This permit, issued on APRIL 26. 1995 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) In order to protect juvenile fish and blue crab populations, no excavation may take place between
February 1 and June 30 without prior approval of the Division of Coastal Management, in
consultation with the Division of Marine Fisheries.
2) Prior to the commencement of excavation activities, the diked disposal area and transport barge
will be inspected by a representative of the Division of Coastal Management.
3) Excavation will not exceed 8 feet below the elevation of mean low water (MLW).
4) All excavated materials will be confined landward of the mean high water (MHW) elevation
contour and any regularly or irregularly flooded vegetated wetlands.
5) The temporary placement or double handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
This permit action may be appealed by the pemmittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1998
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

This letter is in reference to your 31 January 1996 request to modify Major CAMA and
Dredge and Fill Permit No. 48-95. Permit No. 48-95 was issued to Mayo Boddie for excavation
of boat slips adjacent an existing pier within Silver Lake on Ocracoke Island in Hyde County,
North Carolina.
Your request to modify the aforementioned permit to allow replacement of existing pier
and mooring piles with longer (35') piles is hereby authorized. All permit conditions, including
the 31 December 1998 expiration date, still apply and remain unchanged. Your modified plat
dated 25 January 1996 illustrating the authorized changes will become a part of your permit and

RE: Amending Cama Major 4 48-95 to include piling replacement
Dear Jeff:
After completing approximately 50% of the dredging allowed under this permit it
has become apparent that the 24 pilings located in the dredged area will not be long
enough to support the existing "T" and associated mooring.
We are requesting to amend existing permit 48-95 to allow the replacement of the
existing 24 pilings with 35 foot pilings located in the exact same location shown on the
attached drawing.

This proposal for excavation of ±500 cubic yards of material around an existing pier in Silver
Lake, Ocracoke Village comes under the auspices of the May 1992 CRC certified Hyde County
Land Use Plan Update. Estuarine Water and Public Trust AECs are involved. The spoil
material will be removed to another site for storage/use.
The Ocracoke portion of the Hyde County Land Use Plan offers the following guidance on
proposals of this type:
By definition (page III -I) all AECs are included in the Conservation land
classification. County position on development within the estuarine system ". .
. will be restricted to those uses which satisfy the more restrictive requirement
of the policies contained in the plan, or the 15A NCAC 7H use standards."
County policy on estuarine waters and public trust areas (page IV-13) include the
idea that use of these two resources which satisfy riparian access needs of private
property owners and provide public benefit to Ocracoke Village shall be allowed.
This policy (and others in the plan) does note the importance of maintaining and
improving water quality in Silver Lake and other water bodies. This policy also
lists water determent uses the county thinks appropriate. "Docks and piers as
allowed by the policies of the plan" is listed as an allowed use, but the policy
(nor others) does not specifically address dredging.
As no more restrictive policy on dredging within AECs is noted in the plan, and no specific
guidance on dredging is noted, my opinion is if this proposal can be accomplished within 7H
use and performance standards, it would not be inconsistent with the county's conservation land
classification nor the spirit of county policy for estuarine waters and public trust areas.

The proposed project appears to be consistent with the rules found in Subchapter 7H concerning
dredging activities in Estuarine Waters and Public Trust Areas. There should be no impact to the area
of coastal wetlands adjacent the high ground as they are not in close proximity to the proposed area to
be excavated. I recommend issuance of the permit with the following conditions:
Standard Conditions
1. Excavation will not exceed 8 feet below normal water level.
2. No marsh grass will be excavated and/or filled.
3. The temporary placement or double handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
4. No excavated or fill material will be placed at any time in any marsh or surrounding waters
outside of the alignment of the fill area indicated on the work plats.
5. All excavated materials will be confined above mean high water and landward of regularly, or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spill over
of solids into any marsh or surrounding waters.
6. The diked disposal area will be constructed a sufficient distance from the mean high water level
or any marsh to eliminate the possibility of dike erosion into or upon any marsh and/or
surrounding waters.
Additional Conditions
1. Prior to the commencement of excavation activities, the diked disposal area and transport barge
will be inspected by a representative of the Division of Coastal Management.
NOTE:) Prior to any construction activities, the applicant is requested to arrange for a
preconstruction conference to discuss conditions of the permitted activity.

Project setting
The project site is located adjacent SR 1328 on Ocracoke Island on the south side of
Silver Lake, off the Pamlico Sound, in Hyde County, North Carolina.
The area to be excavated (0.12 acre) averages ±4' below the normal water level (NWL).
A fringe of Coastal Wetlands, consisting of Spartina alterniflora, Spartina patens and Juncus
roemerianus, borders the high ground property of Mr. Boddie, but is not in close proximity to
the proposed project. The high ground portion of the Boddie property is vegetated by Bermuda
grass, red cedars and live oaks. There is an existing pier with a "T" head and 4 existing slips
that extends ±260' seaward of the bulkhead bordering the high ground property.
There are other piers constructed on neighboring properties surrounding Silver Lake.
Some of these piers were constructed prior to CAMA, while others were permitted by the
Division.
Silver Lake is an Estuarine Water classified as SC waters by the Environmental
Management Commission. Silver Lake is not designated as a Primary Nursery Area. Although
shellfish (oysters, clams and mussels) inhabit Silver Lake, the lake is closed to harvest.
Project description
Mr. Mayo Boddie, Jr. proposes to excavate an average depth of 2.5' of material in an
area ±80' x ±65' for a total of ±500 cubic yards. The excavation area is located at the
waterward end of the existing ±260' wooden pier. The material to be excavated is coarse sand.
The purpose of this proposed excavation is to provide better deep water access in the area of the
existing 4 slips associated with the existing pier. In addition, this proposal will establish a
consistent ±8' water depth around the existing slips and connection to waters of equal or deeper
depth in Silver Lake. The excavation will be conducted using a dragline and placing the
excavated material within a silt screen on a barge . The material will then be transported to,
and off loaded into a ±90' x ±50' diked disposal area on high ground property owned Mr.
Monroe Gaskill. Mr. Gaskill's property is located ±250' north of the project site.
Anticipated impacts
The project proposed will result in the disturbance of ±5,200 ftz of sound bottom. The
excavation activities associated with this project will result in short term, localized turbidity.
The associated spoils are to be off loaded onto high ground.

I have enclosed for your review a revised CAMA Major
Application for Mayo Boddie, Jr, including the
additional information and changes we discussed at
your site visit October 18th.
We are requesting a permit to dredge around the end of
the existing dock to provide access to the existing four
boat sups as shown on the attached drawing. The sand
would be excavated using a dragline placing the material
on a barge lifted with silt cloth.• Monroe Gaskill has
granted us permission to use his existing dock and
adjacent high ground property located approximately
250' North of the dredge site to off load and use as
a spoil area, (drawing attached).
If you have any additional information or changes that
are necessary, please let me know as soon as possible.

In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront(riparian)landowners. These
individuals have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management and should be advised by the applicant of
that opportunity.

9 CERTIFICATION AND PERMISSION

allow only the development described in the application.
The project will be subject to conditions and restrictions
contained in the permit.
I certify that to the best of my knowledge, the proposed
activity complies with the State of North Carolina's ap-
proved Coastal Management Program and will be con-
ducted in a manner consistent with such program.
I further certify that I am authorized to grant, and do in
fact, grant permission to representatives of state and
federal review agencies to enter on the aforementioned
lands in connection with evaluating information related
to this permit application and follow-up monitoring of
