(1) That the bulkhead must not exceed 5' from the MHW line at any point along
its alignment.
(2) That all backfill material be obtained from a highland source and confi
behind the permitted bulkhead.
(3) That a ground cover sufficient to restrain erosion must be planted or
otherwise provided within thirty (30) working days on spoil, fill and c
other disturbed areas upon which further active construction is not bein W w
undertaken.
(4) That the activitybe conducted in such a manner as to V V prevent significan � Z
increases in turbidity outside of the area of construction or constructi -
related discharge (increases of 25 JTU's or less are not considered
significant).
THIS PERMIT WILL BE VOIDED AND WORK STOPPED IF THE ABOVE CONDITIONS AND THE
PLANS AND SPECIFICATIONS SUBMITTED AS PART OF THE APPLICATION (WHERE NOT IN
CONFLICT WITH THE CONDITIONS) ARE NOT FOLLOWED PRECISELY. PERSONS FOUND
GUILTY OF A VIOLATION UNDER G. S. 113-229 ARE SUBJECT TO A FINE OR I,MPRISONMENT,
OR BOTH.
This permit, (as approved with conditions), may be objected to by the applicant or by
interested State agencies within twenty days of the date of issuance by giving written notice to the
issuing office. If the applicant does not submit an objection, this will be interpreted as an agreement of
compliance with all permit conditions.
This permit must be displayed along with a copy of the application and the project map in the
cab (or pilot -house) of the vehicle working on the project, or be easily accessible on site to Department
personnel when the project is inspected.
Notify: Permit Section, Division of Marine Fisheries, Box 27687, Raleigh, North Carolina,
27611 when the project is completed.
Any maintenance work or additional work on the project subsequent to the termination of
this permit requires permit renewal and/or modification.
This permit shall terminate on December 31, 1976

Investigative process - App. rec. Raleigh office 8-25-75; Morehead 8-27-75. Investigated
site 8-29-75. Requested addtl. inf. 9-9-75; met with app. onsite 9-25-75, and rec. re-
quested modified plat 10-6-75.
Environmental setting - The project is located on Bond Creek in the South Creek community
at the end of SR 1910. The property consists of 200' wide by 235' deep lot which stretches
from SR 1910 to the shoreline of Bond Creek. The tract consists of a high ground lot
which is covered with large pine and gum trees. The property is to serve as a future
homesite for the applicant. The shoreline is receiving moderate to heavy erosiuil along
the westernmost 100' of the shore. Various exposed roots and stumps attest to the wa-
ter's erosive action. The easternmost shoreline of the property is bordered by a 10-30'
wide border of giant reedgrass (Spartina cunosuroides). There appears to be little or
no erosion occuring on this eastern half of the property.
Project description - The applicant proposes to erect a 119' long bulkhead along the
west shoreline of the site. The proposed bulkhead will vary from 2-5' from the MHW
line. The area encompassed by the bulkhead is to be backfilled by hauling in fill ma-
terial from an upland source. The proposed project, as modified, will destroy no marsh
grass.
Environmental impact - The area to be bulkheaded is now receiving moderate to heavy ero-
sion. There is no marsh grass in the proposed backfill area. The bulkhead alignment is
not to exceed 5' from the MHW line. The proposed work will cause some short-term local-
ized turbidity at the project site.

I am writing to confirm our meeting at your property on Bond Creek on September
25, 1975. I understand from our meeting that you wish to modify your pending
dredge and fill request dated August 13, 1975, to reflect the following:
1. The length of your proposed bulkhead is to be changed from 200' in
length to 119'.
2. That the remainder of the property is to be left unaltered.
For your convenience, I have enclosed a modified drawing which you may use in
preparing your new plat.
The original copy of your new drawing should be sent to the USA Corps of En-
gineers in Wilmington with a letter of explanation; a copy should be sent to
me here at our Morehead City office.
You application is being held in our pending file, and processing will be re-
sumed upon receipt of the revised plat from you.

Our Raleigh office has furnished us with your application for a permit to
bulkhead at your property on Bond Creek. I made a routine inspection of
the site on August 29, 1975, and was unable to interpret your plans in re-
lation to the shoreline of the property. In other words, I am not sure as
to the alignment of your intended bulkhead in relation to the present mean
high water line, and in relation to the marsh border along the shoreline.
I have tried to reach you by phone on several occasions, but have been un-
successful. I suggest that we meet at your project site in order to clarify
your intentions. Will you please, therefore, contact me at this office so
we may set up a meeting date. The telephone number is 726-7021, Morehead
City.
We are placing your file in our pending file until we hear from you, and
processing will continue on your application as soon as your plans are
clarified. I will look forward to hearing from you concerning a meeting
