as requested in the permittee's application dated 10/29/73; including attached
plats, 2, dated 10/29/73 subject to the conditions set forth below
(1) That no spoil be placed bow M1414 or on any marsh.
(2) That Lhe diked disposal areas have nn adequate spillwny, In nddltlon, the
disposal area effluent must be contained by pipe, trough or similar dovlce
to a point at or below the MLW line of Pamlico Sound.
(3) That all spoil be adequately contained by dikes or bulkheads.
(4) That disturbed land areas resulting from project activities and fill material
placed landward of bulkheads be stabalized to restrict its erosion and move-
ment into surrounding waters. Vegetative covers utilized to control erosion
should be established within thirty (30) days after parts of the project are
progressively completed.

TO A FINE, IMPRISONMENT, OR CIVIL ACTION AS PROVIDED IN G. S. 113A-126 AND G. S. 113.229 (K) AND (L).
'['his pennit must be accessible, on site, to Department
Personnel when the project is inspected.
This permit action may be objected to by the pernittee
or other qualified persons within twenty (20) days of the
issuing date. A valid appeal requires resolution prior to work
initiation or continuance, as die case may be. Signing this
I'orm and proceeding with the work binds the applicant
to compliance with all permit conditions.
Any maintenance work or project modification not
covered here under requires further Departmental approval.
All work must cease when tie permit expires.

NOTE: Bulkheading of the channelized areas is recommended to reduce future maintenance.
A permit is required for this action.
NOTE: The soil in this area may not be suitable for septic tank systems. A permit
from the local health department is required.
NOTE: Since more than one acre of land will be involved, an erosion and sedimentation
control plan must be filed with the Department of Natural Resources and Community
Development, Land Quality Section, 1562 North Market Street, Washington, NC 27889.
This plan must be filed at least thirty (30) days prior to the beginning of any
land -disturbing activities.

The Depa n en asked to consider renewal of permit numbe 223-73
issued t Mr. Brugh of Ocracoke in October, 1973 and renewed on five
subsequen The original permit allowed maintenance dredging
of a 700' section of an existing canal and construction of two (2)150'
bulkheads. The bulkheads have been completed but additional maintenance
dredging is necessary. A copy of the fifth renewal is attached for your
review.
Any comments that you wish to submit concerning this renewal request should
be submitted to this office by February 28.
