Askew New Route 1, Box 158, SwanQuarter, N.C. 27885 This permit authorizes excavation and/or filling in Hyde County, N.C. at SwanQuarter Harbor Canal as requested in the permittee's application dated 7/l/77- incl. attached plat dated 6/28/77 subject to the conditions set forth below. (1) That an earthen plug be left between the inland canal and the existing canal until excavation landward of the plug is completed. To prevent unnecessary sediments from reaching adjacent waters, a 24-hour period J of time be allowed to elapse prior to removal of the plug.(2) That no excavated or fill material be placed at any time in any marshor waters of the State outside of the alignment of the fill area indicated on the plat. (3) That the spoil shall be provided with a ground cover sufficient to restrain erosion within 30 days after completion of the land disturbing activity. (4) That the activity be conducted in such a manner as to prevent significant increases in turbidity outside of the area of construction or construction -related discharge (increases of 25 JTU's or less are not considered significant). IF THE ABOVE CONDITIONS AND THE PLANS AND SPECIFICATIONS SUBMITTED AS PART OF THE APPLICATION (WHERE NOT IN CONFLICT WITH THE CONDITIONS) ARE NOT FOLLOWED PRE- CISELY, THE PERMITTEE IS SUBJECT TO A FINE, IMPRISONMENT, OR CIVIL ACTION AS PROVID- ED IN G.S. 113-229 (K) AND (L). This permit may be objected to by the permittee within twenty (20) days of the date of issuance. Failure to submit such objection shall be interpreted as an agreement of compliance with all permit conditions. This permit must be displayed along with a copy of the application and the project plat in the cab (or pilot- house) of the equipment working on the project, or be easily accessible, on site, to Department personnel when the project isinspected. Any maintenance work or project modification requires further Departmental approval. Subject to permit renewal, all work must cease when the permit terminates. Askew 7-1-77 Location - Hyde County - Swan Quarter, Swan Quarter Canal, 1/2 mile south of Swan Quarter. Investigative process - The site was investigated 6-24-77; app. rec. Morehead 7-5- 77. Permit request initiated in Morehead. Environmental setting - The project site is located on the Swan Quarter harbor canal about 1/4 mile up the canal from Swan Quarter Bay. The site is a 50' x 100' lot, with an average elevation of approximately 2', vegetated primarily with a mixture of weeds and salt meadow grass (Spartina patens). An existing dirt road runs through the lot which provides access to property on either side of the site. Immediately to the rear of this lot, the area is vegetated with a homogeneous stand of black needlerush (Jun- cus roemerianus). Project description - The applicant proposes to excavate a 30' long by 20' wide boat basin into his property. Approximately 130 cu.yds. of largely loom and muck material will be excavated to a depth of 6' and spread evenly over the remainder of the lot. Environmental impact - If the project is carried out as proposed, some short term turbidity will result during excavation. Several hundred sq.ft. of salt meadow hay marsh will be filled. According to the applicant, the site will be used for docking a commercial fishing boat and no buildings are planned for the site.
