RE: Refinement of CAMA Major Development Permit No. 89-13 (TIP No. R-3601),
Widening of US 17-74-76/NC 133, Brunswick County.
Dear Mr. Hancock:
This letter is in response to your letter dated September 21, 2015, including two (2) revised drawings dated
September 20, 2015. The letter requests authorization to revise the construction plans for the above
referenced project to allow expansion of the authorized work bridge adjacent to Structure 107 by ten
additional feet to the south. The letter also indicates that the N.C. Department of Transportation (NCDOT)
proposes to place an additional 0.03 acres of temporary fill in Section 404 Wetlands to expand the authorized
causeway for work bridge access at Site 10. The letter also indicates that approximately 0.07 acres of
additional hand clearing in Section 404 Wetlands will be required for construction of the work bridge.
Please be advised that through this Letter of Refinement the N.C. Division of Coastal Management (DCM)
conveys its determination that the proposed revisions are consistent with existing State rules and regulations
and are in keeping with the original purpose and intent of CAMA Major Permit No. 89-13. This letter shall
be attached to the original CAMA Permit No. 89-13 which was issued on August 2, 2013, as well as all
subsequent modifications and letters of refinement, and all documents must be readily available on site when
a DCM representative inspects the project for compliance. All conditions and stipulations of the active
permit remain in force unless altered herein. This approval does not eliminate the need to obtain any
additional permits, approvals, or authorizations that may be required.

R-3601 Modification to 401 Water Quality Certification, issued September 15,

The purpose of this letter is to revise our most recent submittal for Site 10 and request
modifications and a letter of refinement of the issued permits to further accommodate
construction of the temporary work bridge on the south side of Structure 107. Please find
enclosed the revised permit drawing sheets 28, 29, and 44 for the above referenced project.
The contractor needs an expansion of the work bridge by ten feet additional to the south side of
the original proposed work bridge. This necessitates additional temporary fill needs for the
approach to the proposed widened work bridge which also creates additional hand clearing needs.
Our last request did not account for hand clearing at the east end of the proposed work bridge,
Totals are as follows for this revision: 1) 10 feet expansion of the work bridge to the south side.
(2) 0.05 acre of temporary fill for the work bridge approach. (3) 0.11 acre of hand clearing for the
work bridge.
Regulatory Approvals
CAMA: NCDOT requests that the Coastal Area Management Act (CAMA) Major Development
permit (#89-13) issued on July 22, 2014 be modified to account for an increase in impacts.
Section 404 Permit: All aspects of this project are being processed by the Federal Highway
Administration as a "Categorical Exclusion" in accordance with 23 CFR 771.115(b). The
NCDOT requests that these activities be re -issued under the existing Nationwide Permit 23 (refer
to NWP 23 issued on July 14, 2014 SAW-2007-03641-010).
Section 401 Permit: We anticipate 401 General Certification number 3891 will apply to this
project as it was previously permitted (refer to 401 Water Quality Certification issued on July 14,
2014 DWQ#: 13-0472). NCDOT is providing this modification request to the NCDWR for their
review and approval.

The purpose of this letter is to request modification and/or a letter of refinement of the issued
permits on this project to accommodate construction of the temporary work bridge on the
south side of Structure 107. Please find enclosed the revised permit drawing sheets 28, 29 and
44 for the above referenced project.
The contractor has determined an additional 0.02 acre of temporary fill is necessary to create a
causeway for work bridge access at site 10. In addition, approximately 0.04 acre of hand
clearing will be required for construction of the work bridge.
Regulatory Approvals
CAMA: NCDOT requests that the Coastal Area Management Act (CAMA) Major
Development permit (#89-13) issued on July 22, 2014 be modified to account for an increase
in impacts.
Section 404 Permit: All aspects of this project are being processed by the Federal Highway
Administration as a "Categorical Exclusion" in accordance with 23 CFR 771.115(b). The
NCDOT requests that these activities be re -issued under the existing Nationwide Permit 23
(refer to NWP 23 issued on July 14, 2014 SAW-2007-0364 1 -0 10).
Section 401 Permit: We anticipate 401 General Certification number 3891 will apply to this
project as it was previously permitted (refer to 401 Water Quality Certification issued on July
14, 2014 DWQ#: 13-0472). NCDOT is providing this modification request to the NCDWR
for their review and approval.

rap in locations where temporary fill has been located on the west bank area of Alligator Creek for
Structures 107 and 108. Your request also indicates that the rip rap would cover an area of approximately
1,250 square feet and stabilize the disturbed areas adjacent to the bridges.
Please be advised that through this Letter of Refinement the N.C. Division of Coastal Management
(DCM) conveys its determination that the proposed revisions are consistent with existing State rules and
regulations and are in keeping with the original purpose and intent of CAMA Major Permit No. 89-13.
This letter shall be attached to the original CAMA Permit No. 89-13 and all documents must be readily
available on site when a DCM representative inspects the project for compliance. All conditions and
stipulations of the active permit remain in force unless altered herein.

