This permit, issued on November 21, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation it these terms may be subject to tines, imprisonment or civil action; or may cause the permit to oe nutt ana vora. Upland Development within Fresh Pond AEC 1) This permit authorizes only the proposed upland development, as depicted in the attached permit application, project narrative, and workplan drawings. Any development proposed in an Area of Environmental Concern (AEC), including but not limited to the Fresh Pond AEC and located within the applicant's property, may require additional authorization from the Division of Coastal Management prior to work commencing. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department, personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Division of Energy, Mineral and Land Resources, Land Quality Section, 943 Washington Square Mall, Washington, NC 27889. 3) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 4) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. Stormwater Management 5) The Division of Energy, Mineral and Land Resources (DEMLR) has determined this project will require a Stormwater Management permit. The permittee shall receive a Stormwater Management permit from DEMLR prior to the initiation of any construction. Submit this plan to the Division of Energy, Mineral and Land Resources, Land Quality Section, 943 Washington Square Mall, Washington, NC 27889. Any violation of the permit approved by DEMLR shall be considered a violation of this CAMA permit. General 6) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 7) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers has determined the project is not located within USACE jurisdiction. NOTE: The N.C. Division of Water Resources has assigned the project DWR Project No. 2022-1337. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The project areas are located at 2110 S. Pond Ave., 2200 S. Lark Ave., 2208 S. Lark Ave., and 0 S. Lark Ave. in Nags Head, Dare County, and are adjacent to the Fresh Pond Reservoir and a man-made stormwater basin. The development proposed will involve the Fresh Pond AEC. I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project, and my findings are as follows: 15A NCAC 07H .0405 SMALL SURFACE WATER SUPPLY WATERSHEDS (c) Designated Small Surface Water Supply Watersheds. The CRC has designated the following small surface water supply watersheds and developed detailed standards as set out in this Paragraph: (1) The fresh pond between Kill Devil Hills and Nags Head on Bodie Island and adjacent catchment area. The Department of Environment, Health, and Natural Resources proposed the fresh water lake on Bodie Island in Dare County as an area of environmental concern. (A) Both the towns of Nags Head and Kill Devil Hills have water treatment plants which take their raw water from the fresh water lake located between the two towns on Bodie Island. The lake is approximately one quarter mile west of the U.S. 158 bypass. This fresh water lake is supplied by groundwater from the surrounding landmass and rainfall. In addition, Kill Devil Hills is the site of the Wright Brothers Memorial, a national monument. As a major tourist attraction this area draws people from across the east coast. Contamination of the water supply could, therefore, have an effect not only on other areas of the state but the east coast as well. (C) To adequately protect the fresh pond, it is necessary that construction of septic tanks and other sources of pollution within the limits of the cone of depression be regulated as follows: (i) Within 500 feet, horizontal distance of the edge of the pond, no construction of sewers, septic tanks nitrification fields or other possible sources of pollution shall be permitted. (ii) Between the distances of 500 feet and 1200 feet from the edge of the pond, construction of septic tank systems shall be limited to one single septic tank system serving a single family residence not to exceed four bedrooms or its equivalent volume of sewage, on a lot or tract of land not less than 40,000 square feet. Consistent: The proposal meets the intent of these rules. Two new septic systems are proposed outside of the 500-foot FP AEC. These systems are rated at 480 gallons capacity per day, which is equivalent to a four bedroom, single- family residence system, and are located on separate parcels that exceed 40,000 sf. Overview: The 11 acre project area consists of four (4) properties: 2110 South Pond Avenue, 2200 South Lark Avenue, 2208 South Lark Avenue, and Parcel #027934001 located on the east side of Lark Avenue across from the properties at 2200 and 2208. The property at 2110 South Pond Avenue has approximately 545 linear feet of shoreline along the Fresh Pond Small Surface Water Supply Watershed Area of Environmental Concern (AEC) with the remaining .properties falling within the 500 foot and 1,200 foot designated cone of depression of the Fresh Pond. Site elevations are approximately 11 feet above Normal Water Level (NWL). The project area is vegetated with trees and indigenous grasses. According to the application, water has not been consumed out of the Fresh Pond for many years, however it is still present as a reservoir for emergency situations. The project area is