Permit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Vertnit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Permit Number 127-22 Issued to Sumit Gupta and David & Cynthia Tonnesen 1314 S. Croatan Hwy #301, Kill Devil Hills, NC 27948 Authorizing development in Dare County at adi. to Currituck Sound, at 104 and 108 Mill Point Rd., in Martins Point as requested in the permittee's application dated 7/26/22 (MP- 1,2) and 6/16/22 (MP-4), including attached work Ian drawings (3) Sheets 1-3 of 3 all dated "rev 7/26/22". This permit, issued on November 21, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to oe nuu ana voia. Excavation 1) In order to protect juvenile shrimp and fmfish populations, no excavation or filling shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. 2) No excavation shall take place outside of the area indicated on the workplan drawings. 3)- Excavation shall not exceed -4.5 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on November 21, 2027 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Samit Gupta and David & Cynthia Tonnesen Permit No. 127-22 Page 2 of 4 ADDITIONAL CONDITIONS 4) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 5) No excavated or. fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing(s). 6) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 7) During all authorized excavation events, the permittee shall implement all available precautions to ensure that damage to SAV beds outside the authorized template does not occur. Should dredging outside the authorized template be proposed in the future, the permittee is further advised that the Rules of the Coastal Resources Commission prohibit new dredging within SAV beds. Dredge Material Disposal 8) No dredge material shall be placed within 30 feet of the normal water line. 9) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the site is graded and stabilized. 10) The dredge material disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. Maintenance Clause 11) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for dredge material disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the dredge material disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. Samit Gupta and David & Cynthia Tonnesen Permit No. 127-22 Page 3 of 4 ADDITIONAL CONDITIONS Docking Facility Expansion 12) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 13) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharged at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 14) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 15) This permit authorizes three (3) additional formalized boat slips for a maximum of four (4) formalized boat slips at this docking facility. 16) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. 17) The roof of the covered platform shall not be designed for second story use. 18) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 19) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. Groin Repair 20) This permit authorizes only the repair of the existing non -conforming groins within the previously existing footprint. No portion of the replaced non -conforming groins shall be located outside of the previously existing groin footprint. 21) The non -conforming structure shall not be enlarged beyond the existing dimensions. 22) The sheetpile groins shall be constructed of treated wood, plastic lumber, metal or vinyl sheet piles or other suitable materials approved by Department personnel. NOTE: This sheetpile groin repair were permitted under the rule of 15A NCAC 07J .0211 for Non - Conforming Development. Samit Gupta and David & Cynthia Tonnesen Permit No. 127-22 Page 4 of 4 ADDITIONAL CONDITIONS Sedimentation and Erosion Control 23) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 24) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 25) If a court of competent jurisdiction determines that a party other than the permittees have legal title to any part of the area approved for development under this permit, this permit shall be null and void as to the area the court determines is not owned by the permittee. This condition shall take effect on the date such court judgment becomes final. In such event, the permittee shall consult DCM prior to initiating or continuing any further development under this permit. 26) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 27) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 28) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2022-0285). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of Individual Water Quality Certification No. 005358 and assigned the project DWR Project No. 2002-0817 v2. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. Dredging the entrance and basin will allow boating access for the two property owners into the Curriluck Sound. c. The proposed dredge area is estimated to be a 380'x60' area within the basin and a 25'x10' area within the existing boat house, connecting to a depth of 4.5 ft below NWL in the Currituck Sound. The total amount of spoils to be excavated is estimated at ± 1,550 yd3 and the spoil area is located in the southeast corner of the Tonnesen's property. In addition to the dredging, Applicant Sumit Gupta is proposing the construction of a docking facility consisting of a 30'x6' pier, 16'x6' lower platform, 16'x16' roofed platform (dripline dimensions), 12'xl6' boat lift, and two 12'x6' jet ski platforms to be placed on the southern portion of the property and within the man -mad basin. Lastly, the property owners are proposing the repair of two existing wooden jetties (64'xl' & 85'xl') at the entrance to the basin. The repairs will include the replacement of damaged sheeting, broken walers, and pilings as needed. The site of the proposed development is primarily located at 108 Mill Point Road (Gupta property), Lot 1 within Section 5 of the Martin's Point subdivision. However, the adjacent property of 104 Mill Point Road (Tonnesen property), Lot 30 within Section 2 contains the location of the proposed dredge spoil site. Both properties are located within the Martin's Point Subdivision, Dare County and are adjacent to a man-made basin and the Currituck Sound. The development proposal involves the Public Trust Area (PTA) & Estuarine Waters (EW) Areas of Environmental Concern (AEC's). Consistent: The applicants are proposing the maintenance dredging in an existing man-made basin and to construct a private docking facility consisting of a pier, platforms, and boat lift. This sub -paragraph considers these structures and uses as water dependent. Paragraph (a)(2)(A) states that the location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds of submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas. Consistent: The proposed development is designed to not interfere with shellfish beds and/or spawning and nursery areas. The location is not classified as a Primary or Secondary Nursery Area and is closed to shellfish taking. A submerged aquatic vegetation (SAV) survey was conducted and although the presence of SAV was found, the dredge area is within a man-made basin and in an area with a history of permitted past dredging. Paragraph (a)(2) (B) states that development shall comply with state and federal water and air quality standards. Consistent: The proposed development will not violate water and air quality. Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural Resources. Consistent: There are no known archeological or historical resources on the property. Paragraph (a)(2)(D) states that development shall not increase siltation. Consistent: The water bottom is sandy, and it does not appear that the development will measurably increase siltation. 1 would recommend the use of a turbidity curtain across the entrance channel. Paragraph (a)(2)(E) states that development shall not create stagnant water bodies. Consistent- It does not appear that the development will create stagnant water bodies. Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent: The developmentwill have minimum adverse effects on the life cycles of estuarine resources. Consistent: The development proposes minimal effects on navigation. Paragraph (b) addresses Specific Use Standards. Of these, subparagraphs (1) Navigation Channels, Canals, and Boat Basins and (6) Piers and Docking Facilities, pertain to this project, and those subparagraphs not listed are not applicable to this project. Paragraph (b)(1)(A) states navigation channels and canals may be allowed through fringes of regularly and irregularly flooded coastal wetlands if the loss of wetlands will have no significant adverse impacts on fishery resources, water quality or adjacent wetlands, and if there is no reasonable alternative that would avoid the wetland losses. Consistent: The dredging will be conducted within an existing man-made basin and no coastal wetlands were found within the proposed dredge area or associated spoil area. Paragraph (b)(1)(B) states all dredged material shall be confined landward of regularly and irregularly flooded coastal wetlands and stabilized to prevent entry of sediments into the adjacent water bodies or coastal wetlands. Consistent: The dredged material will be placed in a 92x150' spoil area located t 65' or greater distance away from wetlands or adjacent water bodies. A silt fence should be used around the spoil area. Paragraph (b)(1)(C) states dredged material from maintenance of channels and canals through irregularly flooded wetlands shall be placed on non -wetland areas, remnant spoil piles, or disposed of by a method having no significant, long-term wetland impacts. Under no circumstances shall dredged material be placed on regularly flooded wetlands. New dredged material disposal areas shall not be located in the buffer area as outlined in 15A NCAC 07H .0209(d)(10). Consistent: No coastal wetlands were found, and the spoil area has been designated in a high ground outside the coastal shorelines 30' buffer. Paragraph (b)(1)(D) states widths of excavated canals and channels shall be the minimum required to meet the applicant's needs but not impair water circulation. Consistent: The width of the proposed dredge area should not impair water circulation. Paragraph (b)(1)(E) states boat basin design shall maximize water exchange by having the widest possible opening and the shortest practical entrance canal. Depths of boat basins shall decrease from the waterward end inland. Consistent: No changes to the existing size of the man-made basin and boathouse are being proposed at this time. Proposed depths of the man-made basin and boat house are consistent with the intent of this rule. Consistent: None of the proposed dredge depths are greater than -4.5' below normal water level or the connecting depth. Paragraph (b)(1)(G) states construction of finger canal systems are not allowed. Canals shall be either straight or meandering with no right-angle corners. Consistent: No finger canals are being proposed and the existing size/shape of basin and entrance channel will be unchanged. The entrance channel is straight, and the basin contains no right-angle corners. Paragraph (b)(1)(H) states canals shall be designed so