This permit may Ir objected to by the permittee within twenty (20) days of the date of issuance. Failure
to submit such objection shall be interpreted as an agreement of compliance with all permit conditions.
This permit must be displayed along with a copy of the application and the project plat in the cab (or pilot-
house) of the equipment working on the project, or be easily accessible, on site, to Department personnel
when the project isinspected.
Any maintenance work or project modification requires further Departmental approval. Subject to permit
renewal, all work must vase when the permit terminates.

Location - Hyde, County - Far Creek at Engelhard, adjacent to Big Trout Marina.
Investigative process - Site investigated 8-25-77. App. rec. Raleigh 9-1-77; Morehead
9-2-77.
Environmental setting - The overall project site consists of a 20 acre tract lying
between US 264 and Far Creek at Engelhard. The specific site is. located immediately
east of Big Trout Marina. The area is vegetated by relatively homogeneous stand of
pine trees on the highland portion of the property. Adjacent to the shoreline, the
area is vegetated by a narrow border of grasses, dominated by salt meadow grass (Spar-
tina patens). Interspersed through the patens, are marsh elder (Iva frutescens), and
a few other woody species. Configuration of the property border adjacent to the
creek is irregular with two bay -type indentations present which appear to be caused
largely by erosive action created by the wakes of passing vessels. The proposed pro-
ject site is unique in that the federally maintained channel lies within a few feet
of the shoreline.
Project description - The applicant proposes to excavate an area along the shore front
measuring approximately 400' long by 20' wide to a depth of 12', or the same as the
existing adjacent channel. The purpose of this excavation is to provide vessel ac-
cess and docking facilities for a proposed seafood processing plant. In addition to
the excavation, the 400' area fronting the channel will be bulkheaded and a dock will
be constructed for use by fishing vessels. Approximately 2400 cu.yds. of excavated
material will be deposited on the high ground adjacent to the project site.
Environmental impact - The proposed bulkhead will arrest an on -going erosion problem.
It is expected that some short term turbidity will be created during construction. A
very small amount of marsh grass will be excavated as a result of this project. No
marsh grass will be filled. A proposed seafood processing plant will utilize con-
ventional septic tanks for sewage disposal.

for you to provide additional information. Such request comes from the
Division of Health Services, one of the several State agencies reviewing
each proposal under the dredge and fill law. That office requires more
information on the expected volume and constituency of wastewater from
your facility. This information will be required before final action can
be taken on your proposal. Should other agencies complete their respec-
tive reviews on your project prior to receiving this requested information
your file will then be placed in abeyance under Department of Natural
Resources and Community Development, Division of Marine Fisheries Regulation
3D .0106.
If any question arises on this matter, do not hesitate to contact
this office. Upon receipt of the requested information, same will be
forwarded immediately to the Division of Health Services in order that
processing may continue.

To llhom These Matters Concern:
The lard upon which Southern Shores Seafood, Inc. proposed put their business and
for which they obtained permits to build a dock and bulkhead and to dredge was
purchased from me. The only reason I sold this land was to see it developed as a
seafood processing area. At the time I sold the property I did not think it
practical for me to attempt the development.
Southern Shores Seafood, Inc. went bankrupt before they had started work developing
this area. They did obtain permits from both the State and Federal people for the
work.
I now have the property back in fee simple( copy of deed attached hereto)and intend
to develop the land under the above mentioned permits.
With the interest of everyone concerned in mind I am respectfully requesting a revision
in the original permits. I would like to string the bulkhead inDmd a sufficient
distance to allow for all boats being tied up at the docks to be a safe distance
from the channel. This move would also pint the bulkhead, dock and other buildings
on more solid ground and provide for more stability.
The development of this area for, seafood processing is planned in steps or phases.
It would be appreciated if this revision could be given prompt_ consideration. It is
hoped that the initial phase can be completed prior to the 1979 off —shore fishing
season which usually begins in the middle of October.
The maps herewith show both the initial stage and the future development plans.
Should there be any questions concerning this revision please let me know.

Sampling by the Division of Marine Fisheries indicates that Far Creek is a highly
productive primary nursery area for brown shrimp. The Division has concerns about the
proposal to excavate the shallow open water mud flats in the creek to a -12, water
MLW so that adequate water depth will be available to moor commercial fishing boats.