The North Carolina Department of Transportation is requesting a Letter of Refinement for
CAMA Major Development Permit # 89-13. The specifics of this request are that NCDOT would
like to place additional rip rap in a location where temporary sheet pile has been located. It is
thought that the additional rip rap proposed would help better stabilize the disturbed area in the
short and long term. Please see the attached drawing in regard to this request. The following
quoted section in this regard was relayed by the onsite inspector
"As we earlier discussed, the ST Wooten Superintendent (Joe Knoll) has proposed using
additional fabric and Rip -Rap at End Bent 1 of Structural 108. This is the location where
the Temporary Work Bridge for Structure 108 was removed. The additional Rip -Rap
would extend approximately 25' South of the Toe of Slope in the permitted area. The
Rip -Rap would than tie into the exiting Rip -Rap slope at a 45 degree angle. Please see the
attached sketch for the approximate locations.
The additional Rip -Rap and fabric will provide NCDOT a permanent solution to a
potential erosion control problem. The contractors will not need to perform any
excavation in established vegetation to place the Rip -Rap. Additionally, all of the
additional Rip -Rap and fabric will be above the high tide elevation. The contractor has
proposed to Rip -Rap approximately 250 Sq. Ft. of additional slope at no cost to
NCDOT."

Dear Mr. Hancock:
This is in response to your correspondence, dated March 12, 2015 and March 27, 2015,
requesting authorization to revise the construction plans for the project. Your request letter
indicates the following:
The original permitted clearance under the end bents on the eastern side of Bridge No. 107 and
Bridge No. 108 was set at 4 feet to allow for maintenance and inspection, however, due to
oversight, the impacts associated with the excavation to allow for this clearance was not
quantified in the drawings or impact summary. It has been determined that impacts can be
reduced and adequate room can still be allowed for inspection and maintenance if clearance is
limited to 2 feet. Your letter indicates that limiting clearance to 2 feet will reduce impacts to
stream banks and wetlands, avoids the need for riprap below the tide line, and will not lead to
scour of the stream banks. This design change will result in an additional 0.O1 acre of
excavation in Section 404 wetlands and 0.01 acre of hand clearing from what was quantified in
the permitted drawings and impact summary.
The request also indicates that additional permanent surface water impacts and temporary

Stephen and I meet onsite yesterday with the contractor and DOT to go over the revised permit application to make
sure that the proposed impacts covers all of the impacts necessary to construct Bridges 107 and 108 and provide
adequate clearance for inspection of the bridges. I spoke with Brad this morning to discuss our findings and we have
determined that the permit drawings submitted on 3/12/15 and the revised impact summary table submitted by e-mail
on 3/25/15, adequately covers the required impacts associated with the bridges and we will issue the
permit/modifications based on this information.
We did discuss the potential permanent surface water fill associated with the proposed rip rap along the western
endbent of Bridge 108 and decided, that the impacts as shown on the current permit drawings is minor and would not
change the permanent surface water impact total noted in the revised wetland impact summary, therefore no changes
in the submittal is warranted.
We were very disappointed to discover that the contractor had already installed the cap on Bent 1 of Bridge 107 prior to
the issuance of this modification. Under no circumstances should DOT or their contractors, commence an activity
within jurisdictional areas prior to authorization. Had more substantial impacts occurred outside of the cap footprint, a
NOV would have been warranted.

I think this will work. Mason will be on this job tomorrow so he will take the latest drawing and write up with him to
confirm that this is what the contractor needs. Just to point out a bit of semantics, there is no approved JD for this
project only preliminary so to be accurate you should change that language in your write up. The other issue the
agencies need to do a better -job of around bridges is to establish the high water marks in the field. This is not always
done by the regulatory agencies nor is it always requested.
Mason and I have tried to make this more a priority with the low impact bridge process but I feel sure the in -field high
water mark was not established during this prelim JD.
It sounds like Mason will be able to weigh in on Friday.

In hopes of savingtime I've attached a draft wording that we would include in our revised modification
request. Additionally, the impact summary sheet has been revised (some of you may have already seen this latest
version) and is also attached.
The attached impact summary table has been revised to indicate the temporary and permanent impacts associated with
placing the end cap on bent 1 of the eastbound bridge over Alligator Creek. Temporary impacts in note 2 have been
reduced by 0.01ac as this area is now added to note 1 as a permanent impact. The ground surface around the end cap
will be restored to its previous elevation.
Excavation will occur under the bridges over Alligator Creek in order to provide an approximate two foot clearance. On
the westbound bridge, soil will be excavated to an elevation of 2' while on the eastbound bridge the excavated elevation
will be 3'. Impacts were calculated using these elevations along with the wetland line and the stated high water
elevation of 1.79' from the approved jurisdictional determination. Since excavation will not be below the high water
elevation on the east bank, we do not anticipate surface water impacts in this area.
If this resolves everyone's concerns, we'll submit the revised mod request shortly after I hear from you all.

