(1) That the fill must not exceed 4' from the toe of the existing bulkhead at any point along its alignment. (2) That all fill material be obtained from a highland source. (3) That no excavated or fill material be placed at any time in any marsh or -J waters of the State, except as described on the attached plat. (4) That erosion be controlled on all disturbed areas with a vegetative cover or by other appropriate means within four weeks of completion of the land disturbing activity. (5) That the activity be conducted in such a manner as to prevent significant t increases in turbidity outside of the area of construction or construction n _ related discharge (increases of 25 JTU's or less are not considered r significant). THAT IF THE ABOVE CONDITIONS AND THE PLANS AND SPECIFICATIONS SUBMITTED AS PART OF THE APPLICATION (WHERE NOT IN CONFLICT WITH THE CONDITIONS) ARE NOT FOLLOWED PRECISELY, THE PERMITTEE IS SUBJECT TO A FINE, IMPRISONMENT, OR CIVIL ACTION AS PROVIDED IN G. S. 113-229 (K) AND (L). That this permit may be objected to by the permittee within twenty (20) days of the date of issuance. Failure to submit such objection shall be interpreted as an agreement of compliance with all permit conditions. That this permit must be displayed along with a copy of the application and the project plat in the cab (or pilot -house) of the equipment working on the project, or be easily accessible, on site, to Department person- nel when the project is inspected. That any maintenance work or project modification requires further Departmental approval. Subject to permit renewal, all work must cease when permit terminates. Alton - 7-21-76 Location - Beaufort County - Chocowinity Bay - Moores Beach located at the end of SR 1177. Investigative process - App. rec. Raleigh 7-23-76; Morehead 7-26-76. Site investigated 8-3-76. Environmental setting - The site is an existing lot with dwelling located at the end of Moores Beach Road on Chocowinity Bay. The shoreline has previously been bulkheaded. This bulkhead appears to be deteriorating as a result of wave underwashing along the base. The overall lot rises from an elevation of approximately 21 adjacent to the shoreline to a height of 15' near the existing dwelling. The lot is well vegetated and wooded. Immediately offshore of the existing bulkhead the bottom appears to be characterized by a detrital deposit overlying a sand base. No submerged aquatic vege- tation was observed in the immediate vicinity of the bulkhead. Project description - The applicant proposes to place rip -rap along the face of the bulkhead for a length of 200' and a width of 4'. The rip -rap will consist of rock and concrete and gravel. It is intended that the rip -rap protect the toe of the existing bulkhead from further washing. Environmental impact - If the project is completed as proposed,.approximately 800 sq. ft. of shallow, near shore habitat will be filled. No marsh grass or submerged aquatic vegetation will be affected by this project. Further erosive action at the base of the bulkhead will be effectively halted.
