Emergency Shill Response Boat Davit Installation 1) This minor permit modification authorizes the installation of a boat davit and associated infrastructure on the north side of the Pamlico River, adjacent to the existing bulkhead within the ferry basin, as depicted in the attached workplan drawings. No other structure shall become a part of this development without additional authorization. 2) This minor modification shall be attached to the original of major permit # 595, along with all subsequent modifications and/or refinements, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2012 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. This permit was originally issued to NCDOT-Ferry Division on April 24, 1972 for the maintenance of the ferry basins at NCDOT's Aurora and Bayview Ferry facilities adjacent to the Pamlico River. The permit was renewed on December 19, 2007 has been continuously renewed for maintenance dredging since its original issuance. A minor modification to the permit was issued on April 8, 2008 to allow the installation of a boat davit for emergency spill responses. The current permit document states that the permit is set to expire on December 31, 2012, however, due to the Permit Extension Act of 2009, the actual permit expiration date is December 31, 2016. The current proposal requests that the permit be modified to allow for the placement of riprap at the Aurora Ferry Terminal. The dilapidated wooden bulkhead on the west side of the ferry basin is approximately 350' in length and is no longer functioning due to its deteriorated condition. The bulkhead would be removed where possible, filter fabric would be put down, and the riprap installed on top of it for approximately 350 linear feet around the ferry basin as shown on the attached plat. The riprap would extend out 5' waterward of the Normal Water Level. Additionally, the applicant has proposed to place 135 linear feet of riprap at the base of the berm around the spoil containment area. The riprap would be placed up to 20' in height and entirely above the Normal Water Level of the Pamlico River. The riprap is needed to protect this portion of the berm since it has been proven especially vulnerable to storms and was heavily damaged during Hurricane Irene. Mr. Winslow has requested that the required $100 fee be debited from WBS#45545.3.1 and a copy of the modification request and plans are attached. I have determined that the request for the modification of the permit is consistent with the 07H .0208 rules of the Division. I also offer the following additional conditions, with all existing conditions to remain valid unless modified herein: 1) Unless specifically altered herein, this minor modification authorizes the placement of 350 linear feet of riprap adjacent to the existing ferry basin and 135 linear feet of riplap along the berm of the existing spoil containment area as depicted in the attached workplan drawings. 2) The riprap material shall be clean and free from loose dirt or any pollutant except in trace quantities. Riprap material shall be of sufficient size to prevent its movement from the authorized alignment by wave or current action. The riprap material shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or broken concrete. 3) The filter fabric associated with the riprap shall be in place prior to the placement of any backfill. 4) This permit does not eliminate the need to obtain any additional permit, approvals, or authorizations that may be required. The bulkhead is in bad shape. The NCDOT Ferry Division is proposing to remove all of the old wooden bulkhead that can be removed, put filter cloth down, and place new riprap on top to stabilize the shoreline and prevent further erosion. The Ferry Division is also proposing to riprap the back of the berm at the Aurora spoil site to prevent further erosion of the berm wall. The subject request is for another 5 year maintenance permit. This original permit was issued 24 April 1972. Since that time maintenance excavation has occurred several times on both sides of the river. I recommend that the permit be reissued however a new condition should be added requiring a new survey of channel and basin dimensions along with up -dated water depths. I feel that much of the work that has been conducted since the original permit was issued has been accomplished with inappropriate plats. The division needs a new set of baseline plats, plain view and cross -sections if we are going to continue to issue 5 year maintenance permits on the project. Signature of Permittee NC Dept. of Transportation ADDITIONAL CONDITIONS Permit #595 Page 2 of 2 5) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 6) The disposal area effluent will be contained by pipe, trough or similar device to a point at or beyond the normal water level to prevent gully erosion and unnecessary siltation. 7) The terminal end of the pipeline will be positioned at or greater than fifty (50) feet from any part of the dike and a maximum distance from spillways to allow settlement of suspended solids. 8) A water control structure will be installed at the intake end of the effluent pipe to assure compliance with water quality standards. 9) Any dike repair will be conducted in such a manner as to prevent spillover into any adjacent marsh or surrounding waters. 10) All earthen berms, dikes, and cut or filled slopes must be provided with a ground cover (vegetative or other) within 30 working days of placement. 11) Adequate erosion/sedimentation control measures, structures and devices must be utilized until a permanent ground cover is established. 