outside of a Floodzone. The Town's public works facility is located in the project area. The shoreline is unimproved with no erosion noted. Redevelopment of the public works facility to include demolition of existing improvements and installation of five (5) buildings, two (2) fuel pumps, a vehicle wash down area, sidewalks, gravel and paved parking and storage areas, permeable paver parking, driveways, fencing, stormwater improvements, and two (2) septic systems with associated septic fields and repair areas is proposed. The water tower and two (2) on -site septic systems will remain. A sewer force main will connect to the existing septic tank at 2110 South Pond Avenue and a proposed pump station. The Coastal Resources Commission's rules for the Fresh Pond AEC regulate the construction of septic tanks and other sources of pollution within the limits of the cone of depression, a distance of 500 feet and between 500 feet and 1,200 feet from the edge of the pond. Specific to septic tanks and other potential sources of pollution, the fuel pumps, vehicle washdown area and two (2) septic systems will be located between 500 feet and 1,200 feet from the edge of the pond. Both septic systems will have 480 gallons of capacity, a septic field with four (4) lines at 48 linear feet and a 5,000 sq. ft. repair area. The septic systems will be at 2208 South Lark Avenue and Parcel #027934001. The waters of the Fresh Pond are classified as WS-111 and CA waters. There are no know archaeological sites associated with the project area. A review of historic resources was not provided. Anticipated Impacts resulting from this project are expected to include: the coverage of 1.93 acres within 500 feet of the Fresh Pond Area of Environmental Concern (AEC) and 2.15 acres between 500 feet and 1,200 feet of the Fresh Pond AEC, and; the disturbance of 1.12 acre within 1,200 feet of the Fresh Pond AEC. The proposal will not involve direct discharge to the Fresh Pond. PROJECT SUMMARY: The applicant proposes the redevelopment of the Public Works Facility, which will involve the demolition of buildings, and improvements to include new buildings for administration, fleet maintenance and storage, water distribution, equipment storage, parking/driveways, washdown areas, two new separate septic systems, fuel aboveground storage tanks (AST), recycling and bulkhead storage areas. Proiect Settino The project locations are at 2110 S. Pond Ave., 2200 S. Lark Ave., 2208 S. Lark Ave., 0 S. Lark Ave., in Nags Head, Dare County, and is adjacent to the Fresh Pond (FP) Reservoir and a man-made stormwater basin that is partially owned by the Town of Nags Head and 222 Satterfield Landing LLC. The size of the tracts equates to t11 acres, and the length of the FP shoreline is ±545'. The elevation of the tracts equates to t11' above normal water level (NWL), and there was no shoreline erosion noted onsite. The existing man-made structures include buildings for the water department, publics works facilities maintenance and office, water storage tanks, driveways and parking, two on -site septic systems, underground utilities, fueling facility and washdown area(s). No Coastal or 404 wetlands are present in the project area(s), and the vegetation onsite includes Loblolly pine (Pinus taeda), Live oak (Quercus virginiana), Wax myrtle (Myrica cerifera), and indigenous grasses. There is no known permit history or archaeologic sites associated with these properties; however, Major Permit history in the FP AEC includes 109-23 Ocean Commerce Business Park, 144-05 Harris Teeter, and 149-11 Satterfield Landing (PetSmart). The riparian property to the north is developed with the Town of Kill Devil Hills Public Works Facility, and the riparian property to the south is a warehouse storage facility. A scoping meeting was held on 07/06/22 to discuss the redevelopment of the Town's Public Works Facility. In addition to Town of Nags Head staff, other representatives present included Brian Rubino and Mike Strader of Quible and Associates, Maria Dunn-WRC, Carl Dunn-Stormwater, Robert Tankard, Robbie Bullock and Allen Steward-DWR, Samir Dumpor and Randall Jones-DEMLR, Jamie Midgette-Public Water Supply, and Kim Hamby - Timmons Group. The waters of the Fresh Water Lake at Kill Devil Hills (FP AEC) are in the Pasquotank River Basin, and classified as WS-111 and CA. However, it was confirmed that since the proposal would not involve direct discharges to the FP, the redevelopment site would not be considered a critical area. It was also confirmed that water has not been consumed out of the FP for many years. Lark Avenue and S. Pond Avenue in Nags Head. This project will involve the demolition of buildings and infrastructure, to include the removal of pipe(s), dry hydrant and bollard, retaining wall, fencing, gravel, fuel tank, concrete, fleet maintenance and storage building and associated pads, outfall pad, parking, curb and gutter, and shed. Two existing septic systems will remain in place (at 2110 S. Pond Avenue and 2200 S. Lark Ave.), and a Tie (sewer) forcemain will connect to the existing septic tank on 2110 S. Pond Avenue and a proposed pump station adjacent the proposed Water Distribution building. Improvements proposed within the 500' FP setback: • 2110 S. Pond Avenue - a 