Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) All excavated materials will be confined above normal water level and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spill —over of solids into any marsh or surrounding waters. (2) The bulkhead alignment will approximate the normal water level. (3) No marsh grass will be excavated and/or filled. (4) The excavated and back fill material will be properly graded and provided a ground cover sufficient to restrain erosion within thirty (30) days of project completion. (See attached sheet for Additional Conditions) This permit action may be appealed by the pemtittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1985 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. On May 11, 1982 Mrs. Ada Schram came by my office to discuss your recently submitted application for a boat basin off of a canal which is connected to the Pungo River. Mrs. Schram learned of your project through the office's public notice process. During her visit she stated two major concerns that she has with your proposal which are stated as follows: (1) She stated that she is an adjacent property owner and that she was not notified of your project; (2) She stated that a portion of the basin that you are proposing is actually on her property. For this office to continue processing of your application these problems must be resolved. For you to perform excavation on Mrs. Schram's property, you must submit a letter to me from her stating that you have discussed the project with her and that she is giving you permission to excavate the boat basin. If you do not agree with her statement that she owns the property you must submit information to me proving your, ownership. Your application is being placed on hold until this matter is resolved. Project summary The applicant is proposing to enlarge an existing boat basin by excavating into his highground property. The new basin will be + 30' long by + 15' wide by -7' deep NWL. All spoils to be placed on highground. + 175' of bulkhead is to be constructed at the NWL along the canal shoreline and within the basin. Application was received 2/12/82; placed on hold 3/l/82; received again and acknowledged 4/26/82. 9. Narrative description The applicant's property is located within Schrams Beach Subdivision off of the Pungo River. On three sides of the applicant's property are private roads; on the other side is the terminal end of a T-shaped canal which connects to the Pungo River. Existing on the property is a mobile home which is being served by a septic tank sewage disposal system. No wetland vegetation is present on the property which is vegetated by fescue lawn grass and pines. The applicant is proposing to enlarge one side of the T of canal by excavating a + 30' long by + 15' wide by -7' deep NWL basin into his property. The work will be conducted with a backhoe and the spoils will be spread across the lawn. After the excavation is completed the applicant is proposing to place 175' of bulkhead at the NWL along the canal and within the basin. 10. Anticipated impacts If the project is conducted as proposed there should be a minimal impact upon the environment. No wetland vegetation will be excavated or filled. Hughes, Commander and District Engineer, Wilmington District, U.S. Army Corps of Engineers, which provides Federal authorization for "...those construction activities that require and receive authorization from the State of North Carolina in the form of a Coastal Area Management Act (CAMA) permit for major development and/or a permit to excavate and/or fill and/or a Water Quality Certification." A review of your application received 11 February 1982 for a Department of the Army permit to enlarge a boat basin and construct a bulkhead on a canal off the Pungo River near Schrams Beach in Beaufort County, North Carolina, indicates that your proposal is a candidate for Federal authorization under this general permit. Accordingly, the processing of your application will be accomplished by the N.C. Office of Coastal Managemen-E` - n rocess, the N.C. Division of Environmental Management will review your proposal and a determination will be made as to the need for a State Water Quality Certification. Comments from Federal review agencies will be furnished to the State. If there are no unresolved differences of State -Federal positions or policy, the final action taken on your application by the State will satisfy the terms of our general permit. The terms of the general permit will not be satisfied if any of the following situations exist: 1. There is an unresolved objection from any Federal agency. 2. A State Water Quality Certification has not been issued (if required). Section 401 of the Clean Water Act requires that prior to the issuance of any Federal permit that may result in a discharge into waters or wetlands, the State agency responsible for water pollution control (N.C. Division of Environmental Management) must certify that the discharge will not violate applicable Water Quality Standards. SAWCO82-N-007-0145 24 February 1982 3. The proposed work would have a significant effect on the quality of the human environment. The District Engineer will make this determination prior to the conclusion of the State process. 4. There is a significant and substantive unresolved objection from any individual, group, or agency. If your application is withdrawn from this general permit process, you will be so notified and informed of its further management in writing. When your application is successfully processed to conclusion under this general permit, you will receive written notice from the District Engineer. Only after receiving such confirmation should you begin work.
