This permit, issued on JUNE 17, 1994 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Excavation
1) Excavation in Tarklin Creek as depicted on sheet 2 of 4 at cross section Cl-C2 to provide an
access channel is hereby deleted. Excavation will not extend beyond a line approximating the
drainage ditch/Creek interface. (See also Condition No. 3, below).
2) In order to avoid periods of high biological activity, no work will be performed between the
dates of March 1 and September 30 of any year without the prior approval of the N. C. Division
of Coastal Management.
3) No work will be conducted at the site until a pre -construction meeting is held between the
permittee, contractor, and a representative of the Division of Coastal Management.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires furtherDepartmental approval.
All work must cease when the permit expires on
December 31 1997
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
4) The proposed boat basin will not have a depth exceeding 3 feet at normal water level.
5) The temporary placement or double -handling of excavated or fill materials within waters or
vegetated wetland is not authorized. Fill of vegetated wetland is not authorized.
6) All excavated materials will be confined landward of the normal water elevation contour and any
vegetated wetlands.
Bulkheadine
7) The bulkhead alignment will approximate the normal water level at the time of construction.
8) The bulkhead must be constructed prior to any backfilling activities.
9) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through
the structure.
10) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles
or other suitable materials approved by department personnel. No excavation is permitted,
except for that which may be required for the construction of the bulkhead wall, riprap, deadmen
cables, etc. This permit does not authorize any excavation waterward of the approved
alignment.
11) The fill material will be clean and free of any pollutants, except in trace quantities. Metal
products, organic materials, or unsightly debris will not be used. .
Riprap
12) The riprap will not extend waterward more than 3 feet from the normal water level at any point
along its alignment at the time of its construction.
13) The riprap material must be free from loose dirt or any other pollutant. It must be of a size
sufficient to prevent its movement from the site by wave or current action.
14) The riprap material must consist of clean rock or masonry materials such as, but not limited to,
granite or broken concrete.
15) The proposed riprap will not be placed higher than the elevation of the adjacent marsh.

16) The created wetland area must be completed prior to the beginning of any other portion of the
project. The area must be approved by a representative of the Division of Coastal Management.
Pier and Boathouse
17) The pier and associated structures shall have a minimum setback of 15 feet between any parts
of the structure and the adjacent property lines as extended perpendicular to the channel at the
points where they intersect the shoreline.
18) The alignment of the proposed pier will be staked by the applicant and approved by a
representative of the Division of Coastal Management prior to construction.
19) The boathouse shall not be completely enclosed or have side coverage more than one half the
height of the side, from the roof waterward.
General
20) This permit authorizes only the docks, piers, and other structures and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other
structures; whether floating or stationary, may become a permanent part of the docking facility
without permit modification. No non -water dependent uses of structures may be conducted on,
in, or over public trust waters without permit modification.
21) No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
22) The permittee will maintain the authorized work in good condition and in conformance with the
terms and conditions of this permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without having the permit transferred to a third parry.
23) The authorized structure and associated activity will not cause an unacceptable interference with
navigation.
24) All project activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 25 NTUs or less are not considered significant.

ADDITIONAL CONDITIONs
25) A permanent ground cover sufficient to restrain erosion will be provided on all exposed areas
within the shorter of 30 working or 120 calendar days after project completion.
26) Appropriate erosion and sedimentation control devices, measures, or structures will be used to
prevent sediment from entering the adjacent wetlands/watercourses/property (e.g., silt fence,
diversion swales/berms, sand ':fence, etc.).
NOTE: The Division of Environmental Mangement authorized the project under General Water
Quality Certification No. 2665 on May 12, 1994.