as not to create an erosion hazard to adjoining property. Design may include shoreline stabilization, vegetative stabilization, or setbacks based on soil characteristics. Consistent: No changes to the size and shape of the existing basin and channel are being proposed. Existing shoreline stabilization methods on these and adjoining properties already include wood and vinyl bulkheads, and rip rap revetments. Paragraph (b)(1)(1) states maintenance excavation in canals, channels and boat basins within primary nursery areas and areas of submerged aquatic vegetation as defined by the MFC shall be avoided. However, when essential to maintain a traditional and established use, maintenance excavation may be approved if the applicant meets all of the following criteria: (i) The applicant demonstrates and documents that a water -dependent need exists for the excavation Consistent: The man-made basin was opened to the Currituck Sound in the late 1980's and has served as a boat basin for the two properties since that time which is water dependent. (ii) There exists a previously permitted channel that was constructed or maintained under permits issued by the State or Federal government. If a natural channel was in use, or if a human -made channel was constructed before permitting was necessary, there shall be evidence that the channel was continuously used for a specific purpose. Consistent: The man-made basin was created and has been maintained through a series of permits including major and general permits issued by the Division of Coastal Management from 1990 to 2014. (iii) Excavated material can be removed and placed in a disposal area in accordance with Part (b)(1)(B) of this Rule without impacting adjacent nursery areas and submerged aquatic vegetation as defined by the MFC. Consistent: Submerged aquatic vegetation was found to exist within the proposed dredge area. However, this man-made basin has a history of previously dredging. Consistent: The depth and width of the man-made entrance channel will not be increased or expanded. Paragraph (b)(6)(A) states that piers shall not exceed six feet in width. Consistent: The proposed pier is 6 feet in width. Paragraph (b)(6)(B) states that the total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. Consistent: The shoreline of the property is t 390 feet in length allowing for the maximum allowance of shading. The proposed platforms, covered area, and boat lift will shade 688 ft2. There is an existing boat house on the property contributing an additional 200 ftz. Therefore, the total area of applicable shading impacts for the property are 888 W. Paragraph (b)(6)(C) states piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking. Consistent: The docking facility development will not impact any wetlands. Paragraph (b)(6)(D) states a boathouse shall not exceed 400 square feet except to accommodate a documented need for a larger boathouse and shall have sides extending no farther than one-half the height of the walls and covering only the top half of the walls. Measurements of square footage shall be taken of the greatest exterior dimensions. Boathouses shall not be allowed on lots with less than 75 linear feet of shoreline. Consistent: No new boathouse is being proposed with this development and no changes are being made to the existing 25'x15' boat house. Paragraph (b)(6)(E) states the total area enclosed by an individual boat lift shall not exceed 400 square feet except to accommodate a documented need for a larger boat lift. Consistent: The boat lift being propose is 12'x16' or 192 ftz. No boat lift is being proposed for the existing boat house. Paragraph (b)(6)(F) states piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow for second story use. Consistent: The proposed roofed area is open with no walls or second story use. Paragraph (b)(6)(G) states piers and docking facility length shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shorelir�for D similar use. (ii) not extending into the channel portion of the water body. Consistent: The proposed docking facility will not be extended into the channel portion of the water body. (iii) not extending more than one-fourth the width of a natural water body, or human -made canal or basin. Potentially Inconsistent: The estimated width of the man-made basin at the project location is estimated to be t 175 feet. The proposed docking facility, with a total length of 58', is beyond one-fourth the width of the basin. However, the proposed docking facility is located entirely within the property boundaries of the applicant's property within a basin which was formally a pond dug in high ground area. The pond became open to the Currituck Sound in the late 1980's. Paragraph (b)(6)(H) states piers or docking facilities longer than 400 feet shall be permitted only if the proposed length gives access to deeper water at a rate of 1 foot each 100 foot increments of length longer than 400 feet. Consistent: The proposed docking facility is 58 feet in length and less than 400 feet. Paragraph (b)(6)(1) states piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's area of riparian access. Consistent: The proposed docking facility is located 26' north of the southern property line and will not encroach within the 15' setback. Paragraph (b)(6)0) states applicants for authorization to construct a pier or docking facility shall provide notice of the permit application to the owner of any part of a shellfish franchise or lease over which the proposed dock or pier would extend. The applicant shall allow the lease holder the