Based on our conversations with the Corps of Engineers and Division 3, the modification request for R-3601 submitted
on March 13, 2015 may not correctly address all of the impacts associated with the proposed construction of the bridges
over Alligator Creek (Site 10). The following items need to be either clarified or revised before DWR can process the
modification request:
1. Bent 1 on the northbound lane - the drill shafts were permitted as a permanent surface water impact in the original
authorization, however the cap is now proposed to be at orjust below natural ground which is below the OHM and
therefore should be added as a permanent surface water impact. Please clarify if this has been accounted for in the
permanent surface water impacts or adjust the impacts accordingly. NOTE: if the proposed temporary excavation for
the cap form around Bent 1 is not going to be restored to its pre-existing elevation, it must be listed as a permanent
surface water impact as well.
2. Permanent wetland impacts is being proposed in this modification request at the northern endbents (Endbent 2) of
both bridges over Alligator Creek for inspection clearance purposes. It is our understanding that this excavation may
extend beyond the depicted wetland boundaries and into natural ground below the OHM at both bridges which is a
permanent surface water impact. Please clarify if additional excavation below the OHM is required at the endbents
and if it is please adjust the permanent surface water impacts accordingly.
Pursuant to 15A NCAC 2H .0507(a)(5), we have placed the permit application on hold until we are supplied the necessary
information. You have 21 days to respond in writing with the requested information or notification to this office that
the information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing, we
will assume you are withdrawing your application and it will be returned. Furthermore, until the information is received
by the NC Division of Water Resources, we request (by copy of this letter) that the US Army Corps of Engineers and the
Division of Coastal Management place the permit application on hold.

The purpose of this letter is to request modification/re-issuance of the issued permits on this
project to account for a change in clearance under bridges 107 and 108 crossing Alligator
Creek. Please find enclosed revised permit drawings and wetland impact summary table for

decreased from four feet to two feet. The newly calculated impacts are included in this
modification request. The reduction in excavation limits impacts to streambanks and
wetlands, avoids the need for riprap below the tide line, and will not lead to scour of the
streambanks. The design change will result in an additional 0.01 acre excavation in wetlands
and 0.01 acre of hand clearing from what was previously permitted.
In addition, temporary excavation around end bent one on the northbound bridge has been
added to the impact summary (0.03 acres; see note 2). The area to be excavated is not located
in a jurisdictional wetland and the elevation in this area is just at or below the tide line as
measured for the permit. Due to an increase in tide levels, this area is now below the tide line.
A revised EEP acceptance letter showing the increase in permanent impacts is attached to this
request.
Regulatory Approvals
CAMA: NCDOT requests that the Coastal Area Management Act (CAMA) Major
Development permit (#89-13) issued on July 22, 2014 be modified to account for an increase
in impacts.
Section 404 Permit: All aspects of this project are being processed by the Federal Highway
Administration as a "Categorical Exclusion' in accordance with 23 CFR 771.115(b). The

Section 401 Permit: We anticipate 401 General Certification number 3891 will apply to this
project as it was previously permitted (refer to 401 Water Quality Certification issued on July
14, 2014 DWQ#: 13-0472). All general conditions of the Water Quality Certification will
continue to be met. NCDOT is providing this modification request to the NCDWR for their
review and approval.

supplied by you on March 11, 2015, the additional wetland impacts are located in CU 03030005 of the
Cape Fear River Basin in the Southern Outer Coastal Plain (SOCP) Eco-Region, and are as follows:

impacts associated with this project located in cataloging unit 03030005 of the Cape Fear River basin as

'Some of the stream and wetland impacts may be proposed to be mitigated at a 1:1 mitigation ratio. Sce permit application for
details. EEP will provide the amount of mitigation as determined by the regulatory agencies.
This mitigation acceptance letter replaces the mitigation acceptance letters issued on May
28, 2014 and March 10, 2015. EEP has previously made debits for the stream and wetland mitigation
requirements to mitigation sites available in the cataloging unit based on the amounts required in the
original and modified permits issued in 2013 and 2014. Upon issuance of the permit modifications for
the project, EEP will make appropriate adjustments to the existing mitigation debits. At this time, no
additional stream or wetland mitigation is anticipated to be needed for this project.