As you are aware, the North Carolina Division of Coastal Management has received from
Mr. Hill an application for a CAMA Major Development Permit and a Dredge and Fill Permit
to perform various development activities on his property adjacent to Battalina Creek near the
Town of Belhaven in Beaufort County, North Carolina.
A portion of Mr. Hill's proposal involves the excavation of a access channel from
Battalina Creek through an area of Distichlis s ica (42' by 10' or approximately 420 sq. ft.)
to highground where a boatbasin and boathouse is to be placed. As can be seen from Mr. Hill's
proposal, he is proposing to relocate the Distichlis Vicata, which is growing within the area to
be excavated, into a newly created area adjacent to the existing marsh. Although his proposal
may not be consistent with the literal interruption of the management objective and use standards
for coastal wetlands, I think it is consistent with the intent; and the proposal to maintain the
status quo (square footage) is acceptable.
The portion of Mr. Hill's proposal that does, in my opinion, conflict with NCAC 7H
guidelines is his proposal to excavate a 45' long by 15' wide access channel in Battalina Creek,
which is classified as a Primary Nursery Area by the North Carolina Division of Marine
Fisheries. The area to be excavated has an average depth of f2' at normal water and the
proposal is to excavate it to a depth of -Y at normal water to provide needed water depth to
reach the proposed boatbasin. The basin is also proposed to be excavated to a depth of -Y at
normal water.
A review of NCAC 7H.0206(d), Estuarine Waters, Use Standards, states in part; .. .
"In every instance the particular location, use, and design characteristics shall be in accord with
the general use standards for coastal wetlands, estuarine waters, and public trust areas described
in Rule .0208 of this Section." Referring to .0208(b)(1) Specific Use Standards, it states in part
that; "Navigation channels, canals, and boat basins must be aligned or located so as to avoid
primary nursery areas . . . " As previously stated, Mr. Hill is proposing to excavate an area 45'
long by 15' wide in Battalina Creek which is classified as a primary nursery area, therefore his
proposal is inconsistent with .0208(b)(1).

As you are aware, the application for permits that Mr. Hill has submitted also includes
a 106' long pier which extends into Battalina Creek. To resolve the inconsistency as previously
stated, I recommend that Mr. Hill consider the feasibility of placing the proposed boathouse on
the pier thus eliminate the excavation within Battalina Creek. I also recommend that if Mr. Hill
determines that this approach is unsuccessful, then his application for permits be denied based
on G.S. 113A-120(a)(8) which states; "That a application for permits be denied if in any case,
that the development is inconsistent with the state guidelines, or the local land use plans."

SUBJECT: Ted R. Hill Application for Boathouse, Pier, Riprap and Mooring Facility,
Battalina Creek, Beaufort County, North Carolina
This proposal that is noted above is in Belhaven and thus comes under the auspices of the March
1993 CRC certified Land Use Plan Update. The proposal involves public trust and coastal
wetland AECs.
The following limited guidance is in the plan as follows:
Town policy on development within AEC's (page 26-27) is to support and comply with
applicable AEC standards.
No specific policy on economic development or similar issues is noted.
By definition, public trust AEC's and coastal wetland AEC's are considered in the conservation
land class (page 55-56). That class, among other items, specifies uses including "... water
oriented uses such as docks, piers, mooring pilings ... if shown not to cause a detriment to the
AEC..."
The landward part of this proposal appears to be in the urban transition class. That class (page
54-55) acknowledges urban type uses with the provision of services necessary to support those
uses.
My opinion is if this proposal can be accomplished within AEC use and performance standards,
it would not be inconsistent with town policy for the conservation land class.

8. PROJECT SUMMARY: The applicant is proposing to develop a private boat mooring facility with
boathouse, pier and to stabilize his shoreline with riprap.

