he conditions set forth below.
(1) That no spoil be placed below MRW or on any marsh.
(2) That the diked disposal areas have an adequate spillway. In
addition, the disposal area effluent must be contained by pipe, 1
trough, or similar device to a point at or below the MLW line
of Pamlico Sound.
(3) That all spoil be adequately contained by dikes or {bulkheads.
(4) That disturbed land areas resulting from project activities and
fill material placed landward of bulkheads be stabalized to restrict
its erosion and movement into surrounding waters. Vegetative covers
utilized to control erosion should be established within thirty (30) /
days after parts of the project are progressively completed.
NOTE: Bulkheading of the channelized areas is recommended to reduce future
maintenance.

UTLICATION (WHERE NOT IN CONFLICT WITH THE CONDITIONS) ARE NOT FOLLOWED PRE-
ISFLY, THE PERMITTEE IS SUBJECT TO A FINE, IMPRISONMENT, OR CIVIL ACTION AS PROVID-

Phis permit may tr objected to by the pennittee within twenty (20) days of the date of issuance. Failure
0 gibmit such objection shall be interpreted as an agreement of compliance with all permit conditions.
I his permit must be displayed along with a copy of 1he application and the project plat in the cab (or pilot-
nxnse) of the equipment working on the project, or be easily accessible, on site, to Department personnel
Alien the project is inspected.
1ny maintenance work or project modification requires further Departmental approval. Subject to permit
rnewal, all work must cease when the permit terminates.

NOTE: The soil in this area may not be suitable for septic tank systems.
A permit from the local health department is required.
NOTE: Since more than one acre of land will be involved, an erosion and
sedimentation control plan must be,filed with the Department of Natural
Resources and Community Development., Land Quality Section, 1502 North
Market Street, Washington, North Carolina 27889. This plan must be
filed at least thirty (30) days prior to the beginning of any land
disturbing activities.

The De t has received a request to rnnsa er a renewal
of permi #223-73 hat was issued to Mr. H. Brug of Ocracoke
in Decembe 73. The permit has been r everal times,
and will expire on February 15. The permittee states that he has
been unable to complete the maintenance dredging associated with
the project.
Any comment that you wish to submit on this request should
be forwarded by January 17 in order that action can be taken.
