This permit authorizes excavation and/or filling in Beaufort County, N.C.
at Chocowinity Bay (Moores Beach, end of SR 1177) as requested in the permittee's
7/21/76; incl. attached mod. plats, 2, dated rec. 10/25/77
application dated subject to
the conditions set forth below.
(1) That the modified bulkhead alignment indicated on the plat dated
October 25, 1977, must not exceed 10' from the normal high water
mark at any point along its alignment.
(2) That the rip -rap fill must not exceed 4' from the toe of the existing
bulkhead at any point along its alignment.
(3) That no excavated or fill material be placed at any time in any marsh
or waters of the State, except as described on the attached plat.
(4) That erosion be controlled on all disturbed areas with a vegetative
cover or by other appropriate means within four weeks of completion
of the land disturbing activity.
(5) That all fill material be obtained from a highland source.
(6) That the activity be conducted in such a manner as to prevent
significant increases in turbidity outside of the area of
construction or construction -related discharge (increases of
25 JTU's or less are not considered significant).
IF THE ABOVE CONDITIONS AND THE PLANS AND SPECIFICATIONS SUBMITTED AS PART OF THE
APPLICATION (WHERE NOT IN CONFLICT WITH THE CONDITIONS) ARE NOT FOLLOWED PRE-
CISELY, THE PERMITTEE IS SUBJECT TO A FINE, IMPRISONMENT, OR CIVIL ACTION AS PROVID-
ED IN G.S. 113-229 (K) AND (L).
This permit may to objected to by the permittee within twenty (20) days of the date of issuance. Failure
to submit such objection shall be interpreted as an agreement of compliance with all permit conditions.
This permit must be displayed along with a copy of the application and the project plat in the cab (or pilot-
house) of the equipment working on the project, or be easily accessible, on site, to Department personnel
when the project is inspected.
Any maintenance work or project modification requires further Departmental approval. Subject to permit
renewal, all work must cease when the permit terminates.
This permit terminates on
December 31, 1978
