This permit, issued on 6 - a 9— 9 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.
2) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, may become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures may be conducted on, in or over public
trust waters without permit modification.

This pennit_action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31.2001
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
3) No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
4) The authorized structure and associated activity must not cause an unacceptable interference with
navigation.
NOTE: Permanent reflectors should be attached to the structure in order to make it more visible
during hours of darkness or inclement weather.

NOTE: This permit does not eliminate the need to obtain any additional permits, approvals or
authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit
No. 197800056 (COE Action Id. No. 199811254).

PROJECT SUMMARY: The applicant is proposing to construct a pier which is to be used for
mooring and water quality monitoring.

The applicant owns a 8 acre tract of land adjacent to South Creek at 2002 Hickory Point
Road near the Town of Aurora in Beaufort County, North Carolina. The property has been used
as a water quality and aquaculture field laboratory since the mid 1960's. Located at the site are
several buildings which are used as offices, research facilities, etc., ect. Throughout the years of
occupancy, several aquaculture ponds have been excavated at the site, however, much of the site
remains wooded.
Shoreline erosion is an ongoing problem and several attempts have been made to combat
the problem, however these attempts have produced limited success.
Vegetation on the property varies from upland grasses, mixed hardwoods and pines, to
areas of coastal wetlands in the undeveloped areas.

The applicant is proposing to replace a pier that was lost during Hurricanes Bertha and
Fran. Proposed at this time is a 264' long by 6.0' wide pier with a 22' long by 6.0' wide T-
platform at the waterward end. Also located on the pier will be a 3.0' wide by 6.0' long stepdown
platform, an on the west side of the pier a 3.0' wide by 7.0' long access platform which terminates
into a 12.0' long by 2.0' wide access pier. These two accesses will form an area for a boat
mooring on the east side of the pier. Water depths at the waterward end of the completed pier
will be approximately 5.0' at normal water.
ENVIRONMENTAL IMPACT
The project as proposed should have a minimal environmental impact.

I have reviewed the subject application in regards to the NCAC 7H .0207 and .0208
guidelines, specifically .0208(b)(6), and have determined the applicant's proposal to be
consistent. Therefore, I recommend the permit be issued with the following conditions:
(1) No sewage, whether treated or untreated, shall be discharged at any time from
boats using the docking facility. Any sewage discharge at the docking facility
shall be considered a violation of this permit for which the permittee is
