SR 1722 in Ransomville, as requested in the permittee's application dated 6/6/Ol including attached the workplan drawings (2): 1 dated as received on 6/8/O1; and 1 dated 6/5/O1 This permit, issued on 9/28/Ol , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Replace existine bridge #127 with 3 corrugated aluminum structural plate arch pipes with headwalls 1) In order to protect anadromous fish populations, no in -water work shall be conducted between February 15 to June 15 of any year without the prior approval of the Division of Coastal Management, in consultation with the NC Wildlife Resources Commission. 2) The culvert inverts must be buried at least one foot below normal streambed elevation to allow for passage of water and aquatic life. 3) No excavated or fill material will be placed at any time in any wetlands or waters of the United States outside of the alignment of the fill area as indicated on the workplan drawing(s). (See attached sheets for Additional Conditions) '1'ms permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December Al, 2004 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Department of Transportation Permit #118-01 Page 2 of 4 ADDITIONAL CONDITIONS 4) No excavation shall occur within wetlands or waters of the United States, except for that depicted on the attached workplan drawings. 5) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. This condition also applies to removal of the existing bridge structure. 6) Live concrete shall not be allowed to contact the water in or entering into the stream. 7) The fill material will be clean and free of any pollutants except in trace quantities and all permanent fill material. must be obtained from an upland source. 8) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. 9) Debris resulting from demolition of the existing bridge, including deck components, shall not enter wetlands or waters of the United States, even temporarily. 10) All excavated materials and debris associated with the removal of the existing bridge will be disposed of - at an approved upland disposal site. Ditch Relocation 11) The relocated ditch shall not be placed within wetlands or waters of the United States. 12) Adequate measures shall be taken to prevent short term and ]on- term erosion of the side slopes of the short section of ditch relocated on the southwestern comer of the project area. 13) The cut or filled slopes of the relocated ditch shall be at an angle that can be retained by vegetative or other appropriate cover. 14) Excavation of the new short section of ditch located on the southwestem corner of the project area as depicted on the attached workplan drawings shall not exceed a depth of 4 feet and shall not exceed a width of 6 feet. Sedimentation and Erosion Control 15) This project must conform to all requirements of the NC Sedimentation Pollution Control Act and NC DOT's Memorandum of Agreement with the Division of Land Resources. 16) Immediately prior to the initiation of construction, the permittee shall install turbidity curtains in the water area immediately adjacent to the replacement culverts at North Creek. The turbidity curtains shall be removed when turbidity within the curtains reaches ambient levels.-•;=, 17) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. Department of Transportation Permit #118-01 Page 3 of 4 ADDITIONAL CONDITIONS 18) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 19) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within fifteen days of project completion. 20) The activitywill be conducted in such a manner as :to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity. in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant. 21) .. This project is in a High Quality Water Zone and must comply with the Design Standards in. Sensitive _ , Watersheds, 15A NCAC 4B .0124 (25 year type H storm, 70% trapping efficiency :for +39 micron size particle in 2 year storm). 22) The permittee shall follow Best Management Practices for the 'Protection of Surface Waters and sedimentation and erosion control measures, sufficient to protect aquatic resources. General 23) If the permittee determines that additional permanent and/or temporary impacts (such as temporary access roads, detours, or matting to transport equipment across wetlands).will occur that are not shown on the attached permit drawings, additional authorization from DCM will be required. Depending upon the magnitude of the impacts and the habitat types that are impacted, additional DCM authorization.may be in the form of a refinement of this permit or a permit modification. 24) The relocation of any utility lines will require additional authorization, either by way of a modification of this permit or by the utility company obtaining separate authorization. 