12) The instream turbidity must not be increased by more than 50 NTUs as a result of the proposed activity after a reasonable opportunity for dilution and mixture. NOTE: The proposed project is certified under General Water Quality Certification No. 1273 issued on November 10, 1978, for discharges of liquid effluent from diked upland disposal areas. NOTE: Placement of dredge spoil in impoundments has been shown to produce very favorable conditions for mosquitoes. The applicant should contact the Vector Control Branch (919) 733-6407 regarding appropriate mosquito control measures. As you are aware, the permit expires on 31 January 1994. A file review of the project indicates that when the 1987 permit was issued plats dated March 1983 were used for the renewal at that time. I feel that it would be inappropriate to again reissue the permit using 1983 plats not knowing what conditions actually exist at the two sites. Prior to this Division reissuing the permit, new updated plats must be submitted for both sites. The new plats must show accurate existing water depths and other features at both basins and in the approach channels. All spoil areas must be shown as they exist at this time in both plan view and cross-section form. The plats should show exactly where the spoil areas are located on NC DOT property and show existing discharge structures and outlets. Discussions should be provided on capacity an any other pertinent features. As you begin to compile the renewal package, I will be glad to meet with you or your surveyors to discuss in more detail what the Division will need to accept a renewal request. I have no objections to the modification of the subject permit to allow the construction of this basin. Site No. 2 is a 1.20 acre site which will be constructed within + 40' of the normal water level of the Pamlico River in a wetland area which is being utilized as a pasture. The area is vegetated with Distichlis spicata, Spartina cynosuroides, Spartina patens, Iva pp. and Spike Rush. The construction of the dike within this area will result in the permanent loss of the wetland area. The two chosen sites are labeled as site 1 and site 2 on plat 1 of 3 and are shown in more detail on plats 2 of 3 and 3 of 3. These two areas if constructed as proposed will have a capacity of + 30,000 cubic yards of materials. The terminal end of the dredge pipeline must be positioned at or greater than 50' from any part of the dike and a maximum distance from spillways to allow adequate settlement of suspended solids. 4. The spillway pipe for the disposal area adjacent to the basin at the southern side of Pamlico River must be positioned on the northern side of the diked disposal area. (See attached sheet for Additional Conditions) This permit action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on September 30,1988 to issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. During the meeting we suggested to Mr. Keech an alignment along which we felt would be a reasonable request for the bulkhead to be placed. Since Mr. T.L. Waters has already submitted to my office a request to review and modify permit number 595, I suggest that the proposed bulkhead work be included in this request. To do this, I will need a plat showing the proposed bulkhead alignment and I will need the work to be shown on the submitted application. Box 1507 Washington, NC 27889 (919) 946-6481 On 2 March 1982 I visited the two project locations on the north and south sides of the Pamlico River and would like to make the following comments: (1) The existing dike disposal area on the north side of the river is in fairly good shape. It is an adequate distance from the Pamlico River NWL so not to be affected by erosion. The dike has upland erosion problems in several locations and the basin appears to be nearly full. Prior to any maintenance excavation, the dike must be repaired, resloped, and stabilized. Also the fill materials present inside the dike must be removed to allow additional capacity. (2) The existing dike disposal area on the south side of the river is in a deteriorated state. Erosion is occurring at the toe of the dike; the dike is breached in several locations, and the disposal area has no more capacity. A major overhaul must be conducted if it is to be used again. On 11 March 1982 Steve Brown, and Terry Moore met with DOT representatives to discuss the disposal situation. The DOT representatives advised that they had no intentions of using the existing basin again, however, they would like to construct a new disposal area to the west of the existing Ate. Steve and Terry viewed the new site and made recom- mendations to the DOT. Apparently they have adequate high ground to construct the new disposal area a sufficient distance from the river. Prior to renewing the existing permit this office will need a plat showing the alignment of the new disposal area. The surrounding land area is high, apparently having been used as a spoil area during basin construction..The ferry basi is bulk - headed on two sides with the west side open. Beginning on the basin's westmRer* meter a brackish marsh area extends westward around Gaylords Bay. This bay/area is rather extensive encompassing approximately 300 acres and is covered primarily with salt reedgrass (Spartina cynosuroides). According to aerial photos taken 3-17-70, a large spoil pile has been pumped in this marsh area, covering approxi- mately 360,000 sq. yards. Apparently this work resulted from original basin ex- cavation or basin maintenance after construction. South Channel: The South Channel area has a park to the east with a wooded section on the west or up -river side. This wooded area has been used as a spoil loca- tion during previous channel maintenance. Spoil run-off subsequently created a sandy point extending 30 to 50' out into the river. Erosion has taken away much of this point area, however, with the resulting sediments apparently going back into the channel. Applicant's proposal - The N. C. Highway Commission proposes to maintain the exist- ing channels at both the north and south locations. At the north channel approxi- mately 10,000 cu. yds. of material is to be excavated and pumped on the exist- ing spoil area. According to the application, adequate dikes are to be construc- ted in order to prevent any spoil re-entry into the water. At the south channel approximately 10,000 cu. yds. of material is to be excavated. The designated spoil areas for this location are in the wooded area west of the landing, and adjacent to the park area east of the ferry dock. According to one of the ferry captains, this maintenance is badly needed due to shoaling in both the north and south chan- nel locations. Environmental effects - Apparently the areas are in need of maintenance. The areas to be excavated are existing channels, previously dug to allow ferry passage. The designated spoil areas have been used as spoiling sites in the past and according to the application, no marsh grass will be covered. I would recommend that spoil- ing in the wooded area on the south shore be confined to the highland section in order to prevent any possible spoil re-entry into the channel.
