This permit is void if the above conditions are not adhered to and followed. Notification of the completed project must be given this office upon its com- pletion. This permit must be displayed with a copy of the application in the cab or pilothouse of the vehicle working on the project, whichever is applicable, and be easily accessible to Department of Conservation and Development personnel. This permit is terminated on December 31 of the next year subsequent to the year of issuance. Any additional work or maintenance work on the project subsequent to the termina- tion of this permit requires a new permit. The permit, as approved with conditions, may be objected to by the applicant or by interested State agencies within twenty days of the date of issuance by giving written notice to the Department of Conservation and Development. Applicant is advised of the requirement under General Statute §146-6.1 that power -operated earth moving equipment operating or .o be operated in or on publicly owned tidelands, publicly owned beaches, publicly owned marshlands, or navigable waters within the State must be registered by the owner of the equipment with the Department of Water and Air Resources. Cpp. for C&D Permit - Aug. 12, 1970 This application is for dredging on both sides of Neuse River near Cherry Point and near Minnesott Beach to provide ferry service between the two points. I have in- spected the plan carefully. Doug Ringer met with kRC biulogist Jack Donnelly on September 1 and inspected the proposed terminal site near Cherry Point. The project specifications for the Minnesott 3each site indicate dredging of the approach channel and most of the turning basin will be within the river, with a 100-ft. wide slip approximately 120 feet long dredged landward of the present shoreline. The 46,600 yards of spoil would be confined on land in an existing non - tidal are4;ome 2 1/3 acres. Vegetative species composition of this low lying area has not been determined. Development of this site as proposed should have minimal effects on fishing values of the area, provided suitable spillways are provided to reduce siltation from the effluent. The site near Cherry Point involves dredging an approach channel nearly 1/2 mile long in the river which would merge with a turning basin and harbor to be dredged within the adjacent land area. The land area to he dredge-1 involves some 9 acres of an existing small drainage area known as Cherry Branch, e+lthough of indefinite proportions, the project map indicates some uncontained disposal of dredged material in the river adjacent to the proposed channel, some along the shore on both sides oflthe entrance channel, and some in the Cherry Branch drainage area beside and im- mediately upstream of the basin. Unrestrained disposal in the river proper will remove a definitive portion of the fisheries habitat and cause excessive siltation over a much greater area. , concerted effort should be made to pump this material to ade- quate retaining areas either along the shore or as near shore as is reasonably possi- ble. Such confining of spoil materials would not only substantially reduce habitat loses, but should also effectively reduce future maintenance costs. Cherry Branch is a relatively small stream, usually less than 10 feet in width. There are some pools and eddies caused by normal shoaling and fallen trees. The drainage area is larger than previously suspected, and comprises a typical and picturesque hardwood swamp. Various land drainage and reclamation projects are eliminating areas of this type from the .American scene at a rate alarming to most conservationists and wildlife enthusiLsts. -2- There remain some questions as to whether normal stream runoff will be im- pounded above the spoil materials to be located around the proposed basin. Adequate consideration of someeaffected,fish.and.wildlife values will be some- what dependent upon the nature of upstream changes. The need for an established ferry service across the Neuse River at this point is recognized, and is further emphasized by a reported privabb passenger service (apparently not authorized) now operating to and from.the marine -base at its'Han- cock Creek Marina landing. In summary, some damaging effects to the fishery re- source will occur. These however can be significantly, reduced if serious consi- deration is given,to:, 1. placement of all spoil material either on land, along the shore -line, or as near shore as is feasible, and 2. reasonable retention of all spoil in adequately confined and spillway areas. Prior to any dredging work the completed diked disposal area will be inspected and approved by a representative of the Corps of Engineers. 2. The depth of the access channel will not exceed 10 feet, mean low water (MLW). 3. In order to protect juvenile shrimp populations, no excavation will be permitted between the dates of 1 April through 30 September of any year without the prior approval of the NC Division of Marine Fisheries. 4. All excavated materials will be confined above the mean high water elevation landward of regularly or irregularly flooded marshlands. 5. All excavated materials will be confined above the mean high water elevation landward of adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 6. The terminal end of the pipeline from the dredge into the retention area will be positioned at or greater than 50 feet from any part of the dike and at a maximum distance from spillways to allow adequate settlement of suspended solids. 7. A drop -inlet water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to.insure maximum settlement of suspended solids. 8. Flow from the diked retention area will be confined by pipe or trough to a point at or below the normal low water elevation to prevent gully erosion and resultant unnecessary siltation. 9.
