Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) Bulkhead construction and pier replacement will be conducted in accordance with the permit plans. (2) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction - related discharge. NOTE: Any new development on the permittee's property may require a modification to this permit. Any new development not identified in the original sediment/ erosion control plan must also be outlined in the form of an amendment to the original plan. All temporary and permanent sediment/erosion control measures, devices, and structures to be utilized during site development must be identified in any amendment to the original sediment/erosion control plan. NOTE: The proposed project is certified under General Water Quality Certification No. 1272 isued on November 10, 1978 for bulkhead construction. NOTE: In keeping with the provisions of GS 146-6(c) the State Property Office of the Department of Administration has granted authorization to fill State-owned submerged lands as described in this permit. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1988 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Project summary The applicant is developing Bavview Townhomes on a 2.47 acre tract at Bayview. Development will consist of the construction of eight units new bulkhead and renovated pier. Environmental setting The applicant owns a 2.47 acre tract of land at Bayview at the site of the old Bayview Hotel, on the Pamlico River. The property has an elevation of + 7.0 feet above the NWL, and is bulkheaded. Located on the property is a + 430.00' long pier which is deteriorated. At the present time eight townhome units are under construction on the property. These units will be served by one septic tank per four units, and each tank will be 2000 gallons. No wetland vegetation is present at the project site. Project proposal The applicant is proposing the following: (1) Upon completion of the townhome units, final landscaping is proposed within the 75' Estuarine Shoreline Area of Environmental Concern. The area will be properly sloped and seeded. (2) The construction of a new bulkhead 339.38' in length to replace the existing deteriorated bulkhead. The new bulkhead will be placed 2' waterward of the existing bulkhead. (3) The repair of the existing pier to its present length and width. The project consists of 2 each buildings placed on wood piles composed of 4 individual townhouse dwelling units in each building. All drives and parking areas indicated will be gravel. Site work will include removal of existing trees at the building, drives, and,sewage nitrification fields only. The heavily brushed area between the building and the bulkhead will be selectively cleared with a large majority of existing growth to remain. We made a sincere effort to locate the buildings at a 75 foot set back from the bulkhead, but failed to realize that the jog at the east end of the bulkhead would effect the required set back. As we are sure you have noticed, the building has been redesigned and will fall outside the 75 foot set back. We hope the above information will clarify our intentions on this project.