PUBLIC NOTICE
MR. RUSSELL THOMAS BLANCHARD, P ox 176, Engelhard, North Carolina 27824, has applied for a modification to `t
7-N-048-123-0642 previously issued to the now defunct Southern Shores Seafood
Inc. The original permit authorized EXCAVAT SIN, CONSTRUCTION AND BACKFILL OF A BULKHEAD AND
CONSTRUCTION OF A DOCK ON FAR CREEK AT ENGELHAR H de County North Carolina. The proposed modification involves
ENLARGEMENT OF THE BASIN AND REALIGNMENT OF THE BU OCK.
The following description of the proposed work is taken from data submitted by the applicant and from onsite
inspection by a representative of the Corps of Engineers. Plans submitted with the application show realignment
of the proposed bulkhead up to 90 feet farther inland than originally permitted. The area waterward of the
proposed bulkhead is to be excavated to a depth of 12 feet mean low water (MLW) to create a larger turning and
mooring area for commercial fishing vessels outside the Federally -maintained channel. Approximately 21,860 cubic
yards of sand, shell, and clay are to be excavated by dragline to create the basin with the excavated materials to
be used during road construction on the property. A portion of the proposed basin is to extend 100 feet inland
along the southwestern property line. This portion of the proposed excavation will facilitate access to planned
packing facilities on site as well as connecting a proposed future canal to Far Creek. This connection will not
be possible by dragline after currently proposed facilities are in place. Approximately 490 linear feet of
bulkhead is to be constructed along the perimeter of the excavated basin areas. This bulkhead is to be capped by
a dock 20 feet wide. Future plans for the property, primarily access canals along both property lines, are shown
on current plans but are not under active consideration for permits at this time. Pursuit of required permits for
those aspects of the attached plans are dependent upon successful operation of the currently proposed facilities.
The purpose of this work is to create a seafood processing center. Plans showing the proposed work are included
with this public notice.
The applicant has determined that this proposal is consistent with the NC Coastal Zone Management Plan and has
submitted this determination to the NC Office of Coastal Management for their review and concurrence. The
proposal shall also be reviewed for the applicability of other actions by North Carolina agencies such as:
a. The issuance of a Water Quality Certification under Section 401 of the Clean Water Act by the NC
Division of Environmental Management.
b. The issuance of a Permit to Dredge and/or Fill under NC General Statute 113-229 by the NC Division of
Marine Fisheries.
C. The issuance of a permit under the NC Coastal Area Management Act (CAMA) by the NC Office of Coastal
Management or their delegates.
d. The issuance of an easement to fill or otherwise occupy State-owned submerged land under NC General
Statute 143-341(4), 146-6, 146-11, and 146-12 by the NC Department of Administration and the NC Council of State.
The requested Department of the Army permit will be denied if any required State or local authorization and/or
certification is denied. No Department of the Army permit will be issued until a State coordinated viewpoint is
received and reviewed by this agency. Recipients of this notice are encouraged to furnish comments on factors of
concern represented by the above agencies directly to the respective agency with a copy furnished to the Corps of
Engineers.
Approval of this permit will give Federal authorization for maintenance dredging for a period not to exceed
10 years from the date of permit issuance. Applicant will be required to present plans for maintenance to the
District Engineer a minimum of 2 weeks prior to commencement of work. All maintenance would be performed in
accordance with Federal, State and local permits and regulations governing such activities at the time the
maintenance is undertaken.
The District Engineer has made a preliminary determination that an Environmental Impact Statement under
Section 102(2)(c) of the National Environmental Policy Act of 1969 is not required. This determination will be
reviewed considering facts submitted in response to this public notice.
This application is being considered pursuant to Section 10 of the River and Harbor Act of 1899 (33 U.S.C. 403)
The District Engineer has consulted the latest published version of the National Register of Historic Places for
the presence or absence of registered properties, or properties listed as being eligible for inclusion therein,
and this worksite is not included as registered property or property listed as being eligible for inclusion in the
Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the
District Engineer, and he is otherwise unaware of the presence of such resources. Presently unknown
archaeological, scientific, prehistorical, or historical data may be lost or destroyed by work to be accomplished
under the requested permit.
The District Engineer has determined, based on a review of data furnished by the applicant and onsite
observations, that the proposed activity will not affect species, or their critical habitat, designated as
endangered or threatened pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of the probable impact of the proposed
activity on the public interest. That decision will reflect the national concern for both protection and
utilization of important resources. The benefit which reasonably may be expected to accrue from the proposal must
be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will
be considered; among those are conservation, economics, esthetics, general environmental concerns, historic
values, fish and wildlife values, flood damage prevention, land use, navigation, recreation, water supply, water
quality, energy needs, safety, food production, and in general, the needs and welfare of the people. No permit
will be granted unless its issuance is found to be in the public interest.
