUBJECT TO A FINE, IMPRISONMENT, OR CIVIL ACTION AS PROVID- ED IN G.S. 113-229 (K) AND (L). This permit may IR objected to by the permittee within twenty (20) days of the date of issuance. Failure to submit such objection shall be interpreted as an agreement of compliance with all permit conditions. This permit must be displayed along with a copy of the application and the project plat in the cab (or pilot- house) of the equipment working on the project, or be easily accessible, on site, to Department personnel when the project isinspected. Any maintenance work or project modification requires further Departmental approval. Subject to permit renewal, all work must cease when the permit terminates. A permit from the local health department is required. NOTE: Since more than one acre of land will be involved, an erosion and sedimentation control plan must be filed with the Department of Natural Resources and Community Development, Land Quality Section, 1502 North Market Street, Washington, North Carolina 27889. This plan must be filed at least 30 days prior to the beginning of any land disturbing activities. David A.