opportunity to mark a navigation route from the pier to the edge of the lease. DATE: October 20, 2022 Consistency Determination: The request is consistent with/not in conflict with the Dare County 2009 Land Use Plan certified by the CRC on February 24, 2011. Overview: The subject properties include the 1.09 acre lot at 108 Mill Point Road (Gupta) and the adjacent 1.69 acre lot at 104 Mill Point Road (Tonnesen), which have a combined shoreline of 1,005 linear feet along a man-made basin and the Currituck Sound. The basin is approximately 175 feet wide and 330 feet long with water depths that range from .5 feet to 4.2 feet below Normal Water Level (NWL). Submerged Aquatic Vegetation (SAV) is documented in the basin entrance channel as sparse vegetation and within the basin in dense patches at depths of 2 feet or greater. Site elevations average 5 feet above NWL in the highground areas. The properties are vegetated primarily with shrubs and lawn grasses, with approximately 1,675 sq. ft. of Section 404 wetlands located on the Tonnesen property. The subject properties contain AE(4) Floodzone with Shaded X in the lot interiors. Existing site improvements include a single-family house with attached garage, decks, a pool with concrete surround and cement/gravel driveway on the Gupta property. Similar improvements along with a pool house are under construction on the Tonnesen property. The jetties are located on either side of the basin entrance channel and need repair. The man-made basin was originally an enclosed pond that was opened to the Currituck Sound for boat access in the late 1980's. CAMA Major Permit (MP#29-90) was issued to a previous owner for the jetties, bulkhead, and other shoreline stabilization in and around the basin and the access channel. Later owners of the Gupta property were issued CAMA General Permits in 2014 for maintenance dredging in the channel and basin, in 2015 for construction of the house, pool, driveway and decks, and in 2016 for construction of the boathouse with lift. The Tonnesen house is currently under construction as approved through CAMA Minor #2022-04. CAMA General Permits were issued to previous owners for various lengths of bulkhead on the Tonnesen property in 2000, 2008 and 2009. Maintenance dredging of a 60 foot wide by 380 foot long area at the basin entrance channel and within the basin and a 10 foot wide by 25 foot long area at the boat house to a connecting depth of 4.5 feet below NWL, placement of spoils in a 92 foot by 150 foot area, installation of a 6 foot wide by 30 foot long pier with a 6 foot wide by 16 foot long lower platform, a 16 foot by 16 foot roofed platform, a 12 foot by 16 foot boat lift and two (2) 6 foot wide by 12 foot long jet ski platforms, and repair of two (2) jetties are proposed. Dredging and installation will occur on the Gupta property and spoils will be placed on the Tonnesen property. The spoil placement site will be at least 85 feet from the shoreline. Once dried, the spoil will be used as fill material on the Tonnesen property. Including the existing boat house slip, a total of four (4) designated slips will be provided. The waters of the Currituck Sound are designated as Class SC waters and Joint Waters and are closed to shellfish taking. The Currituck Sound is approximately 3 miles wide at the project area. Neither property has been determined to hold archaeological significance. Anticipated Impacts resulting from this project are expected to include: the shading of 868 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC); the dredging of .53 acre of Public Trust Area/Estuarine Waters AEC, and; the filling of .32 acre of Highground outside of an AEC. Basis for Determination: The Dare County Land Classification Map identifies the subject property as "Community Residential". As indicated on Page 217, the "Conservation" designation applies to all CAMA Areas of Environmental Concern (AECs) and all federal lands except for the bombing ranges on the Mainland and some state - owned lands in Frisco and Buxton. As indicated on Page 214 for the "Community Residential" designation, "(t)he Community Residential classification is used to identify areas predominantly developed with low density residential dwellings." As indicated on Page 217 for the "Conservation" designation, "...development should be limited to residential development and traditional accessory uses permitted in the CAMA AECs such as but not limited to piers, docks, and'crab - shedders." RAWLS Director A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has reviewed the permit application for proposed actions that may impact fish and/or fish habitats. The proposed work is located at 104 and 108 Mill Point Road in the Martins Point subdivision, within Dare County. The applicant is proposing to conduct maintenance dredging, construction of a pier, gazebo, platform, boat lift, and two jet ski lifts. The applicant is also proposing to repair the existing wooden groins at the entrance to the basin. This location has a permitted history of prior dredging. Submerged aquatic vegetation (SAV) was observed within the project area. The waters of this location are classified as SC, are not designated habitat areas, and are not open to shellfishing. The proposed maintenance dredging would involve removing approximately 1,550 cubic yards (CY) of material within the existing basin and entrance to the basin, bringing depths to 4.5 feet below the normal water line (NWL). Dredged material will be placed in the southeast portion of one of the properties to be reused as fill. In addition to