This permit, issued on January 13, 1984 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) All excavated materials must be placed and retained on adjacent high ground. (2) The spoil material must be provided a vegetative ground cover within thirty working days. (3) The activity must be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction —related discharge. NOTE: A Section 401 Water Quality Certification is not required for this project. This permit action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Project summary The applicant is proposing to excavate off of Garrett Gut, a 100' long by 40' wide by -3' deep NVM boat basin. The facility will be for private use. Environmental settin The applicant owns 2.122 acres adjacent to Garrett Gut, a manmade ditch, which leads to North Creek. The property is mostly agricultural lands with a wooded border next to the canal. The border is vegetated mostly with sweetgums, pines, myrtles, common reed, various vines and sparse Spartina cynosuroides. Located on the property is a new mobile home and septic tank; some limited landscaping also has occurred. Project proposal: The applicant is proposing at this time to excavate a private boat basin and connect it to Garrett Gut. The basin will be 100' long by 40' wide and -3' deep at normal water. All spoils will be placed on highground around the newly placed mobile home to assist landscaping. Excess spoils will be placed on the agricultural land. 879 cubic yards to be excavated. Environmental impact: The project as proposed should have a minimal environmental impact. Less than 100 sq.ft. of Spartina cynosuroides will be excavated and no wetlands will be filled. Some short term turbidity will exist during project activity. David L.