4,852 sf Water Distribution building with a fenced storage area, sidewalks, new gravel parking, and one drop inlet. • 2200 S. Lark Avenue - a 2,000 sf Equipment building, 6,964 sf of covered parking, concrete pavement, a gravel area for bulk storage and access leading to an existing water tower on 2208 S. Lark Avenue. • 2208 S. Lark Avenue - t3,OOO sf of the Facilities & Sanitation (Fleet Maintenance building) with concrete pavement. Improvements proposed outside of the 500' FP setback: • 2200 S. Lark Avenue - two fuel pumps east of the Nags Head Equipment building, permeable pavers (interlocking) for parking, concrete drives and vehicle washdown area with one drop inlet and a frost -proof yard hydrant. • 2208 S. The subject property (Site) includes four legal parcels of land totaling approximately 11.02 acres (see attached vicinity map/aerial photo). Lark Ave.) This is an existing Public Works Facility that includes water storage tanks, roads, parking and staging areas, maintenance and storage buildings, offices, recycling facility, underground and above ground utilities, on -site septic treatment systems, above ground fuel storage and dispensers, vehicle washdown areas, etc. The Site is adjacent to what is known as the "Fresh Pond" which is a surface water reservoir on the Nags Head -Kill Devil Hills border. The Fresh Pond has a designated CAMA Area of Environmental Concern (AEC) as described in 15A NCAC 07H .0405(c) (see attached regs). Water has not been consumed out of the Fresh Pond for many years, however, it is still present as a reservoir for emergency situations. As described in the CAMA regs, there is a 500 ft and 1,200 ft AEC line as measured from the edge of the Fresh Pond. Other than the Fresh Pond, this Site is an upland property, with average ground elevation between 10 and 12 ft ASL. Any new project done within the Fresh Pond AEC requires a CAMA Permit. Most projects that we have been involved with in the Fresh Pond AEC have been permitted through a CAMA Minor, but there at least three that Quible has worked on over the years that have required a CAMA Major due to the need for other State and/or Federal Permits. For reference, those projects included: • CAMA Major 109-13; Ocean Commerce Business Park ■ CAMA Major 144-05; Harris Teeter • CAMA Major 149-11; Satterfield Landing (Petsmart) The CAMA regulations are specific to septic systems and prohibit any new systems to be permitted within the 500 ft AEC and new treatment systems (between the 500 It and 1,200 ft AEC) cannot exceed an effluent flow capacity of a 4-bedroom residential system (480 gallons per day). Furthermore, there can be only one septic system per parcel that must be at least 40,000 sq.ft. For this project, the two existing systems which function properly and have been maintained over the years will remain. Two new systems (480 gallons per day capacity) are being proposed to accommodate this re -development project. These systems will be between the 500 ft and 1,200 AEC and are on separate parcels that exceed 40,000 sq.ft. There are no known State Stormwater Permits issued to the Town for this Site, however, there is an existing State SW Permit that affects Lot C on the west side of Lark Ave. That Permit was for Petsmart in Satterfield Landing since the wet basin that extends onto Lot C is also on the Satterfield Landing Property (Permit # SW7111109). As part of this project, we will likely be proposing a modification to that permit for any stormwater that will utilize the existing BMP in addition to a new permit. Timmons and Quible are working jointly on the Stormwater planning and we will have an engineer from Timmons and Quible to participate in the Scoping Meeting, especially to address Stormwater Management concepts with DEMLR. Septic: I have attached an exhibit that highlights the existing septic and proposed new septic systems. No new system will be waterward of the 500' AEC and the 2 new systems will be on separate parcels over 40,000 sf. These new systems will be the equivalent of 4 bedroom home septic systems (treatment of up to 480 gpd). The two existing systems will remain as they are and will not be expanded. LUP Review: The Town Engineer and Planning Director have reviewed the plan in relation to the approved CAMA LUP. Please see attached email related to this which is intended to be a consistency statement. Please let me know if you need anything further on this. Stormwater: I have included Carl on this email since Kim Hamby, P.E. from Timmons Group has coordinated with Carl related to stormwater rules and permitting further after the meeting. Kim informed us that it was determined that the water body (Fresh Pond) is classified as WS-III. Since the project would not involve any direct discharges to the Fresh Pond, the re- development site is not a "critical area" and stormwater collection is allowed (and this will be non -discharge). Kim is working on a low density SW plan for the west side of Lark Ave and Mike Strader, P.E. here at Quible is working on a mod to the existing high density permit for the property on the east side of Lark. Our plan is to put together all State Permit application packages before the end of the month. Please let me know if there are any outstanding issues that need to be addressed.
