Installation of rock riarap and fill material along the road shoulder for shoreline stabilization and shoulder widening 1) Fodrey Creek supports both spawning adult and juvenile anadromous fish. Therefore, no in -water work shall be conducted from February 15 to September 1 of any year without the prior approval of the NC Division of Coastal Management (DCM), in consultation with the NC Wildlife Resources Commission. 2) The authorized alignment of the proposed riprap must be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Department of Transportation ADDITIONAL CONDITIONS Permit #96-01 Page 2 of 3 3) Placement of riprap shall be limited to the areas as depicted on the attached workplan drawings. The riprap and associated fill material must be clean and free from loose dirt or any pollutant except in trace quantities. It must be of a size sufficient to prevent its movement from the site by wave or current action. The riprap material must consist of clean rock or masonry materials such as but not limited to granite or broken concrete. 4) The riprap shall not extend waterward more than 8'/2 feet from the normal water level at any point along its alignment at the time of construction. 5) Filter fabric associated with riprapfbackfill must be in place prior to the placement of any backfill. 6) All backfill material will be obtained from a high ground source. No unconfined backfill may be discharged into estuarine or public trust waters. The fill material will be clean and free of any pollutants except in trace quantities. 7) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 8) All work along the canal bank shall be contained within turbidity curtains. This requirement may be waived by DCM after consultation with the N.C. Wildlife Resources Commission. 9) No vegetated wetlands will be excavated or filled. 10) This permit does not authorize any excavation. If any excavation is required, a modification of this permit will be necessary. Sedimentation and Erosion Control 11) This project is in a High Quality Water Zone and must comply with the Design Standards in Sensitive Watersheds, 15A NCAC 4B .0124. 12) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 13) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within fifteen days of project completion. 14) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, riprap, etc.). NOTE: Because of the sensitivity of the adjacent waters and the potential for fill material to be eroded away prior to becoming stabilized, the permittee is encouraged to implement all practicable measures to adequately stabilize this area to prevent sediment from entering adjacent waters. General 15) The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 16) The authorized. activity will not cause an unacceptable interference with navigation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The N.C. Division of Water Quality authorized the proposed project on 6/22/01 (DWQ Project No. 01-0718) under General Water Quality Certification No. 3258 and the Tar -Pamlico Buffer Rules. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 198000291 (COE Action ID. No. 200110774), which was issued on 7/16/01. My review indicates that the proposal appears to be consistent with these regulations. However, the project as designed and shown on the plats provides no method for preventing the earthen fill material from entering the adjacent waterbody. Therefore, if the permit is issued, I recommend the following conditions be included: 1) Backfill material must be contained landward of the permitted riprap. 2) Filter fabric associated with riprap/backfill must be in place prior to the placement of any backfill. 3) The riprap will not extend waterward more than 10 ft from the normal water level at any point along its alignment. 4) The riprap must be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. 5) All backfill material will be obtained from a high ground source. 6) The riprap material must consist of clean rock or masonry materials such as, but not limited to granite or broken concrete. PROJECT SUMMARY: Applicant proposes to place rock riprap along the shoreline of the existing canal and place fill material over the rock. NCDOT SR 1136 Hyde County Project Setting The applicant maintains a two lane asphalt road (SRI 136) adj acent to a manmade canal that is contiguous with Fodrey Creek in Swan Quarter, Hyde County, North Carolina. The existing road is approximately 25 feet wide with shoulders that are 1 to 4 feet wide. The northern road shoulder is adjacent to a manmade canal canal, and is experiencing erosion in several areas. In a few small areas, unauthorized rock or masonry material has been placed along the shoulder to protect the road and to address safety concerns. The project area is bordered on the south side by numerous commercial fishing businesses. Vehicular traffic on this road consists of commercial fishermen, trucks transporting seafood, employees of the local businesses, and customers of the seafood. houses. The north side of the project area is a manmade canal. The opposite shore of the canal is, predominately coastal wetland and is vegetated with Juncus roemerianus, Spartina cynosuroides, Distichlis s ip cats and Spartina patens. The marsh covers several acres north of the project area. There is a small undeveloped lot to the east of the project area. This lot is high ground and is vegetated with a mix of upland grass species. There is a water control structure at the culverted access to the lot. Immediately east of the lot is -the town of Swan Quarter. The west end of the project area borders an old hotel site. There is an existing.dirt parking lot and the hotel structure is still standing. The hotel has not been operational for several years, and is in disrepair. Fodrey Creek classified SA ORW by the Environmental Management Commission and is not open to shell fishing at this location. Project Description The applicant proposes to install 1050 ft of rock riprap an average of 7.65 ft waterward of NWL in a manmade canal adjacent to an existing two lane road. The toe of the rock will be a maximum distance of 8.25 ft waterward of NWL. The road shoulders will be widened by placing filter fabric and sand over the riprap. Fill material will be brought to the site to create the wider shoulders. Anticipated Impacts The project as proposed would impact 8,033 fe of canal bottom will be filled by the proposed rip rap. The purpose of this project is to stabilize the eroding shoreline that is the road shoulder to SR 1136. This shoreline has been eroding due to wind tides about one foot per year. The rip -rap will extend an average of 7.65 feet (maximum of 8.25 feet) from the shoreline and will require about 247.3 cubic yards of stone to be placed below water level. Shoulder construction will include rip -rap placed approximately one foot above high water level and about 180 cubic yards of sand from one foot above high water level to existing shoulder. Filter fabric will be placed between the rip -rap and the soil layer and the shoulder will be planted with centipede grass. I have enclosed a vicinity map, plat drawings, landowner signatures, pictures of the site, and a check to cover all permit costs.
