MGT, authorizing development in Hyde Co. at Far Creek as requested in the pernittee's application dated 6/26/79; including attached revised plats, sheets 1-4 of 4 dated 12/17/79 subject to the conditions set forth below (1) That in order to protect juvenile shrimp populations, no excavation or filling will be permitted between the dates of April 1 through September 30 of any year without the prior approval of the Division of Marine Fisheries. (2) That no excavated or fill material be placed at any time in any marsh or waters of the state outside of the alignment of the fill area in- dicated on the plat. (3) That in order to protect water quality, runoff from the construction area must not visibly increase the amount of suspended sediments in adjacent waters. i NOTE: Enforcement personnel will determine an increase as significant if the measured level of suspended sediments is increased by 25 Jackson Turbidity Units. [ See the attached sheet for Additional Conditions l IF THE ABOVE CONDITIONS AND THE PLANS AND SPECIFICATIONS SUBMITTED AS PART OF THE APPLICATION (WHERE NOT IN CONFLICT WITH THE CONDITIONS) ARE NOT FOLLOWED PRECISELY, THE PERMITTEE IS SUBJECT TO A FINE, IMPRISONMENT, OR CIVIL ACTION AS PROVIDED IN G. S. 113A-126 AND G. S. 113.229 (K) AND (L). This permit must be accessible, on site, to Department personnel when the project is inspected. This permit action may be objected to by the permittee or other qualified persons within twenty (20) days of the issuing date. A valid appeal requires resolution prior to work initiation or continuance, as the case may be. Signing this form and proceeding with the work binds the applicant to compliance with all permit conditions. Any maintenance work or project modification not covered here under requires further Departmental approval. All work must cease when the permit expires. NOTE: Since more than one acre of land will be disturbed, this project will require an erosion and sedimentation control plan. F; Far Creek ��,�j ' Hyde County Enclosed is a copy of a letter in this office from Mr. RUSS4fi ich was received on 17 December 1979. Mr. Blanchard indicates he again wants to modify his permit by moving the proposed bulkhead further landward. As you recall, permit #5-78 was modified for the first time approximately two weeks ago. This office has no objection to the proposed modification. Dear Mr, Brown: fief: SAWC079-N-048-000281 In accordance with our telephone discussion of December 13th concerning a further motification of my present permits, enclosed is a modified drawing showing changes that Z_feel would enhance t his endeavor for all parties concerned. As stated to you by me in Wilmington on November 20th, my contractor, by his error of scale, started the underground part of construction of this reinforced concrete bulkhead at a distance farther landward from Day Marker #10 than was authorized by my permits. As soon as this was discovered by me I suspended work and contacted you. Thid led to our meeting on the 20th in Wilming- ton and your gratiously arranging for provisions for a modification that I felt would salvage part of this work by aligning a new concrete bulkhead with the present bulkhead in a manner to utilize the old bulkhead as parts of buildings foundations behind the'new bulkhead. Since receiving this new modification we have made extensive tests in the alignment area that the new bulkhead would be placed, and we are convinced that X, reinforced concrete could not be poured successfully in this soil. If we continued work here our only alternative would be use of wood piling insted of reinforced concrete. This, in our minds, would be much more costly and much less lasting and desirable. With this proposed change as shown on attached drawing we would be ablea3sl3� to resume construction, using the concrete bulkhead that is now in place above the water level and below ground level. It is constructed in such a way that we are very pleased with it's apparent strength and durability. Everyone that has seen what we now have in place have been favorably impressed. I am convinced this placement would add considerably to the value of the completed �rojedt and would be more favorable for future planned expansion. This modification would in no way affect any changes in restrictions in our current permits, we expect to abide by them completely. Contractors' equipmenr,,are on site and waiting to rehsume work if permitted with a�imely modificagon.,My'decision to proceed with wood bulkhead as now author' ed;)proceed.ing with this -requested modification if granted, or?.belaying work indefinitely or perman- nently.
