Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) The bulkhead will be positioned in strict accordance with permit plans. 2) All backfill materials will be obtained from a high ground source and confined landward of the permitted bulkhead. 3) An earthen plug will be left between the basin and the canal off the Pamlico River until excavation landward of the plug has been completed. To prevent sedimentation in adjacent waters, 24 hours will be allowed to elapse before the plug is removed. 4) Excavation will not exceed 5' below the normal water level. 5) No vegetated wetlands will be excavated or filled. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. PROJECT SUMMARY: The his on a manmade Proiect settin The applicant's property is located in Beaufort County off SR 1737 adjacent a manmade canal off the Pamlico River. The lot is approximately 3 acres in size and is approximately 3' above NWL. Existing on the property is a single family residence, bulkhead, pier, and boatramp. The property is classified as transitional according to the Beaufort County Land Use Plan. Vegetation on the site consists of a variety of lawn grasses and a number of pine trees. The adjacent waters are classified as SB by the N.C. Division of Environmental Management. Project description The applicant proposes to excavate a boat basin in the highground area of his property. The design of the basin will allow it to be cut at an angle into the bank with a maximum length of 85' along the longest side adjacent the bank and a maximum width of 22' at its head. The basin will be excavated to a depth of 5'. (See attached plat) The spoil from the excavation activity will be placed on the applicant's property on an approved highground site. The applicant also proposes to construct a boathouse within the basin measuring 40' long by 22' wide at its outer dimensions. A 110' bulkhead will also be constructed adjacent the highground side of the canal in an effort to stabilize the shoreline, 20' of this bulkhead is an existing section which is in need of repair. Environmental impacts The project as proposed will result in the excavation of approximately 1870 sq.ft. of highground resulting in approximately 554 cubic yards of spoil material to be placed at the spoil disposal site. It is expected that some short term turbidity will result from the excavation of the basin. Raleigh W. If the applicant is not claiming to be the owner of said property, then for- ward a copy of the deed or other instrument under which the owner claims title, plus written permis- sion from the owner to carry out the project. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on 8 Sh x 11 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue -line prints or other larger plats are acceptable only if 16 high quality copies are provided by the applicant. (Contact the U.S. Army Corps of Engineers regard- ing that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency per- sonnel unfamiliar with the area to the site. Include county road (SR) numbers, landmarks, and the like. A stormwater management plan, if applicable, that may have been developed in consultation with the Division of Environmental Management.