dredging, the applicant is proposing construction of a docking facility consisting of a 30' by 6' pier, 16' by 16' lower platform, 16' by 16' roofed platform, 12' by 16' boat lift, and two 12' by 6' jet ski platforms. Finally, the applicant is proposing to repair two existing wooden jetties at the basin entrance. The proposed repairs include replacement of damaged sheeting, broken walers, and pilings as needed. Taking into consideration the scope of the proposed work, DMF would recommend that any permit issued include a 1 April through 30 September moratorium on any in -water work associated with the project. Incorporation of this moratorium will help to minimize the potential for this project to impact resources within the project area as well as the immediate surrounding area. Because SAV has been observed at this location, DMF would also encourage the applicant to utilize building materials and/or designs that allow for increased light penetration (in comparison to standard building materials). Using materials and designs that allow light penetration to the water may provide better chance for impacted SAV to recover or allow SAV to spread after construction is completed. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 3. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 4. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 5. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. In order to protect juvenile finfish resources, no excavation or filling activities will be permitted between the dates of April 1 and September 30 of any year without the prior approval of the North Carolina Division of Coastal Management and the U.S. Army Corps of Engineers. 8. All excavated materials will be confined landward of the mean high water level elevation contour within adequate dikes or other retaining structures to prevent spillover of dredged materials into any vegetated wetlands or surrounding waters. 9. Excavation will not exceed -4.5 feet below the elevation of mean low water. 10. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 11. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 12. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Field Investigation Report Page 3 Proiect Settin The majority of the proposed development is located at 108 Mill Point Road (Gupta property), Lot 1 within Section 5 of the Martin's Point subdivision. However, the adjacent property of 104 Mill Point Road (Tonnesen property), Lot 30 within Section 2 contains the location of the proposed dredge spoil site. Both properties are located within the Martin's Point Subdivision, Dare County. The properties are located on the northwestern tip of a peninsula that stretches between the Currituck Sound and Jean Guite Creek. Directly adjacent to the two properties is a man-made basin that opens to the Currituck Sound and is t 175 ft in width and t 330 ft in length. The property of Sumit Gupta is platted at t 47,500 ft2 (t1.09 acres) and contains t 390 ft of shoreline. The adjacent property, owned by the co -applicants David & Cynthia Tonnesen, is platted at t 74,000 ft2 (t 1.69 acres) and contains t 615 ft of shoreline. Elevation averages t 5 ft above Normal Water Level (NWL) in the high ground areas. Man-made features within the properties include multi -level, single family residences with attached garages, decks of varying sizes, pools with concrete surrounds, and cemented/gravel driveways. The Tonnesen's house is currently under construction (CAMA Minor #2022-04). The properties are primarily vegetated with landscaped shrubs and domestic lawn grasses. The applicant (Sumit Gupta) is in the process of purchasing the property at 108 Mill Point Road from current owners John & Caroline Baughman. The Baughmans were issued CAMA GP #66032A in 2014 for maintenance dredging within the basin & channel, CAMA Minor#2015-13 in 2015 for the construction of the current home, pool, driveway, and decks, and CAMA GP #66032A in 2016 for the construction of a boat house and lift in an existing basin. The existing man-made basin was originally a fully enclosed pond that was opened to the Currituck Sound for boat access in the late 1980's. A major permit was issued to previous owner David Watson (MP#29-90) for the jetties, bulkhead, and other shoreline stabilization measures in and around the man-made pond and access channel. The Tonnesens purchased the property at 104 Mill Point Road in 2019 and were recently issued CAMA Minor Permit #2022-04 in 2022 for the construction of a single-family dwelling, pool, concrete driveway and attached garage. Other permitting history for this parcel includes GPs #12721A in 2000 to Larry Putz, and #50573A in 2008 and #53273A reissued in 2009 to Martin Miller. All were for various lengths of bulkheading. Neither property has been determined to hold any archeological significance. The shorelines of both properties are hardened and contain man-made features including wood & vinyl bulkheads, two wooden jetties (64 ft & 85 ft in length), and a rip rap revetment (175'x25'). Other features include a 25'x15' boat house on 108 Mill Point Road. There is a section on the northern side of the Tonnsen's property that has an area of designated 404 Wetlands containing Phragmites sp. and three -square rush (Scirpus sp.). The wetlands were delineated by Atlantic Environmental Consultants, LLC on June 13, 2022, and are estimated to be 1,675 ft2 in size. The wetlands are located outside of the project area, so no official determination was made by the US Army Corp of Engineers (USACE). The shorelines of adjacent properties are hardened with bulkhead and rip rap revetments. Adjacent properties are also developed including single-family residences with associated structures and a docking facility to the south. The waters of the Currituck Sound are joint waters, classified as SC, and are closed to shellfish taking. It is t 3 miles across the Currituck Sound to the opposite shoreline (Powells Point, NC). The bottom substrate is sandy and water depths within the man-made basin range from t0.5 ft to t4.2 ft below NWL. The location is not classified as a Primary or Sggp"_WED ;1 1, ..