Box 37, Ocracoke N.C. 27960 authorizing development in Hyde County at Pamt i ro Snund (at- 0 ra okp) as requested in the permi'tee's application dated 10/29/73 including attached plats 2 dated rec. 8/17/82 This permit, issued on September 1. 1982 Is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject perttittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) -The area delineated on the attached plat as "eroded" is deleted from spoil area. Further, no filling of any area below mean high water or no filling of marsh is authorized. (2) Excavation must not exceed —6' mean low water. (3) Only cross hatched canal and channel areas may be excavated. (4) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other re— taining structures to prevent spill —over of solids into any marsh or surrounding waters. (5) The disposal area effluent will be contained by pipe, trough or similar device to a point at or below the mean low water level to prevent gully erosion and unnecessary siltation. (See attached sheet for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on Aubust 31, 1983 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. - Signed by the authority of the Secretary of DNRCD and the Chairman of the Coastal Resources Commission. Brugh ADDITIONAL CONDITIONS Permit No. 233-73 Page 2 of 2 (6) The terminal end of the pipeline will be positioned .at or greater than fifty (50) feet from any part of the dike and a maximum distance from spillways to allow settlement of suspended solids. (7) A water control structure will be installed at the intake end of the effluent pipe to assure compliance with water quality standards. (8) The diked disposal area will be constructed a sufficient distance from the mean high water level or any marsh to eliminate the possibility of dike erosion into or upon any marsh and/or surrounding waters. NOTE: Bulkheading of the channelized areas is recommended to reduce the need of future maintenance. NOTE: The spoil in this area may not be suitable for septic tank systems. A permit is required from the local health department. NOTE: Since more than one acre of land will be involved, an erosion and sedimentation control plan must be filed with the Department of Natural Resources and Community Development, Land Quality section, 1502 North Market Street, Washington, NC 27889. This plan must be filed at least thrity (30) days prior to the beginning of any land disturbing activities. NOTE: The permittee is reminded that any project work after this renewal must be covered by a new application request. August 16, 1982 MEMORANDUM TO: John Parker FROM: Nelson G. I have no objections to renewal of this permit so long as the existing conditions of the permit are retained and the following conditions are added to this permit also: #1. The area delineated on the attached plat as "eroded" area:is deleted from the spoil area. #2. All areas are to be excavated in accordance with the attached plat. #3. C. 27960 Dear Mr. Brugh: This letter is to confirm that on August 11, 1982, Mr. Hugh Heine of the U. S. Army Corps of Engineers and I visited your project site located near Gap Point in Ocracoke in Hyde County. The purpose of my visit was to inspect this site a rt of this officers review pursuant to your request to renew permi 23-73 ated August 2, 1982. During this inspection it was discovered an area measuring approximately 261' long by 30' wide has been eroded behind the existing bulkhead. This eroded area is in the area you have delineated on your maintenance permit as a spoil area. To place fill material in this eroded area is going to require further authorization from this office. The plat currently with your maintenance permit is being amended accordingly. If you have any questions concerning this, please feel free to contact me at my Elizabeth City office.
