authorizing development in Craven Countyat Neuse River (S. Side at Cherry Branch Ferry
Terminal as requested in the permittee's application dated 5 /3/90 including
attached plats, 2, dated received 5/7/85.
This permit, issued on May 21, 1990 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1)_All excavated materials will be confined on highground behind adequate dikes
or other retaining structures to prevent spillover of solids into any marsh
or surrounding waters.
(2) The disposal area effluent will be contained by pipe, trough, or similar device
to a point at or below the MLW mark to prevent gully erosion and resultant
unnecessary siltation.
(3) The terminal end of the pipeline will be positioned at or greater than 50'
from any part of the dike and a maximum distance from spillways to allow adequate
settlement of suspended solids.
(4) A water control structure will be installed at the intake end of the effluent
pipe so as to assure compliance with Condition No. 5.
(5) The activity will be conducted in such a manner as to prevent significant

other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
June 30. 1995
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
increases in turbidity outside of the area of construction or construction -
related discharge (increases of 25 JTUs or less are not considered significant).
(6) The diked disposal area must be constructed a sufficient distance from
the MHW line or any marshland to eliminate the possibility of dike erosion
into or upon the adjacent waters and/or marshland.
(7) In order to protect juvenile shrimp populations, no excavation or filling
will be permitted between the dates of April 1 through September 30 of
any year without the prior approval of the Division of Coastal Management.
NOTE: The permittee is requested to call the DCM at 726-7021 and arrange for
a final inspection of dike and water control structure prior to beginning
actual dredging.
Maintenance Clause
For any maintenance after Dec. 31, 1990, the Department must be notified in
writing at least two (2) weeks in advance of work authorized by this permit
and that notification must include:
A. the number of the original dredge and fill permit.
B. a statement that no dimensional changes are proposed.
C. a copy of the original permit plat(s) with cross -hatching indicating the
to be maintained, the area to be used for spoil, and the estimated amount
of material to be removed.
D. the date of map revision and the permittee's signature shown anew on the
original plat.

Enclosed is a letter from Harvey G. Ramsey, Director, DOT Ferry
Division, requesting a third renewal of Permit #257 to perform
maintenance dredging at Cherry Branch Ferry Terminal, on the
Neuse River, in Craven County. There has been no rule changes
that would affect this project since the permit issuance. There
will be no dimensional changes to the project and the spoils
disposal area would be at the original site, plus, the additional
area approved by the USCOE.
I would have no objection to the issuance of a five (5) year
maintenance permit. All the conditions of the original permit
should be included in the renewal permit.

Under authority of CAMA permit number 257 and Federal permit number
SAW0085-N-025-0209, the North Carolina Department of Transportation, Ferry
Division, is permitted to perform maintenance dredging in the turn basins
and approach channels at the Cherry Branch ferry terminal on the Neuse
River in Craven County. The permit expires June 30, 1990. In order to
continue efficient ferry service to the public, I request that the permit
be renewed. mile no immediate requirement for maintenance dredging exists,
I hope to maintain a valid permit in order to be prepared for sudden dredging
requirements. There are no requested changes of conditions from those speci-
fied in the existing permit.