The applicant owns a 3.1 acre tract of land adjacent to Battalina Creek, off of SR 1708,
within .the Town of Belhaven's Zoning jurisdictional area, in Beauforf County. Located on the
lot is a single family dwelling which is served by a septic tank sewage disposal system. Potable
water is supplied by an individual well located on the property. The majority of the property
has an elevation of t5' above the NWL and it is vegetated with various lawn grasses. Adjacent
to Battalina Creek, there is a fringe of coastal wetlands (marsh) located along the entire width
,of the property. The marsh which is vegetated predominately by Distichli Vic , and Iuncus
roemerianus varies from 42' to 160' in width. Located along the applicant's western property
line is a t5' wide ditch which connects to Battalina Creek and which serves as a route for
upland drainage. Battalina Creek is classified as a primary nursery area by the Division of
Marine Fisheries. Waters depth in the creek vary from P to 5' at normal water.
The applicant is proposing the following:
(1) To excavate a boating access channel from Battalina Creek into his property along
the western property line. An area 45' long by 15' wide will be excavated in the
creek to a depth of -T at normal water. Also, a 128' long by 15' wide access
channel will be excavated into the property. This channel will also be excavated
to a depth of -T at normal water.. At the landward end of this canal, the
applicant is proposing to construct a boathouse which will be discussed later. As
described in the submitted narrative, a portion of the channel (10' by 42') will be
excavated within Distichlis spiok marsh. The remainder of the channel will be
excavated within the existing drainage ditch or highground. All spoils will be
placed on highground as shown on the attached plat labeled 2 of 4.
(2) The construction of a 16' wide by 30' long open sided boathouse at the landward
end of the proposed access channel.
(3) The construction of 71' of wooden bulkhead across the land end of the boat basin
an along the eastern side to the point where it intersects with the proposed
retaining wall.
(4) The construction of a 86' retaining wall along the landward side of the wetland
area to be created. See plat 2 of 4. On the waterward side of the retaining wall,
the applicant is proposing to create a wetland area which is to be substituted for
the area of marsh to be excavated. The proposal is to relocate the Distichli
ij= which is growing within the excavated area into the newly created area.
v The emergent marsh along with 6" of sod will be relocated to the same elevation
of adjacent marsh. See cross-section plant EI-E1 on plat 4 of 4 for details. When
completed, a 5' wide 86' long fringe of created Distichlis VI= will be located
along the landward side of the existing marsh.
-- - • --_ (5) The placement of riprap along 154' of shoreline within Battalina Creek waterward
of the existing marsh. The riprap will average 3' beyond the NWL and will be
- _ placed no higher than the adjacent marsh.
(6) The construction of a 105' long by 6' wide pier which will extend from
highground into Battalina Creek. The pier will extend 30' into the creek and will
have a 10' by 16' T-section at the waterward end. The pier will be positioned
as shown on plat 2 of 4.
Environmental imps
. The following environmental impacts will occur:
(1) ±675 sq. ft. of open water area will be excavated in Battalina Creek which is
classified as a primary nursery area by the Division of Marine Fisheries.
(2) ±420 sq. ft. of Distichlis W&M marsh will be excavated.
(3) ±430 sq. ft. of Distichlis spicatamarsh will be transplanted to substitute for the
area to be excavated.
(4) The placement of the riprap along the shoreline should help retard ongoing
erosion of the marsh adjacent to Battalina Creek. ±462 sq. ft. of open water
area will be filled as a result of the riprap placement.
(5) Some short term turbidity will occur in Battalma Creek as a result of the
excavation and the pier placement.

8 ADDITIONAL INFORMATION
In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
theproject.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
W x 11 white paper. (Refer to Coastal Resources
Commission Rule 710203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is apart
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management and should be advised by the applicant of
that opportunity.
A list of previous state or federal permits issued for
work on the project tract .Include permit numbers, --- -_
penmittee, and issuing dates.

Health, Environment & Natural Resources to cover the
costs of processing the application.
A signed AEC hazard notice for projects in oceanfront
and inlet areas.
A statement on the use of public funds. If the project
involves the expenditure of public funds, attach a state-
ment documenting compliance with the North Carolina
Environmental Policy Act (N.C.G.S. 11 3A-1 to 10).
9 CERTIFICATION AND PERMISSION
TO ENTER ON LAND
Any permit issued in response to this application will
allow only the development described in the application.
The project will be subject to conditions and restrictions
contained in the permit _
I certify that to the best of my knowledge, the proposed
activity complies with the State of North Carolina's ap-
proved Coastal Management Program and will be con-
ducted in a manner consistent with such program.
I further certify that I am authorized to grant, and do in
fact, grant permission to representatives of state and
federal review agencies to enter on the aforementioned
lands in connection with evaluating information related
to this permit application and follow-up monitoring of
project.