-7 1:' v Field Investigation Report Page 3 Nursery Area by the Division of Marine Fisheries. A submerged aquatic vegetation survey (SAV) survey was conducted within the man-made basin and entrance channel by Atlantic Environmental Consultants, LLC. The presence of SAV was documented in the entrance as three sparsely vegetated areas and within the basin in dense patches at depths of 2 ft or greater. The majority of the SAV species are Eelgrass and Eurasian Milfoil. Development Proposal The applicants are proposing to mechanically dredge a portion of the man-made basin, entrance channel, and existing boat house for the purpose of maintaining boating egress, ingress, and navigation within the basin. The proposed dredge area includes the basin entrance channel between the two existing jetties and follows the basin's eastern shoreline, stopping at the Tonnesen's property line to the south. The proposed dredge area is slightly irregular in shape and is estimated to be 380'x60' with a connecting depth in the Currituck Sound of 4.5' below NWL. The proposed dredge area also includes an existing boat house for an additional 25'x10' of water bottom. There is a documented presence of SAV in the dredge area, and the area does have a permitted history of prior dredging. The spoils will be placed in the southeast portion of the Tonnesen's property in a 92'x150' (13,800 ft2 capacity) area temporarily set aside for that purpose. The total amount of spoils to be excavated is estimated at t 1,550 yd3. Once dried the spoils will be used on the Tonnesen's property as fill material. In addition to the dredging, applicant Sumit Gupta is proposing the construction of a docking facility consisting of a 30'x6' pier, 16'x6' lower platform,16'x16' roofed platform (dripline dimensions), 12'x16' boat lift, and two 12'x6' jet ski platforms to be placed on the southern portion of the property and within the man-made basin. There will be a total of four designated slips including the three being proposed and the existing boat house. Following the proposed dredging, water depths within the proposed location will range from t 1.5 ft to t 4.5 ft below NWL. The proposed docking facility is similar to others in the area and does extend beyond the % width of the man-made basin. The docking facility will not encroach within either of the 15' riparian access setbacks and is t 1,050 ft away from the nearest adjacent docking facility to the south. Lastly, the property owners are proposing the repair of two existing wooden jetties at the entrance to the basin and in the Currituck Sound. The existing jetties are 64'x1' and 85'x1' and the repairs will include the replacement of damaged sheeting, broken waters, and pilings as needed. The footprint of the existing jetties will not be expanded, and the current location will not change. Anticipated Imoacts The dredging of the basin, entrance channel, and boathouse will result in t 23,050 ft2 of shallow water bottom disturbance. The dredging of the basin will result in the removal of t 1,550 yd3 of sandy material within the Public Trust Area and Estuarine Water AEC. The associated spoil disposal area will result in 13,800 ft2 of high ground disturbance located at 104 Mill Point Road (Tonnesen's property). The vertical wood groins and rock breakwater were constructed to protect the shoreline and entrance from erosion. The basin and entrance were most recently dredged in 2014 under General Permit GPA64894 to dredge up to 1,000 cubic yards. The property located at 108 Mill Point Road is a developed property currently owned by John and Caroline Baughman and is under contract to purchase by Sumit Gupta. The existing improvements on the property include a house, pool, boat house, rock breakwater, vinyl bulkhead, and 2 vertical wood groins at the entrance of the manmade basin. The property located at 104 Mill Point Road is being developed with a single family residence that was permitted through a CAMA Minor Development Permit 2022-04. Existing improvements prior to the construction of the house include a wood bulkhead along the Currituck Sound and basin. PROJECT DETAILS: The proposed work associated with this CAMA Major permit application includes the maintenance dredging (1,550 cu.yds.) of the basin and entrance to a depth of -4.5 feet, construction a 30' pier with a 16'x16' gazebo, a 6'x16' lower level kayak platform, one large boat lift and two small floating jet ski lifts. In addition, the applicants would like to repair the existing wood groins at the entrance to the basin. The wood groin repairs will include replacing damaged sheathing, broken whalers and pilings as needed. The Tenneson's are not proposing any structures at this time and are only involved for a dredge spoil location. The dredge spoil location is shown on sheet 1 in the attached site plans. SUBMERGED AQUATIC VEGETATION (SAV) ANALYSIS: Atlantic Environmental Consultants (AEC) evaluated the project area for the presence of submerged aquatic vegetation (SAV) within the entire basin and entrance.