25) The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration of the structure or work herein authorized, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 26) This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. This includes approval, if required, from the N.C. Division of Water Quality under stormwater management rules of the Environmental Management Commission. If a Stormwater Management Permit is required, it must be obtained and a copy provided to DCM prior to initiation of construction. . NOTE: The N.C. The project consists of replacing the existing bridge with 3 culverts. The pavement width will remain the same and the shoulders will be widened just enough for compliance with Federal and State Highway Standards. Relatively small areas of 404 wetlands, and shallow bottom will be filled at the North Creek crossing. The impacts from this project would be considered minimal by the Division of Coastal Management and would qualify for a General Permit except that North Creek is Primary Nursery Area. The NC DOT has done a commendable job minimizing the impacts from their original proposal to install 70-foot culverts with 8-foot shoulders and 8 to 10 foot slopes with riprap. North Creek is joint waters. Comments from the agencies regulating these waters (as it pertains to PNA's) will determine my recommendation. The project is well designed with minimization of impacts. Without strong objections from fishery agencies, I would recommend the project be approved contingent upon the following conditions: 1) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 2) No excavated or rill material will be placed at any time, in any marsh or surrounding waters, outside of the alignment of the fill area indicated on the work plats. 3) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 4) The roadway fill material will be clean and free of any pollutants, except in trace quantities. 5) In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. June 29, 2001 PAGE 2 8. PROJECT SUMMARY: The applicant is the N.C. Department of Transportation. The proposal is to replace the degraded timber bridge with 3 corrugated aluminum structural plate pipe arches with head walls and wing walls. This will allow 8 foot shoulders that comply with State Highway standards for secondary roads. 9. PROJECT DESCRIPTION: The site of this proposal is State Road 1722, at the crossing of North Creek, in the community of Ransomville, Beaufort County, NC. The road is approximately 3 feet above NWL. The general purpose of the project is to replace the deteriorating timber bridge with culverts, to allow for a 22 foot pavement width and 8 foot shoulder width. The bridged crossing at North Creek is flanked with wooded Pine/Gum swamp wetlands, coastal wetlands, pasture and residential land. This area is primarily residential, agricultural and undeveloped wooded swamp and forest. The site consists of a 20' wide creek downstream of the crossing. The creek widens adjacent to the bridge to 25' at the south side and 31' at the north side. At the north side of the bridge (upstream), the creek branches to the main stream (15% a smaller steam (8') and a ditch. The coastal wetland consists of Spartina cynosuroides, Scirpus spp. and Cladium jamaicense. The adjacent uplands are pastuelands, agricultural fields, residential land and forested, and are vegetated primarily with various elm, pines, cedar, gum, grasses and wheat. North Creek is Joint waters at the project site, and is classified SA HQW NSW between the Pamlico River and SR 1722 and classified C Sw NSW between SR 1722 and its headwaters by the Division of Water Quality and subject to the Tar -Pamlico River Buffer Rules. The area is closed to shellfishing, and is designated as primary nursery area by the North Carolina Division of Marine Fisheries. The Beaufort County Land Use Plan designates the project area as Rural with Services , with all areas lying within CAMA Areas of Environmental Concern, designated as Conservation. The proposal is to replace the existing 30 feet wide by 35 feet long timber bridge with three 97' wide x 6'6" tall x 49'6" long corrugated aluminum structural plate pipe arch's (culverts) on the existing alignment. The addition20 foot width will allow for 8 foot road shoulders as required for State Highway standards. The ends of the culverts will be stabilized with headwalls and wingwalls to eliminate the need for slopes extending into coastal shoreline, esturine waters, public trust waters, 404 type wetlands and coastal wetlands. The approaching roadway will be unchanged. Best Management Practices will be used to minimize erosion and sedimentation. FIELD INVESTIGATION REPORT NC DOT - SR 1722, Beaufort Co. ANTICIPATED IMPACTS: As proposed, the replacement of the existing bridge with three culverts will result in the following impacts: Approximately 124 square feet of 404 type wetlands will be filled by road shoulder, and 1750 square feet of shallow bottom will be filled by culverts and fill surrounding the culverts. Approximately 96 square feet of high ground will be graded, filled or excavated for the roadway and paving. There is a high probability of turbidity to be expected during the replacement of the culverts. Stringent sedimentation/erosion control measures can minimize this. The NC DOT has reduced their original proposal to install 70 foot culverts with sloped road shoulders to the shorter 49'6" culverts with head and wing walls in order to avoid the impact of an additional 800 sgare feet of impacts to shallow bottom, esturine waters , 404 type wetlands and coastal shoreline. Principally local residents use state Road 1722. The replacement of the bridge with culverts and 8 foot road shoulders will upgrade the crossing to improve safety of traffic movement and have the comply with State safety standards for secondary roads.
